게임 속 아이템에 관한 법적 문제는 온라인게임 산업이 매우 융성해온 한국에서는 앞으로 더 활발하게 논의될 필요가 있다. 아이템의 법적 문제는 게임 서비스제공자가 경쟁업자에 대항하여 아이템 자체의 저작권에 기한 보호를 부여받을 수 있느냐의 차원도 존재하지만, 그것보다는 약관에 근거한 게임 서비스제공자의 소위 계정압류행위나 다른 이용자에 의한 아이템 사취 등 침해행위로부터 게임 서비스이용자가 특정 아이템에 관한 자신의 보유상태를 보호받을 수 있느냐 여부가 중심이다. 필자는 일단 게임 아이템이 아닌 인터넷상에 존재하고 있는 다양한 데이터들 중 일부 정보에 관하여는 이른바 공공재의 비극을 피하기 위하여 배타적 독점권을 인정할 필요가 있다고 본다. 하지만, 이런 독점권 부여는 정보소통이 더 중요한 가상공간에서는 현실공간에서와 달리 장차 특별법이 열거한 극히 제한적인 대상에 한하여야 할 것이다. 뿐만 아니라 아이템 현금거래의 폐해가 앞으로 대폭 시정되지 않고서는 게임 아이템 자체는 이러한 독점권부여가 현재로서는 곤란하다고 사료된다.

From now on, the legal issues in game-in items should be more discussed in Korea where theonline gaming industry has been really prospering. While the legal issues includes whether or not agame service provider can be protected under the copyright of the item itself against hiscompetitors, the main issue has been whether or not a game service user might be guaranteed thepossession of a specific game-in item against the so-called freezing of the users’account by thegame service provider based on the end user license agreement or against the other users’infringing activity such as virtual item fraud. In this article, I show the necessity of creating the exclusive right for some information amongthe other various data residing on the internet, to evade so-called the tragedy of the commons oncyber space. However, unlike in the real world, the above creation should be limited to the very fewobjects enumerated in the future special act because the free communication of information is morevital in the virtual world. Moreover, game-in items themselves could not be the object of the abovecreation at least right now unless the abuses of real money trade would be heavily corrected.
