2004년 12월 Google은 주요 도서관의 소장 도서를 스캔하고 디지털화해서 세계적으로 검색가능 하게 하겠다고 선언하였고, 그 후 이 프로젝트가 실행되어 현재“Google Book Search”서비스가 제공되고 있으며 스캔 작업은 계속 진행 중이다. 발행인이나 저자가 자신의 도서를 Google에 제공하는 파트너 프로그램의 경우, 저작권 침해 문제가 야기될 여지는 없는 것으로 보이고, 도서관 프로젝트의 경우, 공적 영역의 도서에 대해서는 저작권 침해 문제가 없고, 다만 저작권의 보호를 받고 있으나 발행인이나 저자가 파트너 프로그램에 참여하지 않은 경우만이 문제될 터인데 그 역시 카드 카탈로그 방식으로 해당 도서에 대한 기본 정보 혹은 짧은 발췌문정도만 볼 수 있도록 하고 있다는 점에서 이를 저작권 침해로 보기 힘들 것이다. 결국 문제는 도서의 디지털화 작업인“스캔”이 복제에 해당되어 저작권을 침해하는 것인가 하는 점인데, 사용자가 자신이 원하는 정보를 가진 도서를 검색하기 위해서는 그 검색어가 도서의 콘텐츠에 포함되어 있는지를 확인하는 작업이 선행되어야 하며, 이 과정이 온라인에서 이루어지기 위해서는 디지털화 작업이 필수적으로 이루어져야 하기 때문에, 디지털 시대의 정보 보존 및 접근 가능성의 확대 측면에서 이를 형평법상 원칙인 공정이용(fair use)이론의 융통성있는 해석을 통해 정당화할 수 있을 것으로 보인다. 그러나 이 프로젝트의 진행과정에 대한 여러 비판점들을 경청할 필요가 있을 것이다.

In December 2004, Google announced that it would scan, digitize, and make universally searchable the collections of leading libraries. Now“ Google Book Search”is serviced and Google continues scanning. For Partner Program, because publishers or authors submit their books for inclusion in Google’s search results, there is no room for copyright infringement. For Library Project, there is also no room for copyright infringement to public domain works. It looks that the problem is in a book which is under copyright and publisher or author is not part of the Partner Program. But it’s hard to consider that service as copyright infringement, cause you can only find index about the book or a few snippets of text showing search term in context. Finally the problem is that scanning, the digitalization of books, infringes copyright as a reproduction. For knowledge preservation and accessibility in digital age, I think it can qualify as fair use with more flexible, open ended approach, cause in order to search a book which has search term in context essentially scanning should precede. But there is necessity to listen various criticism carefully about process of this project.
