2011년 12월 중국어선의불법어업을 단속하는 과정에서 중국인 선장이 휘두 른 흉기에 의해 대한민국 해경이 사망하는 사고가 발생하면서 단속이 강화되고 검찰이 석방 담보금을 상향하는 등 우리 정부의 적극적 대응에 따라 중국어선 의 불법어업이 잠시 잦아드는 듯하였다.
또한, 2008년 해상공권력 강화대책, 2011년 불법어업 근절 종합대책뿐만 아 니라, 2012년에는 해양경비법을 제정하여 불법어업 단속을 위한 추적 및 나포, 무기 사용 요건 등을 정립하였다. 그러나 세월호 참사로 해경이 사고 수습에 매진하고 있는 가운데 중국어선이 이 틈을 타 불법행위를 일삼는 것은 물론, 최근까지 통계자료를 살펴보아도 중국어선의 불법어업은 줄어들기는커녕 일정한 수준을 유지하거나 오히려 증가하고 있는 추세이다. 특히 중국어선의 불법 어업은 서해 우리 측 배타적 경제수역(Exclusive Economic Zone : EEZ)과 심 지어 우리 영해에서 발생하고 있다는 점에서 재발 방지를 위한 대책마련이 시 급하다.
그런데 중국에서는 수산물 소비량이 급증한 반면 급속한 공업화로 인한 연 안오염과 무분별한 남획으로 인한 수산·어업자원의 고갈, 불법어업행위로 단속 되더라도 3대 엄중위반행위를 제외하면 담보금만 납부하고 어획물을 반환받아 처분하는 게 경제적 이익이라는 인식 등으로 대한민국 EEZ와 영해 내에서 중 국어선의 불법어업은 근절되지 않고 있다.
이처럼 인명피해 뿐아니라 국가적 마찰을 초래하는 중국어선의 불법어업을 근절하기 위해서는 현행 체제에 대한 미비점을 찾고 개선방안 및 발전방향을 도출하여야 할 것이며, 기존의 법률적 근거가 없는 새로운 조치사항들은 따로 제정하거나 보완하는 등의 방법으로 최소한의 법적 근거를 마련하여야 할 것으 로 생각된다. 법령의 효율적 집행과 정비는 물론 단속경찰관의 안전장비 및 진 압장비의 보강과 정부차원의 외교적 노력 또한 뒷받침되어야 할 것이다. 따라 서 이 논문에서는 중국어선의 불법어업 현황과 증가원인을 규명하고, 불법어업 의 근절 및 단속환경 개선을 위한 구체적 방안을 검토한다.
In 2011, one of the coast guard offers of Korea Coast Guard(KCG) died while regulating illegal operations of Chinese fishing vessels. Furthermore, these illegal operations have more frequently occurred taking advantage of recent Se-Wol-Ho tragedy.
The Korean Government has discussed this issue with diversity of solutions, for instance, the announcement of 'Countermeasure of strengthening maritime public powers' in 2008 and 'Multi-Solution for eradication of Illegal fishing' in 2011. The KCG established 'Maritime Guard Act' in 2012 to establish the need to pursuit, arrest, use of weapon toward enforcing illegal fishing. But according to the recent statistic reports, the Chinese illegal fishing operation rate has steadily increased or kept its level fixed. It is urgent to establish adequate counter plans in order to prevent these illegal operations since they has occurred not only within Korea's Exclusive Economic Zone but also in Korean territorial waters.
The illegal operation by Chinese fishing vessels which could not only damage human life, but also build up tension between two nations, should ungently be eradicated.
In orderto solve this purpose, the improvement of related legislations, reinforcement of KCG's safety equipment and enforcement gears, and diplomatic support in government-level should be guaranteed.
This paper analyzes the current status of Chinese vessels' illegal fisheries as well as its increasing factors. It is also suggested that concrete plans need to be established in order to eliminate the illegal operation and specific plans need to be established for improving the enforcement environment of KCG.
