본고는 영토 분쟁이 심화되면서 동북아의 군비경쟁이 가속화 되고 있는 상황에서 한일 간에 점점 분쟁의 강도가 높아지고 있는 독도 문제를 어떻게 풀어야 할 것인가에 대해 논한 것이다. 우선 본고에서는 먼저 한일 양국의 영유권 문제의 쟁점에 대해 어떠한 문제점이 있는 지 살펴본다. 즉, 역사적 근거, 국제법적 효력 및 2차 대전부터의 정치적 결정의 효력에 관한 해석에 대한 양국의 주장이 상대국에게 어느 정도의 설득력이 있는 지의 관점에서 재조명한다.
This paper discusses how to solve the Dokdo problem which is gradually increasing the intensity of the conflict between Korea and Japan in a situation of accelerating arms race in Northeast Asia region with the territorial disputes deepened.
In this paper, firstly, several aspects of the sovereignty issue over Dokdo will be reexamined, such as historical and legal bases of claims of both countries and interpretations of legal and political measures which had been taken since World War II and post-war issues.
Secondly, from a self-critical perspective, what effect the Dokdo issue set to another dimension of an emotional confrontation under the UN Convention on the Law of the Sea have on the societies of both countries will be reviewed.
Finally, this paper argues, in seeking a solution of the Dokdo problem, there will be necessary, not only a new thinking of the territorial issues, but also cooperative attitude, as shown in the anecdote of Takeda Shingen and Uesugi Kenshin who fought in case of inevitable fighting, but helped when the rivalry in need, in Japan 16th century. And makes a suggestion of diverting 0.1% of the military spendings of both countries to establish such as ‘Fund for Historical Reconciliation and Peace in East Asia’ for peacemaking in the region.
