한국사회는 이미 다문화사회가 되었으며 수백만 명에 이르는 외국인이 살고 있으며 다문화가정은 그 어느 때보다도 증가하고 있고, 28,000여명의 북한이탈주민이 남한에 살고 있다. 우리사회가 복합적이고 다양화됨에 따라 여러 가지 형태의 사회갈등들이 표출되고 있는데 이들은 폭행과 심지어는 살인과 같은 범죄로 나타나기도 하기 때문에 사회적인 큰 관심이 되고 있다. 이러한 지대한 관심과 강한 조치가 필요한데에도 불구하고, 지역사회내 일상적인 갈등들은 등한시 다뤄지고 있다. 지역사회에 살고 있는 이웃사이에 일어나는 층간소음, 주차 공간, 동물, 쓰레기문제, 악취 등과 관련된 갈등들은 그들 사이에 스트레스를 유발시키고 불신과 심리적ㆍ정신적인 역기능을 일으켜 주민의 삶의 질에 악영향을 끼치고 있다. 그러나 대부분의 사회적 갈등에 관련된 기존 연구들은 사회정책과 제도, 체제적인 관점에서 이루어졌고, 지역주민들에게 직접적으로 영향을 미치는 지역사회내 갈등에 대한 구체적인 연구는 찾아보기 힘들다. 본 논문에서는 연구의 주목적인 범죄예방책으로서 지역사회내 갈등을 위하여 중재(mediation)를 활용하는 방안을 살펴보았다. 이 목적을 위하여 실제적으로 대체갈등해결(ADR)로서 중재가 활용된 현장 케이스를 제시하였고, 이를 분석한 결과, 중재는 지역사회내 갈등해결을 위하여 활용가능성과 효과적인 것으로 나타났다. 결과적으로 본 연구는 지역사회갈등해결센터의 설립이 필요하며 그 가능성을 시사해주고 있다. 둘째로, 갈등해결과 중재 등 관련분야에 관심 있는 사람들에게 적절한 교육과 훈련을 제공하여 자격증을 수여하고 이들이 전문 갈등중재사가 될 수 있도록 체계적인 커리큘럼을 개발하고 철저한 인턴절차를 마련하는 것이 매우 중요하다. 셋째로, 지역사회갈등해결은 기존의 법체계를 거치지 않고, 갈등을 해소하고자 하는 메카니즘이다. 그러므로 지역사회갈등해결센터는 대학 그리고 경찰과 사법기관들을 포함하는 정부기관들, 또한 지역사회 민간기관들과의 네트워킹을 통하여 협력활동을 펼치는 것이 매우 적절하다.

Korean society has already become a multicultural society while millions of foreigners live in South Korea and multicultural families are ever increasing, and that nearly twenty eight thousand North Korean defectors live in South Korea. As the complexity and diversity of the society in Korea continue to increase, various types of social conflicts are expressed and recognized and they have drawn social attention because they often result in crimes such as serious violence, even murders. Despite the necessity for increased attention and strong measures, daily conflicts within a community have been ignored. Consequences of conflicts among neighbors such as floor noise, parking space, animal, trash, offensive odor etc. produce negative factors degrading the quality of life by causing stress, distrust, psychological and mental dysfunctions. Most existing studies, however, on social conflicts have been conducted in the context of social policy or systems, it is difficult to find a study that more specifically deal with conflicts in the community that have direct impacts on the citizens. This paper, as a main purpose of this study, deals with applying mediation, an alternative dispute resolution, for resolving conflicts in a community as a crime prevention measure. An example of mediation case in practice was presented and analyzed. Mediation seems to show its applicability and effectiveness for those community conflicts. Finally, it suggests that a center for community conflict resolution center be set up and discuses possibilities. Secondly, it is necessary to give an appropriate education and training for those who are interested in conflict resolution and mediation, and others to provide them with a licence and eventually to be a professional mediator. It is highly important to create and develop such a systematic curriculum and well-organized intern procedure. Thirdly, community conflict resolution is a mechanism to prevent conflicts from leading to a resolution through the legal system. Therefore, it is very appropriate for a community conflict resolution center to work collaboratively by networking of an University, governmental offices including police and legal offices, and neighboring institutions at the level of NGOs.
