본 연구는 국내체류 외국인의 증가와 함께 급속도로 증가하고 있는 외국인 범죄에 대한 대응방안을 모색하기 위해서, 외국인 범죄를 설명하는 사회학 이론을 알아보고, 국내체류 외국인 범죄 실태를 분석하여 연구하였다. 외국인 범죄 에 대한 이론은 사회해체이론, 차별기회이론, 사회유대이론으로 설명되는데 사회해체이론은 한 지역사회에 외국인의 비율이 증가할 경우 기존 지역사회 구성원과의 이질성으로 인해 범죄가 증가한다고 설명하며, 차별기회이론은 외국인 이주로 사회의 빈곤층으로 전락하게 되면서 범죄에 더 쉽게 노출된다고 주장 한다. 실제로 우리나라도 외국인의 증가에 비례하여 외국인 범죄도 급증하고 있었으며, 국내체류 외국인들이 빈민층을 형성하며 외국인 범죄형태도 더욱 조직화, 국제화, 광역화 형태로 변화하고 있었다. 그러나 이전까지 외국인 범죄를 설명하는 사회해체이론과 차별기회이론에 따른 시각은 외국인범죄를 유발하게 되는 유발요인에 초점을 둔 것으로 외국인 범죄의 대응방안을 모색하기에 한계가 있다. 국제사회는 더욱 개방화, 세계화되면서 외국인 증가율도 가파르게 상승하고 있는 현실 속에서 외국인의 국내유입을 막을 수 없고, 그들이 우리나라 경제에 미치는 긍정적 요소가 적지 않다면, 이들의 범죄에 대한 대응방안을 통합적으로 모색할 필요가 있을 것이다. 이에 본 연구에서는 인간이 본성적으로 가지고 있는 범죄 가능성을 통제하는 보호요인으로서 사회연대의 개념을 설명한 사 회유대이론을 살펴보고 이에 근거한 대응방안을 교정처우를 위한 대응방안과 사회복지 정책적 대응방안으로 나누어 제시하였다. 교정처우를 위한 대응방안을 통해서는 외국인 범죄재발을 방지하고 한국 사회의 안정을 도모할 수 있으며, 사회복지적 대응방안으로는 외국인들이 지역사회에 적응하고 한국인들이 다문화 사회를 받아들임으로써 사회통합을 이룰 수 있기에 교정과 사회복지는 상호 보완적인 매우 친밀한 관계라고 하겠다. 이에 본 연구에서는 외국인 범죄자 교정처우에 대한 개선방안으로 외국인 전담 교정직원의 배치, 외국인 경찰관 교정직원 배치, 외국인에 대한 한국의 언어와 문화 교육방안 제고, 지역사회 경찰의 사회통합 활동의 활성화가 이루어져야 하며, 사회복지적 대응방안 측면에서는 외국인 자활전문기관 구축, 다문화 사회를 수용하는 지역사회 인식제고, 외국인 공동체 지원이 이루어져야 할 것임을 제시하고 있다.
This Study is about the foreigner crime. Today, in our society, the population of the foreigner increases steadily. Here are two sides. One is positive. Now Korea economic needs for them. Korea suffers the shortage of labour in the "3D Jobs" work that is dirty, dangerous or difficult. Instead of Korean labour, there substitutes the immigrate cheap labor. But the other side is negative. the foreigner creme is happened seriously. So the purpose of this study is analysis of the foreigner crime.
First of all, we explore a few the traditional theories about the foreigner crime, and analysis about the actual condition of the foreigner crime in Korea. Last we try to find the several countervailing ideas.
In Korea, the number of the foreigner increases along with the foreigner crime increase. The characteristic of the foreigner crime is systematize, internationalize, and wider. The organized violence or gangsterism are formed in and around a concentration areas of the foreigner. And the nature of the crime is turning violent. The type of them is an illegal alien, an illegal alien immigrant, prolonging one’s stay abroad, acquirement of nationality, undocumented workers. The general living crime is the general crime and illegal foreigners. The crime- orientation happens systemize.
So we try to find the way to solve these problems in terms of the correctional treatment and the social work. First, we suggest arrangement of the officers who can speak foreign language to be exclusively responsible for them, who come from foreign country in the Correct institution, the education program in Korean language and culture and the activities of police offices in community for Social integration in the aspect of the correct treatment. Seconde, Korea society needs a project to help the foreigner support themselves, preparing the acceptance for multi culture in community, the support for the foreign community in the aspect social service.
