징벌제도의 적정성에 대한 새로운 대안을 도출하기 위해서는 교정행정이 국 민의 지지를 받고 본연의 역할을 충분히 발휘하여 국민속의 교정으로 자리매김 하여야 할 것이다. 효율적으로 징벌집행을 하기 위해서는 교도소의 수용질서유 지 상태 및 수용자의 규율위반에 대한 수용자 징벌기준, 규율위반 행위와 징벌 간의 형평성, 수용자 징벌 집행실태의 적정성, 징벌제도의 수용질서 유지에 대 한 기여정도, 수용자들의 징벌에 대한 위하력 등을 조사 분석할 필요가 있다. 징 벌집행의 문제점을 해결하기 위해서 조사․징벌수용자의 교육프로그램을 다양 화하고 징벌사동 프로그램에서 징벌자의 후회와 반성 그리고 이에 상응하는 잔 벌 조치, 교육강화 등을 통하여 효율적인 징벌사동프로그램의 활성화로 징벌집형중인 수용자 스스로 자신의 행위를 돌이켜 보고 반성할 수 있는 기회를 제공 함으로써 수용생활을 보다 보람 있게 보낼 수 있는 기회를 교정당국은 제공해 주어야 할 것이다.

To derive new alternatives to the appropriateness of the punitive system, correctional administration need be supported by people, fulfill its proper roles to a full extent, and settle down as the correction for people. For an efficient enforcement of punitive measures, it is necessary to investigate and analyze the state of imprisonment, disciplinary baselines for violations of inmates, fair equity between violation of rules and punishment, appropriateness of the actual conditions of punitive enforcement on inmates, the degree of contribution of punitive systems to maintenance of order in prison and the influential power of punitive enforcement on inmates. To solve problems in relation to punitive enforcement, correctional authorities should provide opportunities for inmates to reflect on their deeds so that they can spend the time in prison in positive and productive ways by diversifying training programs for the inmates and promoting efficient punitive ward programs based on inmates’ regret and remorse and equivalent commutation of punishment as well as by strengthening education.
