본 논문에서는 지난 10여년에 걸쳐 미국에서 수행된 소년미결구금제도의 개혁에 관해 고찰하고 있다. 미국에서 소년미결구금제도의 개혁에 관한 논의를 추동시킨 현실적인 문제점은 소년미결구금시설의 과밀화였다. 과밀수용이라는 현실적인 문제점에서 출발하기는 하였지만, 개혁안의 기초를 이루는 것은 소년에 대한 미결구금은 예방적 목적뿐 아니라 소년의 사회복귀를 지원하는 서비스를 제공해야 한다는 치료적 미결구금이라는 개념과 함께 미결구금이 단지 폐쇄적인 미결구금시설이라는 장소를 지칭하는 제한적인 개념에서 벗어나 소년의 보호감독의 필요에 따라 다양한 점진적인 제재와 보호감독을 제공하는 과정으로서의 미결구금이라는 개념이다. 이에 따른 실제적인 개혁방안들은 폐쇄적인 시설구금에 대한 다양한 대안프로그램들의 마련과 미결구금의 남용을 억제하기 위한 객관적이고 효율적인 입소정책의 마련에 초점이 맞추어졌다. 이러한 개혁방안들을 수행한 지역에서는 재판불출석률과 재범률이 증가하지 않으면서도 폐쇄적인 시설 구금률이 감소하면서 비용도 감소시키는 결과를 낳은 것으로 평가된다. 이러한 미국의 소년미결구금제도의 개혁과 그를 수행하는 과정에서 얻게 된 경험과 교훈은 높은 구속률과 미결구금의 남용이라는 우리가 처한 현실적인 문제를 해결하기 위한 방안을 모색하는데 있어 시사하는 바가 크다.

This study emphasis on exploring the Juvenile Detention Alternative Initiatives in USA. The initiative was developed as an alternative to crowding in juvenile detention center and had four objectives; 1) to eliminative the inappropriate or unnecessary use of secure detention, 2) to minimize failures to appear and the incidence of delinquent behavior, 3) to redirects public fiances from building new facility capacity to responsible alternative strategies and 4) to improve conditions in secure detention facilities. According to evaluation study on the initiative, the sites which performed these reforms reduced reliance on secure detention without increasing rearrest or failure-to -appear rates. To capture USA's innovations and the lessons they learned help to establish the reform measure to high detention rate and misuse of detention in juvenile detention in Korea.
