본 연구는 전두환이 제5공화국을 출범시키는 과정에서 박정희 정권의 권 력구조, 대통령 선거제도, 그리고 국회의원 선거제도를 어떻게 답습했는지를 사례 분석으로 검토하였다. 첫째, 전두환 정권은 권력구조에서 박정희 정권 이 도입한 유신헌법의 강력한 대통령제를 답습하였으나 긴급조치권, 비상계 엄과 경비계엄, 국회해산권 등에서 국회의 권한을 유신헌법보다 강화하였다. 둘째, 전두환 정권은 박정희 정권의 대통령 선거방식인 간선제를 모방하였으 나 국민이 직접 선출한 대통령선거인단 방식을 채택하였으며, 장기 집권에 대한 국민 저항을 의식하여 중임제 효과가 있는 7년 단임제를 채택하였다. 셋째, 전두환 정권은 박정희 정권에서 집권당에 유리하게 작용한 국회의원 선거제도를 선택적으로 활용하였다. 전두환 정권은 집권당의 안정화를 위해 지역구에서는 제4공화국의 중선거구제를, 비례대표에서는 제3공화국의 전국 구를 채택하였다. 결국 전두환 정권은 유사한 정권 출범 과정을 거친 박정희 정권의 정치제도를 수정하여 답습하였다. 전두환 정권의 단임 대통령제와 비 례대표제는 제6공화국에서도 수정을 통해 계승되었다.

The purpose of this study was to examine how Chun Doo-hwan learned the power structure, presidential election system, and National Assembly election system of the Park Chung-hee regime in the process of launching the 5th Republic. First, the Chun Doo-hwan regime followed the presidential system of the Yu-shin Constitution introduced by the Park Chung-hee regime in the political power structure, but strengthened the power of the National Assembly in the emergency measures, martial law, and dissolution of the National Assembly. Second, the Chun Doo-hwan regime imitated the indirect election method in the presidential election system, but elected the president through an electoral college elected by the people. In addition, the Chun Doo-hwan regime adopted a seven-year single term system with the effect of a double term system. Third, the Chun Doo-hwan regime selectively utilized the National Assembly election system which was favorable to the ruling party during the Park Chung-hee regime, and the Chun Doo Hwan regime adopted the Fourth Republic's midterm election system in the district and the National District of the Third Republic in the proportional representation to stabilize the ruling party.
