The Responsibility of the State and Local Governments for the Parceling-Out of Large-Scale Condominium Buildings : Focusing on the Introduction of a Condominium “Management Plan”
집합건물은 현대 도시의 보편적 건축 형태로 자리 잡았으나, 다수의 구분소유 자가 하나의 건물을 공동으로 관리해야 한다는 구조적 특성으로 인해 의사결 정의 어려움과 이해관계의 충돌을 필연적으로 내포한다. 이러한 구조적 위험 성은 관리 부실에 따른 건물의 조기 노후화, 끊임없는 분쟁, 관리 권한의 사유 화 등 심각한 사회적 비용으로 이어진다. 그 근본 원인은 분양 단계에서 관리 에 관한 기본질서가 형성되지 못한 채 구분소유관계가 성립한다는 데 있다. 현행 법제는 기본질서의 형성을 구분소유관계 성립 이후 관리단집회의 결의에 맡겨두고, 분쟁이 발생하면 소송이나 분쟁조정을 통해 해결하는 사후적 대응 에 의존하고 있다. 그러나 사후적 대응은 분쟁의 발생 자체를 예방하지 못하며, 기본질서라는 토대가 부재한 상태에서의 지원·감독은 갈등을 재생산하는 구 조 자체를 변경하지 못한다. 미국의 선언증서, 독일의 분할선언과 공동체규약, 프랑스의 공동소유규약은 모두 구분소유관계 성립 이전 단계에서 분양자가 작 성한 문서에 의하여 기본질서를 형성하도록 하고 있다는 공통점을 보여준다. 이러한 비교법적 검토를 바탕으로, 본 논문은 사전적 대응방안으로서 집합건 물 「관리계획서」 제도의 도입을 제안한다. 분양자는 건축허가 단계에서 전유 부분과 공용부분의 구분, 공용부분의 지분비율, 전용사용권, 업종제한, 관리단 기관의 구성 등 관리에 관한 기본질서를 「관리계획서」로 사전에 확정하고, 이 를 수분양자에게 제공하여 동의를 얻어야 한다. 「관리계획서」는 규약보다 상 위에 위치하는 기본규범으로서, 구분소유관계 성립과 동시에 모든 구분소유자 와 그 승계인을 구속한다. 아울러 분양자에 의한 원시규약의 사전 제정을 법제 화하되, 표준관리규약의 활용과 내용통제를 통하여 분양자의 권한남용을 방지 하는 장치를 함께 마련하여야 한다. 나아가 국가와 지방자치단체는 건축허가를 통하여 구조적 위험을 내재한 집합 건물의 사회적 유통을 승인하는 주체로서, 그 위험에 대비할 책임을 부담한다. 따라서 사전적 단계에서는 집합건물법·건축법·건축물관리법의 개정을 통한 법적 근거 마련, 심사기구의 설치·운영, 다양한 유형의 표준관리규약 보급이 이루어져야 하고, 사후적 단계에서는 관리 현황의 점검·감독, 입주민에 대한 교육과 정보제공, 분쟁 예방을 위한 자문서비스 제공이 지속적으로 이루어져 야 한다. 이러한 사후적 대응에서 사전적 질서 형성으로의 패러다임 전환이야 말로 집합건물을 안전하고 쾌적한 삶의 터전으로 만들기 위한 출발점이 될 것 이다.
Condominium buildings have become a universal architectural form in modern cities, yet their structural feature—that a large number of sectional owners must jointly manage a single building—inevitably entails difficulties in decision-making and conflicts of interest. This structural risk leads to serious social costs, including the premature deterioration of buildings due to poor management, incessant disputes, and the privatization of management authority. Its root cause lies in the fact that sectional ownership is established at the parceling-out stage without any fundamental order of management having first been formed. The current legal framework leaves the formation of this fundamental order to a resolution of the managing body's meeting adopted only after sectional ownership has been established, and relies on ex post responsibility to guard against those risks. Accordingly, at the ex ante stage they should establish a legal basis by amending the Act on Ownership and Management of Condominium Buildings, the Building Act, and the Building Management Act, set up and operate review bodies, and disseminate standard regulations tailored to diverse building types; at the ex post stage they should continuously inspect and supervise the state of management, provide education and information to occupants, and offer advisory services for the prevention of disputes. This paradigm shift—from ex post response to ex ante formation of order—is the very starting point for transforming condominium buildings from breeding grounds of dispute into safe and pleasant places to live.
