Legal Issues of Smart Construction Technologies
오늘날 제4차 산업혁명과 디지털전환 경제가 본격화되고 있어서 건설에서도 기존의 인력을 사용한 공법에서 디지털과학기술, 인공지능기술을 탑재한 스마 트 건설 기술(BIM, OSC, 로봇, 드론 등)이 현장에 본격 도입됨에 따라, 전통적 인 건설법 체계와 충돌하는 지점이 많아지고 있다. 건설 현장의 디지털 전환이 가속화되면서 BIM(Building Information Modeling, 건설 정보 모델링) 의무화 및 건설 로봇 도입으로 스마트 건설 기술 도입 시 발생하는 책임 소재, 지식재산권 보호, 안전관리 책임 등을 건설법제에 반영하 여야 한다. 예를 들면, BIM 관련 데이터 소유권이 설계자, 발주자, 혹은 데이터 를 가공한 시공사 중 누구에게 속하는지 법적 귀속 문제나, BIM 오류로 인해 시공 하자가 발생했을 때, 소프트웨어 개발사-설계사-시공사 간의 책임 배분 문제, OSC(Off-Site Construction, 탈현장 건설) 공법으로 만들어진 모듈러 주택을 제품인지 건축물인지에 따른 관련 법규 적용문제나 모듈 제작 위탁이 제 조 위탁인지 건설 위탁인지에 따른 하도급법 적용 문제, 그리고 건설 로봇 및 자율주행 장비의 안전 책임과 중대재해처벌법 또는 건설안전기본법 등의 문제 도 생각해보아야 한다. 무엇보다 분쟁해결 및 구제방법에서 디지털 로봇 사고 에 특화된 건설공사보험이나 대안적 분쟁해결방법(ADR)의 고도화를 국내외 사례와 대비하여 찾아보아야 할 것이다. 디지털 기술로 인한 변화는 기회 또는 위협이기에 다층적, 혁신적인 접근이 필 요하며, 인간을 위하여 과학기술을 어떻게 활용할 것인지 하는 문제에서 선 (善)과 형평(衡平)의 기술을 담당하는 법학계의 지혜가 필요할 것이다.
With the Fourth Industrial Revolution and the digital transformation economy gaining momentum today, the construction industry is shifting from traditional labor-intensive methods to the full-scale introduction of smart construction technologies (BIM, OSC, robots, drones, etc.) equipped with digital science and technology and artificial intelligence. Consequently, there are increasing points of conflict with the traditional construction legal framework. As the digital transformation of construction sites accelerates, the mandatory implementation of BIM (Building Information Modeling) and the introduction of construction robots necessitate that the construction legislation reflect issues regarding liability, protection of intellectual property rights, and safety management responsibilities arising from the adoption of smart construction technologies. For example, one must consider legal issues regarding the ownership of Building Information Modeling (BIM) data—specifically, to the designer, the client, or the construction company that processed the data; the distribution of liability among software developers, designers, and construction companies when construction defects arise due to BIM errors; the application of relevant laws depending on whether modular housing constructed using Off-Site Construction (OSC) is classified as a product or a building; the application of subcontracting laws depending on whether module production is outsourced for manufacturing or construction; and safety liability for construction robots and autonomous equipment, as well as issues related to the Serious Accidents Punishment Act or the Framework Act on Construction Safety. Above all, regarding dispute resolution and remedies, one must explore the advancement of construction insurance or Alternative Dispute Resolution (ADR) methods specialized for digital robot accidents by comparing them with domestic and international cases. Since changes brought about by digital technology present either opportunities or threats, a multi-layered and innovative approach is required, and the wisdom of the legal academic community, which is responsible for the technology of good and equity, will be needed regarding the question of how to utilize science and technology for the benefit of humanity.
