건설과 같은 전문 소송에서는 감정인의 참여가 필수적이다. 감정인은 무엇보다 실체적 진 실 발견을 위한 전문성과 기술력을 갖추어야 한다. 하지만 건설감정에 대해 증명력이 부족 하고 감정결과의 부실을 우려하는 목소리도 높다. 이러한 우려에도 불구하고 그 동안 감정 방법의 구조적 특성으로 인해 발생하는 각종 문제점에 대한 고민이 부족했다.
이 연구에서는 감정의 문제점에 대한 진단의 초점을 감정절차나 기준이 아닌 감정 방법에 맞추어 보고자 한다. 이를 통해 그동안 놓치고 있었던 감정의 과정과 방법에 대해 구체적 으로 분석하고 문제점의 실체를 파악한 후 효과적인 개선방안을 모색하고자 하였다.
이제 건설감정의 현장조사 기법은 정보화를 통해 디지털 정보로 구현되어야 할 것이다. 감 정업무 또한 표준화를 통한 더욱 효율적이고 전문적인 감정 수행 방식으로 정착되어야 한 다. 이를 위해 표준 감정내역서식과 업무 방식이 보급되고 개발되어야 할 것이다. 감정 방 법의 정보화는 전자소송 시대의 필연적인 흐름이라고 할 수 있다.
