우리나라의 경우 현재까지는 약물범죄자들의 성공적인 사회복귀에 있어서 사회내처우가 그다지 효과적으로 기능하지 못하고 있는 것으로 보인다. 마약류사범의 예를 들어본다면, 2005년에는 67.1%의 동종재범률을, 2006년에는 45.0%의 동종재범률을 보여 동종재범률이 가장 높은 범죄로 나타나고 있다. 이와 같은 수치는 약물중독의 치료 및 재활상의 어려움을 반영하는 것인 동시에 현재의 처우시스템이 약물중독 문제에 효과적으로 대응하지 못하고 있는 현실을 반영하는 것이기도 하다. 무엇보다 성공적인 사회복귀와 이를 통한 재범의 방지를 위하여 사회내처우의 문제점을 인식하고 개선점을 도출하기 위하여 선진 각국의 우수사례를 검토하고 이의 시사점을 고찰할 의의가 있다고 하겠다. 이에 본 연구는 우리나라의 약물범죄의 실태 및 처우의 현황 및 개선이 요구되는 사항들을 점검한 후, 선진 각국의 사회내처우의 우수 사례를 살펴보고, 그 시사점의 고찰 및 한국적 도입에의 적실성을 검토하여 정책적 개성방안을 제안하였다.

Korea has been faced with serious problems of drug abuse. Drug abuse appears to become more wide spread regardless of class and region and newly emerging types of drug have rapidly been distributed. Those who arrested for abusing drugs are gradually increasing. The number of drug offenders has been beyond 10,000 persons every year since 1999. Especially a very high percentage of offenders whose crimes are drug related have substance abuse disorders or dependency and need substance abuse treatment. To cope with this problem the Korean government newly is establishing the pretrial diversion system in lieu of prosecution for the drug abusing offender. Thus, recent interest in the problem of substance abuse has increased the attention given to the probation with drug offender. This study focused on Correctional Treatment for Drug Abuser among Advanced Countries(United States, United Kingdom, Canada) Drug and drug offenders constitute a serious threat to public safety and a serious drain on public resource. Traditional punitive model of drug enforcement and prosecution has failed to have much impact on drug problems and has overwhelmed the criminal justice system with drug cases. There are some kind of compulsory treatment measures such as 'treatment protection', 'treatment and superintendence', 'treatment in the prison' and 'treatment in probation system'. Probation is regarded as the most effective method to correct offenders among such measures. So the current system of probation for drug abusers shall be utilized more widely and much more resources shall be invested in the probation system quickly.
