「국제해상충돌방지규칙」과 이의 국내입법인「해사안전법」은 좁은 수로에서의 항법과 관련하여 넓은 바다에서 적용되는 일반항법과는 다른 지리적 특수성을 이유로 특별항법을 규정하고 있다. 이러한 특별항법은 일반항법의 경우에 인정되는 피항의무, 유지의무와는 다른 통항금지의무를 규정하고 있다. 한편, 좁은 수로에 대한 횡단의 경우에는 소형선박, 어선 등에게 부여된 ‘다른 선박의 통항을 방해하여서는 아니 된다’는 통항방해금지의무와 다르게 ‘다른 선박의 통항을 방해하는 경우에는 횡단하여서는 아니 된다’고 규정하고 있는바, 제정목적과 법문에 충실한 해석에 의하면 이를 통항방해금지의무와 다른 횡단 금지의무로 보아야 하는 것이 상당할 것이다. 따라서 그와 같이 해석하여야 하는 이유 내지 근거, 달리 본다면 어떤 의무와 책임을 부담시켜야 하는지를 살펴보고, 이에 상응하여 상대선박은 어떤 의무와 책임을 부담하는지에 대하여 검토하고, 마지막으로 합리적인 좁은 수로 항법에 대한 조문이 되기 위하여 향후 추가 연구를 통해 보완하여야 할 부분이 있음을 제시하였다.

「Convention on the International Regulations for Preventing Collisions at Se a」 and its domestic legislation「the Maritime Safety Act」 stipulate special navigation rules within a narrow channel for geographical specificity other than the general navigation rules on the open sea. Therefore, special navigation rules stipulate the obligation not to impede the passage of other vessels, while general navigation rules stipulate the obligation to avoid those vessels and keep her course. Meanwhile, it is required not to cross the channel in case of impeding the passage of other vessels within a narrow channel unlike the obligation for a small vessel or fishing boat not to impede the passage of other vessels. Therefore, it is resonable to interpret those obligation as not to cross a narrow channel other than not to impede the passage of other vessel according to legislation’s object and legal text. Accordingly, it is reviewed reasons or grounds for this interpretation and what obligation and responsibility is imposed to the vessel within narrow channels. Lastly, it is suggested that the supplemental research be done from further review for reasonable navigation rules within narrow channels.
