드론(무인항공기: UAV, Unmanned Aerial Vehicle)이 테러목적에 활용되는 사례가 점점 현실화되면서 드론을 이용한 테러에 대한 우려가 증가하고 있다. 2019년 9월 14일 사우디 석유시설에 대한 드론 공격은 큰 피해를 입으면서 드론이 국가 핵심시설을 타격할 수 있는 테러수단으로 악용될 가능성을 잘 보여주었다. 드론은 테러 목적 이외에도 사이버 해킹이나 다른 여러 범죄행위에도 이용될 수 있다. 소형 드론은 전문지식 없이도 공중 이동과 원격 조종을 바탕으로 안전·보안 위협, 사생활 침해 등의 범죄 행위에 쉽게 사용 가능하기 때문에 그 위협성이 더욱 우려 된다. 이와 관련 하여 테러 등 각종 범죄사용 우려와 함께 각국에서는 드론에 의한 신규 범죄예방책을 마련 중이다. 현재 한국에서도 여러 법률과 전파차단장비의 운용, 조종자 처벌 및 제지, 비행금지 또는 제한구역 설정, 비행시간제한 등의 조치를 취하고 있으나 미흡하다. 드론 보급의 대중화에 따른 불법 드론 비행사례증가 및 드론을 이용한 각종 테러 위 험성이 상존하여 이에 대한 안전대책 마련이 필요하다. 이와 같은 문제 인식에 근거하여 이 글에서는 드론 테러에 대한 전략적 이해를 제시하고 드론 테러의 현황과 미래의 추이를 평가하며, 이를 바탕으로 정책, 법률적 대응을 위한 방향성과 몇 가지 방안을 제안한다. 미래 폭력은 분산 공격 능력(the distribution of offensive capability), 취약성의 분산 (the distribution of vulnerability), 그리고 분산된 방어(the distribution of defense)를 특징으로 한다. 드론 테러는 이러한 미래 폭력의 특성이 잘 반영된 대표적인 구체적 사례에 해당한다. 드론 테러가 야기하는 공격능력의 분산과 취약성의 분산이 제기하는 딜레마에 대한 효과적인 대응은 따라서 방어의 분산을 통해 모색될 수 있다. 이 글에서 제시하는 몇 가지 전략적, 정책적, 그리고 법률적 모색들은 그러한 노력의 일환이다.

There is a growing concern that drone(UAV, Unmanned Aerial Vehicle) could be used for a terrorist attack. On 14 September 2019, the drone attack on the Saudi oil facility well showed a perfect example that such concern is indeed realistic. Besides, drone could be used for the purpose of various online or offline criminal/malicious activities. Regarding the potential risk of drone, many nations develop some new terror or crime prevention measures. The Republic of Korea also works on legal, technical, regulatory measures but those measures are still incomplete. Accordingly, more effective security measures are needed to reduce the potential terror risk related to the drone use. This article responds to such necessities. It proposes a strategic understanding on drone, assess the current situation and future trend of, and suggests policy implications and legal measures on drone terror. The essential feature of future violence includes the distribution of offensive capability, the distribution of vulnerability, and the distribution of defense. Drone terror is a specific case which well implies those features of future violence. Some strategic, policy, and legal proposals of this article is an effort of the distributed defense against future violence.
