2019년 기준 보석허가율이 구속인원 대비 3.9%에 불과하다. 이처럼 보석허가율이 낮은 이유는 보석 후 도주 가능성 때문이다. 도주를 방지함으로써 보석허가율을 높이는 방법이 전자보석이다. 전자보석 시행은 보석 허가를 많이 할 수 있게 하는 원동력 으로 작용함으로써 과밀수용해소, 피고인의 방어권 보장, 건강권 보장 등에 기여할 수 있다. 이에 따라 전자보석 실시에 따른 다양한 문제점으로 전자보석 활성화에 제동이 걸리지 않도록 대응방안을 모색하여 제시하는 것이 연구의 목적이다. 전자보석 실시에 따른 행정적 측면, 기술적 측면, 인권적 측면, 회복적 측면, 법적 측면 등에서 다양한 문제점이 발생할 수 있는데 이를 다양한 각도에서 문제점을 도출한 후 대응방안을 제시하고자 하는 것이 연구의 주된 내용이다. 연구결과 전자보석 실시에 따른 다양한 문제점을 도출하였고, 이러한 문제점에 대 한 대응방안을 논문, 보고서, 언론 기사, 본인의 아이디어 등을 바탕으로 제시함으로 써 전자보석을 활성화하는데 기여할 수 있다고 본다.
As of 2019, the bail permit rate is only 3.9% compared to the number of people arrested. This is due to the possibility of escape after bail. Electronic bail is a way to increase the bail permit rate by preventing escape. Electronic bail can be used as a driving force to grant a large number of bail permits, thus contributing to relieving overcrowding, guaranteeing defendants' right to defend, and guaranteeing health rights. However, the purpose of the study is to find countermeasures to prevent the activation of electronic jewelry due to various problems caused by the implementation of electronic jewelry. The contents of the study can cause various problems in administrative, technical, human rights, restoration, and legal aspects following the implementation of electronic jewelry. Problems are derived from various angles and then countermeasures are presented. As a result of the study, the court has derived various problems resulting from the implementation of electronic bail, and it is believed that it can contribute to the activation of electronic bail by presenting countermeasures based on papers, reports, media articles, and opinions.
