이 연구는 5.18 광주민주화운동의 역사적인 의미를 헌법적인 차원에서 분석하고 이를 계승하는 방법을 도출하고자 하는 시도이다. 2022년 대통 령선거 이후 한국에서는 5.18정신을 헌법전문에 포함하자는 여론이 형성 되었다. 이에 연구는 첫째, 5.18정신을 헌법전문에 포함할 가치가 있는지 를 살펴볼 것이다. 둘째, 5.18정신의 헌법전문 수록이 가능하다면, 국가 유공자 예우에 관한 논의를 분석하고자 한다. 연구는 세부적으로 5.18이 한국의 민주화 운동으로서의 의미가 아닌 세계적인 민주주의 운동에서 중요한 사건이자 민주주의 이행과정의 시민항쟁으로 평가했다. 그리고 이를 계승하기 위한 노력의 일환으로 국가유공자 예우에 대한 학술적 논 의를 진행하였다. 분석을 통해 연구는 5.18정신의 의미를 4가지로 제시 한바, 첫째, 민주주의 국민저항권, 둘째, 역사적 평가, 셋째, 법·제도 정 비, 넷째, 세계사적 평가 등을 위한 노력 차원에서 분석했다. 그리고 연 구에서는 5.18정신의 헌법전문 수록은 필요하고, 이를 민주주의 국가의 주요한 동력이 되려는 방법으로 5.18 국가유공자 예우에 관한 법·제도를 정비할 필요가 있음을 제시하였다.

This study is an attempt to analyze the historical meaning of the 5.18 Gwangju Democratization Movement in terms of constitutional evaluation and to derive a method of succeeding it. After the presidential election in 2022, public opinion was formed in Korea to include the spirit of 5.18 in the preamble to the constitution. The study will first look at whether it is worth including the spirit of May 18th in the preamble to the Constitution. Second, if it is possible to include the preamble of the constitution in the spirit of 5.18, we will analyze the discussion on the treatment of national merit. In the study, in detail, the 5.18 was evaluated as an important event in the global democracy movement and a civil resistance in the process of implementing democracy, not as a meaning as a democratization movement in Korea. And as part of an effort to inherit it, academic discussions were conducted on the honorific treatment of men of national merit.
