2024년 한국은 경제협력개발기구(OECD) 기준 다인종·다문화 국가로서 사실 상 ‘이행기 문화’의 시기이자 ‘다문화 국가로의 체제전환’ 과정에 진입하였다. 이 글은 이러한 시대적 흐름과 변화, 요구를 반영한 국내외적 배경에 따라 이 민정책을 추진하는 주체 즉, ‘정책결정자(policy maker)’이자, ‘정책명령자 (policy commander)’이면서, ‘정책조정자(policy broker)’인 행정부에 초점을 맞추어 논의를 전개한다. 특히, 현 윤석열 정부가 추진하는 ‘한국형 이민정책’ 가운데 ‘출입국‧이민관리청 신설 방안’을 정책 사례로 선택하고, 선행 연구된 논문들과 관련 문헌, 연구보고서, 주무 부처의 국회 제출자료 등을 근거로 내용 을 비교 및 검토한다. 그 결과, 먼저, 국익 중심의 선별적 수용과 강력한 동화 주의를 지향하는 정책 기조에 대해 국익 개념이 갖는 모호성의 문제를 지적하 고 헌법적 가치와의 양립 필요성 등 인식론 차원의 재논의를 주장한다. 또한, 한국형 이민정책 추진을 위한 정부 차원의 미흡한 사전 조사, 정책 추진 근거 의 불균형에 따른 보완이 요구되며, 이에 한국인의 ‘신안보’ 인식조사 결과를 토대로 포괄적 안보의 관점에서 인간안보 및 사회‧경제적 위협요인을 최소화하 고 기존 제도의 붕괴에 따른 공백을 대체할 수 있는 정부의 역할과 기능을 강 조한다. 특히, 이때 정부에 강력하게 요구되는 것으로서, 선거에 따른 정부 권 력의 이동과 관계없이 한국형 이민정책 추진의 ‘일관성’과 ‘연속성’을 확보해야 만 하며, 이를 위해 필요한 ‘세 가지 순환 구조의 리더십’을 다음과 같이 제언 한다. 정부는 첫째, 이민정책 내용의 전문성을 높이고 정책개발 역량을 키우기 위한 ‘정책 리더십(policy leadership)’을, 둘째, 정부조직법 등 관련 법령의 통 과와 예산 확보 논의를 가능케 하는, 정책의 입법 성공을 위한 ‘입법 리더십 (legislative leadership)’을, 셋째, 이민정책을 단계별 진행순서(sequencing)에 따라 적절히 관리하고 책임성과 신뢰성을 높이기 위한 이민정책실명제를 시행하 는 등 ‘행정 리더십(administrative leadership)’을 갖추어야 한다.

The development of autonomous ships relies heavily on the Internet technologies, which have introduced a new type of risk to the shipping industry. Increasing dependence on the Internet computing and satellite communications makes cybersecurity a significant consideration for the current operation and future development of autonomy technology in the shipping industry. Cyber risks will be a more critical issue for maritime autonomous surface ships (MASS). This research identifies current international regulatory issues concerning cybersecurity in MASS, and exam ines potential regulatory improvements for the effective prevention and control of potential cyber risks. In terms of improvements, the authors suggest the adoption of a mandatory goal-based MASS code that constitutes an independent cyber risk management, separate from existing safety management systems based on the International Safety Management code. In addition, the SUA Convention for the suppression of unlawful acts against shipping must be revised to actively respond to cyber-crime as an emerging threat in the era of MASS.

남한, 북한, 미국 등 세 행위자 간에는 복잡한 상호작용이 지속되며 전략적 삼각관계가 형성되어 왔다. 세 국가 간 관계에 적용돼 온 디트머의 전략적 삼 각관계 분석틀에 따르면 냉전기엔 ‘안정적 결혼’, 탈냉전기엔 ‘안정적 결혼’과 ‘로맨틱 삼각관계’ 사이의 과도기가 이어졌다. 하지만 북한이 대미 협상수단으 로서 핵개발 단계를 넘어 핵보유국 지위를 기정사실화하고, 미중 간 패권경쟁 과 ‘한미일 대 북중러’라는 구도가 본격화된 신냉전기에 들어서면서 남북미 간 전략적 삼각관계는 무너졌다. 하노이 회담 결렬 이래 미국과의 대화에 목매지 않고 대미 장기전체제에 돌입한 북한은 남한과의 대화도 철저히 단절한 채 동 맹국들과의 관계에만 몰두하고 있다. 북한의 핵 무력 완성으로 비핵화라는 목 표가 불가능에 가까워지고 ‘군축’이 최선책이 된 가운데 현재 중국과 러시아를 상대하느라 여력이 없는 바이든 정부에도 북한문제는 후순위로 전락해 소극적 인 대북정책을 펼치고 있다. 하지만 남북미 간 상호작용이 아예 끊겨버린 지금 이 오히려 북한의 배신행위 아래 불안정하게 유지되어 오고 있던 현재까지의 남북미 관계가 새롭게 거듭나는 중요한 기회일 수 있다. 기회가 오기까지 남북 관계에서의 긴장 국면이 확전되지 않도록 잘 관리하는 것이 현재 한국 정부의 과제일 것이다.

The US has entered a new era of crisis. President Biden has just been inaugurated. He faces historical challenges to return the US to global leadership. The primacy purpose of this article is to discuss national security and trade policy in the new Biden administration. First, I look at the historic and dubious claims made by the Trump administration in utilizing national security as a cover for protectionist trade actions, as well as at the federal court cases addressing these claims. I then assess the cases that have come before the WTO over the last two years, raising for first time the issue of the national security exception under GATT Article XXI. Finally, I conclude that President Biden’s overwhelming priority is to resurrect American democracy and alliances. But he will also need to address a broad range of trade issues and to restrict reliance on national security as a cover for populist and protectionist policies.

New national security (NNS) represents a twenty-first century’s sociological paradigm on which the law is based on and is characterized by multiple actors, wide covering, low predictability, subjective perception, dual nature, and rampant diffusion. The emergence and expansion of the NNS prompts a highly advanced perspective to the rule of law at both the national and international levels, specifically, the relationship between international and domestic law. In this context, traditional approaches, ‘international approach’ or ‘national approach,’ are insufficient, so that a new ‘managerial approach’ is thus needed. The legal practice in relation to national security of China, a rising great power, attracts close attention in the international society. Furthermore, since Chinese conception of national security has its own ‘Chinese characteristics,’ how China will enforce its national security law in the context of international law remains to be seen. The NNS will lead profound sociological transformation upon which all legal orders are based.
