마약류문제는 갈수록 심각해지고 있으며 그 폐해는 전 세계가 몸살을 앓고 있다. 사용자 개인에 국한되지 않고 가정과 지역사회 그리고 국가전체에 막대한 영향을 미치는 인류의 심각한 사회문제 중 하나가 되었다. 본 연구에서는 마약류중독자 치료보호제도의 현황분석을 통한 제도 활성화의 저해요인을 파악하고, 그에 따른 개선방안의 마련을 통해 치료보호제도를 활성화시키기 위한 정책방안을 제시하였다. 마약류 사범은 재발 가능성이 높기 때문에 보다 세심한 배려가 필요하며, 더불어 마약중독자에 대한 효율적인 치료․재활 프로그램이 절실하다. 치료보호기관의 저조한 실적문제를 해결하기 위해서는 기관측의 적극적인 프로그램 개발과 검찰 측의 협조가 무엇보다 필요하며 이에 대한 획기적이고 다양한 방법들이 모색되어야 할 것이다. 치료보호제도 활성화를 통하여 지역사회 정신보건기관(정신의료기관, 민간단체 등) 등 관련 인프라와의 접근성 강화로 퇴원자의 지속적 추후 관리에 의한 사회복귀 효과 제고 및 마약류 중독자 치료보호 지정기관에 대한 예산 지원 강화 등 인센티브 부여로 사업에 대한 적극적 동기를 부여하여야 할 것이다. 나아가 치료명령제의 도입 및 조건부 기소유예 및 집행유예제도 검토, 치료보호가이드라인의 제작, 프로그램의 다양화를 모색하여야 할 것이다.

The issue of treating drug abusers has been discussed in great detail in our country for decades. There are those that say we should buckle down on drug users and increase our illegal drug enforcement in order to put all those drug-using criminals behind bars. However, those that just want to lock up every drug addict are ignoring the fact that drug addiction is a sickness, and without proper treatment, the user will find themselves back on the streets using drugs once they are out of jail.
In this study, it is to develop a policy proposition to facilitate the compulsory treatment and rehabilitation system by analyzing barriers of pre-existing compulsory treatment system to drug abusers.
The Barriers of compulsory treatment system are different between drug abusers in the treatment facilities and drug abusers in the communities. The main barriers were insufficient information of drug abuse treatment system, prejudice to compulsory mental health treatment system, and insufficient infrastructures in the community.
To facilitate the compulsory treatment system, we need advertisement to inform the compulsory treatment system, collaboration efforts improvement of legal-social system, construction of community based drug center and evaluation of compulsory treatment system. It is preferable that drug abusers rehabilitation provides voluntary treatment, serves therapeutic ends, and supports the offender as an autonomous adult.
