본 연구는 최근 독일 연방헌법재판소의 교도작업 보수에 대한 위헌결정과 그 시사 점을 알아보는 것을 목적으로 한다. 독일 바이에른주와 노르트라인베스트팔렌주의 수감자 두 명이 독일 연방헌법재판소 에 헌법소원을 제기하였고, 독일 연방헌법재판소는 교도작업에 대한 보수가 법정 최 저임금보다 현저히 낮게 책정된 것이 헌법에 위배된다고 결정하였다. 독일 연방헌법 재판소는 수감자의 재사회화가 헌법적 요구사항임을 강조하며, 입법자는 이러한 헌법 적 요청에 따라 최신 과학적 연구를 바탕으로 포괄적이고 효과적이며 일관성 있는 재 사회화 개념을 개발할 의무가 있다고 판시하였다. 또한, 교도작업에 대한 보수수준은 재사회화 목표를 실질적으로 달성할 수 있도록 산정되어야 함을 명확히 하였다. 적절 한 보수는 수감자에게 책임감을 고취하고, 피해자에 대한 보상은 물론, 수감 이후의 삶을 준비하는 데 이바지할 것이다. 한국에서도 교도작업에 대한 대가로 작업 장려금을 지급하는데, 일반 최저임금에 비하면 현저히 낮은 것이 현실이다. 독일의 사례와 유엔 총회에서 채택된 ｢유엔 피구 금자 처우에 관한 최저기준규칙(넬슨 만델라 규칙)｣을 보면, 교도작업에 대한 보수규 정이 재사회화 요청에 맞춰 반영되어야 함을 확인할 수 있다. 한국의 작업 장려금 제 도 역시 재사회화 원칙에 부합하도록 개선할 필요가 있다. 한국에서도 전문가로 구성 된 위원회를 조직하여 교도작업에 대한 보상 문제를 진지하게 논의해야 할 것이다.

본 연구에서는 교도작업 활성화를 위한 조직체계 개편방안을 미국, 싱가포르, 일본 등 외국의 사례를 중심으로 살펴보았다. 교도작업의 활성화는 수형자의 교정교화와 사회복귀에는 물론 재범방지를 통한 안전한 사회 건설에도 순기능적인 역할을 할 것 이므로 교정행정의 성공을 위한 중요한 촉매제라고 할 수 있다. 그러므로 교도작업이 대내외의 불리한 환경을 극복하고 제 역할을 다할 수 있도록 획기적인 조직개편이 요구된다. 새로운 교도작업 조직구성방안으로는 별도의 특수법인으로 한국교정산업공사를 설 립하는 방안, 기존의 특수법인인 대한민국재향교정동우회나 교정공제회에 교도작업사 업부를 신설하는 방안이 있다. 이러한 방안 중에서 교도작업의 활성화를 위해서는 미국의 연방교도소 산업공사(FPI)나 싱가포르의 교도작업공사(SCORE)를 모델로 하는 한국교정산업공사를 설립하는 방안이 가장 바람직하다고 제시하였다. 다만, 이러한 방 안은 당장 막대한 국가재정이 투입되어야 하고, 「한국교정산업공사법」의 제정 등 국민 의 동의가 필요하므로 교정동우회나 교정공제회에서 일본 교정협회의 형무작업 협력 사업부를 참고한 교도작업사업부를 신설하여 단계적으로 교도작업을 수탁 받아 운영 하는 방안을 제안하였다.

The objectives of this study are to analyze the productivity of prison labor and to derive some implications through comparisons with productivities of small and medium sized enterprise in free market economy in order to improve the quality of prison labor. Fundamentally, the aim of prison labor is the rehabilitation of prisoners, while that of private enterprise is maximizing the profits. Thus, there lie some limitations in comparing the productivity of these two. Goods and services produced by prisoners are in market competing with those by private sectors.However, according to this study, the productivity and the capital investment efficiency of prison labor are very low comparing to the private sectors. Therefore, in order for the prison labor to have a competitive edge, more effort will be required to improve its technology and productivity. Further study will also be needed to devise various programs for improvement of prison labor.

The purposes of this study are to analyze economic effect of prison labor on free market economy and to suggest ways for more effective prison labor industry. The impact of prison labor on non-prison labor has been debated over the years. Proponents have touted the social benefits of decreased net cost of prisons, improved behavior in prison, the potential for low recidivism, and rehabilitation through development of work and social skills. Opponents of prison labor from the beginning have pointed out the private costs of lost jobs and lost sales of industries outside the prison. Although it is very difficult to measure and compare quantitatively benefits and costs of prison labor, there is inverse relationship between prison labor and recidivism rates. According to Federal Bureau of Justice, inmates involved in prison labor has better chance to be employed and to receive higher wage. In addition, the revenue from prison work can pay for the costs of housing them in prison and prison labor leads to increased production of goods and services that can help in developing regional economy. In spite of the advantages of prison labor, it is argued that prisoners work is exploitative and it will displace civilian business and labor. These concerns put in place as the size and scope of prison labor expands and motivate legislative efforts in restricting prison labor. To improve quality of prison labor, the Bureau of Prisons needs to allow more private companies to employ prisoners at reasonable wage and to cultivate useful skills. Moreover, the operation body and methods of correctional work program should be reformed and specialized. It is recommended to consider establishment of special organization that concentrates in operating prison labor industry. Finally, it is suggested to benefits of prison labor should be measured and publicized to ensure quality of correctional work program.
