최근 우리나라 영상저작물의 해외 진출이 활발해지고 있다. 대장금이나 겨울연가와 같은 방송콘텐츠가 일본과 중국 등지에서 기대 이상의 높은 시청률을 기록하였고, 일부 영화는 한국에서보다 더 큰 흥행실적을 올리기도 하였다. 1980년대에 해외 영화제에서 우수한 성적을 거두던 시기와 비교하여, 최근 한류 바람을 이끌고 있는 영상저작물의 해외 진출은 ‘상품’으로 수출된다는 점에 특징이 있다. 해외에서 상품으로 유통되기 위해서는 저작권 문제가 가장 큰 법적 쟁점이다. 불법 저작물을 단속하고, 합법적 유통을 위한 권리처리가 이루어져야 한다. 이를 위해서는 권원의 확인이 필요한데, 저작권은 그 특성상 정당한 권리자가 자신의 권리를 증명하는 것이 매우 어렵다.중국에는 행정당국이 관여하여 영상물의 유통에 앞서 저작권 권리관계를 확인하는 절차를 마련하고 있다. 해외 영상물을 중국에서 발행하기 위해서는 판권국이 발급한 계약등기번호가 필요한데, 이 때 해외저작권인증기구의 권리자 증명제도를 이용하면 편리하다. 우리나라는 2006년 한국저작권위원회 북경사무소가 중국 당국으로부터 한국저작물에 대한 증명서를 발급해줄 수 있는 기구로 비준·허가 받았다. 우리나라에도 2006년 저작권법에 권리인증제도를 도입한 바 있으나, 아직까지 단 한건의 인증서 발급도 이뤄진 사례가 없다. 제도의 필요성에는 공감할 수 있으나, 그 운영 방법에 대한 해법이 마땅치 않기 때문이다. 본고에서는 중국의 제도를 연구하고 북경사무소의 실무를 분석하면서 시사점을 찾아보고 우리나라에의 적용 가능성을 타진하였다. 나아가 중국 인증기구의 심사와 한국 저작권법에 규정된 권리인증제도의 연계 방안을 모색하면서 양 제도의 발전적 개선 방안을 모색해 보았다.

In the eighties, Korean cinematographic works started to enter the overseas market. Recently Korean wave makes Korean movies and TV dramas more popular than ever, and China is one of the biggest Korean wave fan. The copyright clearance is a big obstacle in exporting cinematographic works, right holders of which are difficult to know, especially when it comes to cross-border situation because of the different legal system of each country. In China, in order to distribute overseas works, you should verify copyright in advance of the publication and get a registration number issued from National Copyright Administration. During the mentioned process, the verification system of a right holder is used for more convenience. With USA and Japan, Republic of Korea also obtained China's approval for the establishment of a verification organization. This system in China, which is that the government involves in the verification process, has important implications, and yet related study has not been preceded. This paper investigate the outline of the verification system of a right holder and the operational situation of this system in China, and analyse derived problems for the improvement.
