양도담보는 비전형적담보의 중요한 유형이다. 또한, 최근 중국민법학계의 관심 이 집중되고 있는 주제이다. 중국에서는 <민법전>과 <담보제도 해석>이 공포된 후, 양도담보를 비전형담보의 한 유형으로 볼 것인가와 관련해 집중적인 논의가 있었다. 이에 본고는 해석학의 측면에서 담보이론을 해석하며, <민법전>과 <담보 제도해석>의 내용을 종합적으로 분석하였다. 이를 통해 양도담보는 비전형담보의 일종으로서 <민법전>에서 인정해야 한다는 결론을 도출하였다. 한편 집합물의 양도담보와 관련해, 본고는 집합물의 법적 성질 및 물상대위에 관해 분석하였다. 본고는 집합물양도담보는 이론적 및 실천적 가치가 있다는 것 을 논증하였다. 또한, 집합물의 양도담보의 공시효력을 강화하고, 집합물양도담보 의 물상대위성을 인정해야 한다고 보았다. 이러한 태도는 채권의 실현을 보장하 는데 기여할 수 있으며, 특히 담보물이 대체된 경우 채권자의 이익을 보호하는데 유리하다. 그리고 거래안전도 강화할 수 있다. 그 밖에도 본고는 집합물의 과잉담보 문제에 대해 다음과 같은 해결방안을 제 시하였다. 우선 보증을 설정하기 전에 집합물에 대한 합리적인 평가가 진행되어 야 한다. 또한 계약당사자가 합당한 협상을 진행해야 한다. 이는 위험을 예방하 고 분쟁을 피할 수 있을 것이다. 한편, 집합물에 대해 담보권을 실행하기 위해 환가하는 경우에는 “일물일권주의”에 따라 집합물의 분리를 인정하여 담보책임을 명확히 해야 할 것으로 보았다. 이러한 방법은 당사자의 형평을 도모할 수 있고, 금융거래의 건강한 발전을 촉진할 수 있을 것이다.

With the increasing value of data and the growing power in the field of digital economy, China has taken the governance of cross-border data flow(CBDF) as an important national strategy. At the domestic policy level, China has piloted Beijing, Shanghai, Hainan and Xiongan New Area to create international data centers with the intention to control inbound and outbound data resources. At the domestic legislative level, China insists that the outbound data transfers be conducted in a secure environment. At the international cooperation level, on the basis of the Global Data Security Initiative, China builds the consensus of countries and promotes cooperation among countries along the Belt and Road routes on CBDF through the Digital Silk Road. Simultaneously, China will engage proactively in the newly international economic and trade agreements, with RCEP standing as a prime example. China’s discourse and model on CBDF governance have been continuously enhanced.

This research concentrates primarily on the foundation of the China International Commercial Court (CICC), considering the structure and functions of the Court. The main objective of CICC is to develop a dispute resolution mechanism for the Belt and Road Initiative (BRI). Given its predominant Chinese orientation, CICC may encounter various challenges as the BRI’s contracting members possess diverse judicial systems. This article will focus on the jurisdiction of the court and the procedures of enforcement of its judgments, orders, and direction. The authors also discuss the types of legal and administrative changes necessary to make CICC an effective and successful dispute resolution body. The BRI is a crucial element of Chinese strategies to control the global economic system. Therefore, CICC can provide critical insight into the present Chinese goals about international order. This paper finally examines that CICC symbolizes a Chinese ambition to strengthen, modify, or challenge the current international system.

In recent years, the global geopolitical landscape has been significantly influenced by nations asserting dominance in key sectors, including finance, intellectual property, and military industries. This ascendancy allows states to dictate terms and wield substantial impact on the world order. In particular, China has emerged as a pivotal player, strategically utilizing innovation and economic prowess to reshape international relations. This research examines China’s role in redefining global power dynamics, particularly within Africa, while evaluating the effectiveness and criticisms of its “soft power” strategies. China’s robust presence in critical sectors such as finance, intellectual property, and military industries underscores the correlation between leadership in these domains and global influence. The country’s economic and technological prowess has positioned it as a formidable player, enabling it to exert significant control over international rules and norms. The ramifications of such dominance transcend mere economic power, influencing diplomatic relations and shaping the international order.

Historically, the People’s Republic of China (PRC) has provided development assistance to Latin American countries even though PRC has not achieved developed country status itself. In explaining this puzzle, the literature emphasises the prevalence of material and economic interests in the region. The present study seeks, by key informant interviews, to provide a deeper understanding of this dynamic, specifically by paying attention to how this practice has taken shape in the case of Venezuela. Beijing opens extensive lines of credit based on a holistic trial-and-error approach and case-by-case adaptation. Loans have shifted from being seen as a solution to local problems to becoming another source of national economic stagnation. The criticism directed towards Chinese lenders is that they lack clear standards and this holistic adaptation tends to perpetuate the bad practices of unstable governments.

ICT가 중국-아프리카 경제무역 협력에 미치는 영향에 초점을 맞추어, 중국과 아프리카가 디지털 배당금을 활용하여 무역과 경제의 지속 가능 한 발전을 촉진하는 방안을 탐구한다. 본 연구는 주로 패널 데이터 모델 과 고정 효과 모델을 연구 방법으로 사용한다. 이러한 방법론을 통해 국 가 간 및 시간에 따라 관측되지 않는 이질성을 통제할 수 있으며, ICT와 경제적 성과 간의 관계를 강력하게 분석할 수 있다. 2005-2022년 데이 터를 통해 ICT가 중국-아프리카의 양자간 무역 및 아프리카 국가경제 성장에 미치는 영향을 분석한다. ICT는 중국과 아프리카의 양자간 무역 을 촉진하며, 아프리카 국가의 경제성장에 긍정적인 영향을 미치며, 특히 유선 전화와 휴대전화는 중국과 아프리카의 경제무역 협력에 가장 큰 기 여를 한다. 중국과 아프리카 회원국은 지역 협력을 강화하고 ICT와 같은 디지털 인프라의 효율성을 높이며 경제적 상호연결성을 촉진하고 무역 촉진 및 협력 수준을 높여야 한다.

본 연구는 중국 체류 시 인권유린과 함께 성적 학대를 경험한 북한이 탈여성의 외상 후 성장 경험에 대한 현상학적 연구이다. 본 연구에서는 북한이탈여성의 중국에서의 학대 경험과 한국에서의 회복 경험을 분석하 고자 했다. 연구에는 9명의 북한이탈여성이 참여했다. 연구방법은 현상학 적 연구로 접근했다. 자료 분석 결과 10개의 구성소요가 도출되었다. 이 는 잔인한 땅에서의 성노예, 인신매매의 공모 네트워크, 삶의 감옥에 갇 힌 수인, 자기의 파괴, 몫 없는 존재, 탈출 생명력, 손상된 정체성의 치 유, 사상의 해독에서 벗어나기, 주체적 자기 복권, 상처 입은 치유자로 제시했다. 연구결과에 근거하여 북한이탈여성의 외상 후 성장 경험에 대 한 회복을 지지할 수 있는 논의를 구체적으로 제언했다.

이 연구는 다차원적 배경음악 속성(유형，볼륨，리듬，친숙도)이 소비자의 심리적 정서 및 충 동구매에 미치는 영향을 연구함으로써 중국 또는 한국 소비자를 대상으로 하는 화장품 매장에서 매출 향상 측면에서 배경음악의 중요성을 인식시키는 목적을 가지고 연구되었다. 연구방법은 한 국 오프라인 화장품 매장에서 구매 경험이 있는 한국 및 중국 소비자를 대상으로 온라인 설문을 통해 각 150명의 유효 샘플을 사용하며 구조 방정식 모형으로 경로분석 및 다중집단 분석을 통해 변수간의 인과관계 및 집단간의 경로 차이에 대해 분석하였다. 분석한 결과，음악의 유형，볼 륨，리듬 및 친숙도가 모두 소비자의 심리적 정서 및 충동구매에 영향을 주었다. 한국 및 중국 소비자의 차이를 보면, 음악의 유형 및 친숙도는 한국 소비자들의 충동구매에 더 큰 영향을 미쳤 으며 음악의 불륨 및 리듬은 중국 소비자의 충동구매에 더 큰 영향을 주었다. 연구 결과 본 연구는 화장품 가게 매장에서 배경음악을 사용하여 소비자의 충동구매 행위를 자극하는 효과를 향상시켜 매장의 매출을 높이는 데 도움을 주었다고 도출하였다.

This study examined whether the perceptions of the theory of planned behavior (TPB) and individual and environmental factors related to healthy eating changed after the COVID-19 pandemic among adults living in Daqing, China. Data were collected through two rounds of online surveys conducted from April to May 2021 and from March to April 2023, using a questionnaire previously validated for use in Daqing. Using the snowball sampling method, 571 adult participants were recruited, most of whom were Daqing oilfield workers or members of their families. Multiple linear regression analyses were used to determine if the differences in the perceptions of the TPB and dietary environments exist during and after the pandemic after controlling for potential confounders. Scores of several subcomponents of TPB and mean scores of longterm intentions increased but scores of subcomponents and overall mean of motivation decreased after the outbreak. Multiple linear regression showed that only motivation for healthy eating decreased after the pandemic. Influenced by the pandemic, people increased their healthy eating behaviors. Nevertheless, as the pandemic subsided and the pace of life accelerated, people tended to choose convenient foods over healthy options. Consequently, the motivation for healthy eating has declined post-pandemic compared to during the pandemic.

2022 marks the thirtieth year of diplomatic relations between China and South Korea. Two countries’ relations are not only one of the most important state-to-state relations in East Asia, but also important relations that attract the attention of all over the world. This research used CiteSpace 5.8.R3 software to extract relevant papers on China-Korea relations from CNKI, a representative academic database in China. By extracting authors, institutions, keywords and other elements, this research focused on how the research on China-Korea relations in CAC is carried out and what kind of characteristics it has. This research found that in terms of the total amount, the number of academic achievements of CAC on China-Korea relations is not large, and China-Korea relations have not been the main focus of the CAC. From the perspective of scholars and institutions, CAC have not yet formed a core scholar and core scientific research institution. Judging from the keyword analysis, CAC have involved various fields of China-Korea relations, but their focus was mainly on the major events that happened each year, scholars’ vision was not broad enough, meanwhile the focus did not last long enough.

이 연구는 중국의 성공적인 실경 공연 작품의 비즈니스 모델을 분석함 으로써 향후 한·중 양국의 실경공연 발전을 위한 전략을 제시하고자 하 였다. 이를 위해 Osterwalder & Pigneur(2010)에 의해 고안된 비즈니 스 모델 캔버스를 활용해 최근 중국 현지에서 가장 성공적이라고 평가받 는 <판타지아·하남>을 분석하였다. 분석 결과, 일반적인 실경공연과 달리 <판타지아·하남>의 관객은 지역문화에 관심이 있는 젊은 사람들이 주를 이루었으며, 지역문화를 활용해 공연을 제작하고, 입소문 마케팅 및 홍보 를 적극적으로 전개하고 있었다. 또한 수익원으로는 호텔, 문화상품 판매 등 다양한 수익원을 발굴하는 데 주안점을 두고 있었다. 이와 같은 연구 결과가 시사하는 바는 첫째 공연 내용은 전략적으로 그 지역 특유의 문 화에 집중해야 하며, 둘째 수익원의 다각화가 필요하고, 셋째, 온·오프라 인의 홍보를 강화해야 하며, 마지막으로 그 지역의 현지인의 배우들을 육성하는 노력이 병행돼야 한다. 본 연구가 한국 및 중국 실경공연 시장 의 성장에 기여할 수 있기를 기대한다.

Since Dolichovespula kuami Kim & Yoon was first recorded in Korea in 1996, there has been ongoing debate over its valid specific status. However, through recent analysis of the male genitalia structure and DNA barcode, it has been proven that it is a different species from D. flora Archer, which live in China. D. kuami is an endemic species that mainly lives in forest areas in the central and northern parts of South Korea. It is a hornet species that is relatively rare due to low nest density. Therefore, little is known about their ecological characteristics. However, as numerous wasps of D. kuami were recently collected in the Jilin Province of China, their distribution records have been confirmed to be beyond the Korean Peninsula to China. Therefore, this study aims to record the distribution of D. kuami in China for the first time.

본 연구는 광시성(广西省)을 사례로 중국의 아세안 국가에 대한 고등교 육 협력 정책을 분석하는 데 목적이 있다. 연구 결과, 광시성은 중국 중서 부와 해상 실크로드를 연결하는 관문이라는 지정학적인 위치를 적극 활용 해 아세안 국가를 대상으로 한 고등교육 협력을 강화하고 있다. 중국 중앙 정부는 국가 전략적으로 광시성에 해상 실크로드 전략 중 ‘민심상통’에 토 대가 되는 아세안과의 고등교육 협력 강화를 중점 과업으로 부여하고, 광 시성 지방정부는 지역이 가지는 지경학적 특성을 고려해 아세안 국가를 대상으로 고등교육 협력을 강화하고 있다. 구체적으로 보면, 광시성은 “유 학 광시”를 브랜드화해 아세안 국가 학생을 유치하고, 아세안 국가 장학금 을 신설해 지원을 확대하고 있다. 또한 중국과 아세안과의 교역 관계와 산 업 분업구조가 심화함에 따라 아세안을 대상으로 한 직업교육을 강화해 일대일로 구축에 필요한 기술 인력을 양성하고 있다. 즉, 광시성의 아세안 국가와의 고등교육 협력은 자국 고등교육의 국제화 수준을 제고하는 한편 중국과 아세안과의 산업 분업구조에서 필요한 산학 인재를 육성하는 전초 기지로 역할하고 있다. 나아가 아세안과의 ‘교육 공동체’ 구축을 강화하고 있어 ‘중국몽’의 토대가 되는 ‘교육 강국’, ‘인류운명공동체’ 구축을 뒷받침 하고 있다.

Today’s digital economy has gradually emerged as a new engine of innovation for China’s economic growth. However, while injecting new vitality into the Chinese economy, digital globalization has also brought a series of challenges to China, such as data security, digital divide, unregulated competition among digital platforms, and a lack of mechanisms for protecting property rights. These issues underscore China's insufficient capacity for effectively regulating and systematically governing the digital economy. In contrast, South Korean government has implemented the ‘Korea Digital Strategy’ (KDS) and the ‘Basic Law for Promoting the Revitalization and Utilization of Data’ (Data Industry Act) to foster the development of the digital economy industry. These measures effectively solve the problems of digital industry development and governance, and thus improve the legal system of South Korea’s digital economy. Therefore, this study compares the construction of digital economy legal system in China and South Korea through comparative analysis, summarizes the experience of digital economy legal system construction in South Korea, and offers three insights for the development of China’s digital economy legal system. Firstly, China needs to improve the coordination of its laws for the digital economy, avoid repetitive and overlapping legislation, and enhance the scientificity and authority of legislation; Secondly, China needs to adopt a systematic and comprehensive approach to legislating and governing the digital economy, ensuring the consistency and coherence of the system; Thirdly, China needs to conduct more basic research, pay attention to the ethical and legal implications, and keep the legal system up to date, so as to ensure the effectiveness of the law.

최근 전 세계적인 경제 불확실성이 높아짐과 함께 미국 주도의 집중적 중국 견제 또한 심화되자 이미 제조업 중심의 성장이 한계에 다다른 중국은 새로운 돌파구를 찾을 수밖에 없게 되었다. 그 돌파구 가운데 하나가 문화산업의 집중적인 육성이었 고, 그것은 중국 정부의 여러 발표들을 통해 확인할 수 있었다. 이에 본 연구는 중국 의 문화와 문화산업에 대한 올바른 이해를 통해 시사점을 찾고자, 중국의 문화와 관 련 산업에 대한 인식 변화, 중국 문화산업의 주요 분류 및 특성, 정책의 주요 기조 등을 연구대상으로 하여 면밀히 분석하였다. 분석의 결과 얻은 가장 중요한 시사점 은, 중국 정부가 자신들이 원하는 경쟁력을 갖춘 문화산업의 안정적 성장이라는 목 표를 달성하기 위해서는, 문화 및 문화산업에 대한 정책의 방향을 현재의 규제와 통 제 중심의 정책으로부터, 자율적인 진흥 중심의 정책으로 적극적으로 전환해야만 한 다는 것이다.

스펀지 도시는 도시가 물을 효율적으로 사용한다는 개념을 강조한다. 도로의 스펀지화는 스펀지 도시 의 가장 직접적인 구현이며, 도시의 침수 및 물 부족 문제를 해결할 수 있다. 본 연구에서는 지닝시 성화 로를 대상으로 하여 성화로 이용에 대한 인식 및 개선수요를 분석하기 위하여 성화로 주민, 환경미화원, 지닝시 택시운전자 및 도로 계획가를 대상으로 현장 인터뷰 및 설문조사를 실시하였다. 조사내용을 바 탕으로 성화로 이용빈도에 대한 인식과 인구통계학적 특성의 유의성을 검증하기 위해 교차분석을 수 행하였다. 선행연구와 성화로 이용 인식분석을 통해 스펀지형 도로, 친환경 생태도로 및 안전형 도로의 3대 도로유형을 설정하였다. 도로유형의 각 항목의 중요도가 성화로침수에 미치는 영향관계를 결정하 기 위해 선형회귀분석을 수행하였으며, 성화로 개선의 방향을 결정하기 위해 AHP 계층분석법을 이용 하여 가중치를 계산하여 각 항목의 중요도 점수를 분석하였다. 분석결과 성화로는 LID 기술, 생태형 비 탈면 설계 및 식생배치가 도로 스펀지화 개선의 주요방향임을 알 수 있다.

본 논문은 주로 현장조사와 문서수집을 통해 중국 윈난다이징포자치주 루이리시 더훙 다이족 전통마 을의 현황과 현대 사회발전이 덕홍 다이족 전통마을에 미치는 영향을 조사하였다. 먼저 더훙지역의 지 형, 기후 등 자연배경과 사회구조, 문화적, 역사적 배경을 통해 덕홍 다이족 마을의 입지선정에 대한 역 사적 이유를 확인하였다. 그 중 문헌조사를 통해 더훙시 다이족의 16개 무형문화재 보호마을 중 가장 잘 보존된 곳이 한사마을임을 확인하였고 다이족 전통마을 경관연구의 대상지로 선정하였다. 본 논문 에서는 한사마을을 공간구성과 경관요소로 나누어 조사 및 분석한 결과는 다음과 같다. 한사마을은 자 연공간, 농업공간, 생활공간, 도로공간, 공공활동공간으로 나누어져 있으며, 마을 외곽 경계부는 대나무숲으로 둘러싸여 독립적인 형태를 띤다. 내부 공간구성은 채두(寨頭), 채심(寨心), 채미(寨尾)의 세 결절점을 중심으로 형성되며, 이러한 구심점을 통해 전체 마을 공간의 조직과 원시종교, 상좌부 불교가 어우러져 내향성을 더욱 확고히 하는 형태를 보인다. 한사마을의 경관요소는 건축, 식재, 시설물로 구 분한 결과는 다음과 같다. 첫째, 건축경관 측면에서는 한사마을의 독특한 종교와 기후, 한족 문화의 영 향을 받은 독특한 빌라식(别墅式), 건란식(乾欄式) 건축양식을 확인했다. 둘째, 한사마을 현장조사를 통해 불교의 영향과 자급자족하는 등 상징성 및 실용성을 강조하는 식재경관의 특징을 발견하였다. 시 설물은 대불교의 도덕이론에 기초를 두고 있으며, 시설의 스타일과 기능도 이에 영향을 받은 것으로 분석되었다. 이상의 조사와 연구를 통해 한사마을의 공간 배치는 민족의 역사와 종교로부터 배태(胚 胎)된 결과라는 결론을 도출하였으며, 종교적 신념과 공동체적 정신이 마을 전체를 지배하고 행태를 통제하는 경관을 보임을 확인하여 마을의 특수성과 보전 가치를 입증하였다.

시진핑 신정부가 2013년에 들어서면서 교육부는 정치교육을 강화하였다. 교육부는 고교학업수평고사 도입(2014), 대학입시제도 개혁(2016), 고교교육과정표준 개혁(2017 /2020)을 진행했는데, 그 결과 고교 경제교육 체계와 내용은 다음과 같이 변화되었 다. 첫째, 경제영역을 포함한 ‘사상정치’는 선택성 과목으로 바뀌었다. 둘째, 사상정치 중 정치영역 학습량은 늘어난 반면, 경제영역은 감소 되었다. 셋째, 영미권 ’주류경제 학‘의 주요 개념과 이론교육이 생략되었다. 넷째, 대학입시 선택과목 중 사상정치가 선택되는 비율이 최저치로 떨어졌다. 다섯째, 사상정치 중 경제영역 문제 비중은 2 4% 수준으로 축소되었고, 난이도는 더 쉬워졌다. 여섯째, 정치교육 강화 방침에 따라 사상정치 교과목의 절대 학습량은 오히려 증가했다.
