본고는 韓·中 고전문학 속에 등장하는 여성들이 송사를 제기하거나 또한 송사를 당하는 역할로 등장하는 작품을 살펴보고자 한다. 여성이 송사를 제기하거나 당하는 경우, 효녀, 열부, 현모양처인 경우에는 물질적 보상, 사회적 칭송을 받는 해피엔딩으로 끝나는 경우가 대부분이다. 이는 송사를 통한 법의 엄정성보다 법의 윤리의식이 우위에 있었던 고대 韓·中 봉건사 회의 일면을 보여 주고 있는 것이다. 한편 선한 의도와 행실에도 불구하고 억울함이 해소되지 않은 채로 끝나는 경우가 발견되기도 한다. 이는 송사라는 법적인 절차가 사회정의를 구현하는 통로이긴 하나 남존여비의 봉건사회에서 여성에게 그 기회가 완전히 보장될 수 없고, 또 다른 가부장적 기준으로 여성을 이중으로 평가했던 당시 사회의 한계점을 보여주는 예이기도 하다. 또한 일부 여성들은 원혼(冤魂)이 되어서까지 재심(再審)을 통하여 그녀들의 억울함을 사회에 공개적으로 호소하고, 해결 받고자 한다. 이를 통해 여성의 명예회복 및 내적 존엄성까지도 회복하고, 공개적인 법집행을 통한 처벌로 사회질서 확립과 사회정의 실현이 가능하였기 때문이다.

This article wants to review classical Korean and Chinese literature in which women either file lawsuits or are also sued. In most cases, when a womanis sued or subjected to a lawsuit, if the protagonist is a filial daughter, virtuous daughter or lady, the case usually ends with a happy ending, material reward and social acclaim. This shows a side of the feudal society of ancient Korea and China, wherethe ethics of the social norm prevailed over the strictness of the law through litigation. On the other hand, in spite of good intentions and good behavior, unfairness may end up with resentment unresolved. This is also an example of the limitations of societyat the time when the legal process of litigation is a sort of way to embodying social justice, but the opportunity cannot be fully guaranteed to women in a feudal society of male-dominated system. Some women also publicly appeal to society and seek to resolvetheir grievances through retrial with becoming ghosts. This is because it enabled the restoration of the honor and even the inner dignity of Western women, and the establishment of social order and realization of social justice through punishment by publiclaw enforcement.
