The development potential of the aquaculture industry is very high, but there is no financial support for investment except for the government, policy funds, fishery funds, etc. Therefore, we would like to propose a contract transaction in the aquaculture industry. This refers to a forward contract between a producer (fish farmer) and a buyer (mainly a processor or marketer) that stipulates the production and supply of fish products at a predetermined price, but it also refers to an “equity participation type” contract in which both producers and buyers can participate. In other words, it is a model in which part of the fish farm is produced in a way that meets the conditions of the buyer, and part is produced by the producer. This study aims to establish the basic contract trading process. It provides an academic approach to prevent adverse selection and moral hazard due to information asymmetry. It also provides an idea to converge the aquaculture industry with the financial industry using Pecking Order theory. By doing so, we have made it possible for venture capitalists to invest with confidence and provided a process for investors to resolve their concerns, paving the way for the aquaculture industry and the financial industry to develop together.

Criticism has erupted around the world over the paper “Contracting for sex in the Pacific War” written by Mark Ramseyer, a Mitsubishi professor at Harvard University Law School. Ramseyer insists tha “comfort women” by Japanese imperial military made “credible contracts” with recruiters regardless of the Japanese government or the Japanese military. Ramseyer further insists that the “comfort women” were certified prostitutes. However, the Japanese government selected recruiters secretly and provided them with convenience in mobilizing women. Recruiters have deceived women, mainly by job fraud, into kidnapping them to military brothels. The recruiters signed with Japanese women as barmaids (shakuhu), meaning women who served drinks. However, the Japanese military brothels were prohibited from drinking. Almost Korean women were illiterate in 1940’s, so recruiters did not make contract papers with them. It was very easy to deceive Korean women to make sexual slaves of Japanese military. The surviving Japanese military’s surgeon or soldiers testified that Korean “comfort women” had been sexual slaves.

Supply units in each command are multi-tiered and each supply unit keeps a supply level independently, which can cause excess stock, leading false reports to the Logistics Command and increasing difficulties in managing user needs. This causes excess assets and the excess then causes deformation in demand. therefore, the supply support systems of our armed forces have become high-cost/low-efficiency and are insufficient to meet the needs of users in combat units. Civilian corporations and the US Department of Defense are downsizing the aforementioned multi-tiered supply systems thus revolutionizing efficient and effective logistics by adopting Supply Chain Management(SCM), and Prime Vendor policies. Prime Vendor policy is a logistics support method that allows users to directly request and receive supply items from suppliers, based on supply contracts between suppliers and central maintenance organizations like KDA. In other words, it is a system that allows for users to make orders to suppliers directly and suppliers to deliver goods to the users directly, cutting out the middle stage, thus allowing an efficient supply. This is a way forward in finance that cuts costs in net supplies and allows an efficient utilization of civilian assets. which is also known to fasten the speed of logistical support and stripping down the logistical structure. therefore, this report will explore Prime Vendor policies adopted in certain number of units for medical supplies that were taken in consideration of improvements in stock management in civilian organizations and the US Army, and aims to apply such policies for repair parts.

CESL은 EU 역내 계약법을 개정하지 않고 개별회원국이 채택하는 경 우 특별법의 지위를 점할 수 있도록 성안되었다. 이에 CESL은 국제상사 계약에 있어 계약당사자의 합의에 따라 자발적으로 적용된다. CESL상 계약당사자의 의무 및 불이행에 관한 규정체계는 구체적이고도 광범위하 다. 주요 내용은 의사표시하자, 계약의 현저한 불균형 내지 불공정성, 표 준약관 삽입과 관련한 법적 유효성, 소유권 또는 담보권의 이전에 대한 법률효과, 계약의 유효성, 서비스 계약 및 디지털 콘텐츠와 관련한 계약 등이다. 이 경우 CESL은 서식의 교전에 관한 규정을 보유하여 보다 포 괄적이고 응집된 규칙을 보유하고 있는 특징이 있다. CESL은 독립적으로 그리고 당해 목적과 일반원칙에 따라 해석되어져 야 하고, 나아가 CESL의 범위 내에 있지만 명시적으로 규정하고 있지 않는 사안에 대하여도 그 처지는 마찬가지다. CESL의 적용에 대하여는 해석, 합리성, 불요식, 개별적으로 협상되지 않는 계약내용, 계약의 해제, 혼합목적의 계약, 통지, 기간의 계산, 일방적인 진술 또는 행동 등이다. CESL은 계약체결 전 일방이 계약내용에 기한 정보를 제공하지 않을 경우 신의 및 공정거래 위반에 해당되는 것으로 취급하고 있다. 나아가 원거리 계약의 경우 전자적 방법의 계약체결을 용인하고 있고 계약체결 전 또는 체결 시 정보를 제공하는 일방은 계약내용의 구속력 확보를 위 해 그리고 특정장소에서 당해 의무를 준수하기 위한 정보가 정확히 전달 되었음을 확인할 수 있도록 합리적 주의의무를 부과하고 있다. 만약 당 해 의무위반에 기하여 부정하거나 잘못된 정보가 제공된 경우 타방은 특 단의 구제권을 행사할 수 있다. CESL은 당사자의 합의, 합의에 기한 법적 구속력, 충분한 계약의 내 용과 확실성 등을 계약체결의 요건으로 두고 있다. 또한 의사표시의 하 자에 기하여 착오ㆍ사기ㆍ강박ㆍ부당한 착취에 대해 계약을 취소할 수 있는 권리를 보장하고 있으며, 취소통지, 취소효과, 추인, 손해배상금, 구 제수단의 배제 또는 제안과 구제수단의 선택 등을 이에 추보하고 있다. 나아가 계약내용의 해석기준으로서 계약내용 해석의 원칙, 계약내용 및 그 효력, 불공정한 계약내용 등으로 구분하여 다루고 있는 특징이 있다.

아시아 최초의 민영교도소인 아가페소망교도소가 경기도 여주에 개원된 지가 2년 6개월이 되었다. 민영교도소가 이슈화 된 초기 시점부터, 300여 명의 재소자를 수용하고 다양한 교화 프로그램과 교정행위가 진행되는 현재에도 소망교도소를 둘러싼 잡음들(noices)은 가라앉지 않고 있다. 논란의 소용돌이에 여전히 답보되어 휘청거리지 않고 묵묵히 황소걸음을 옮기고 있는 것은 결정과정에서 과도한 정치사회적 비용을 부담하면서 겪은 내성력 때문이기도 하지만 성공적 정착에 대한 공감대 또한 점차 커지고 있다는 반증이기도 하다. 이제 민영교도소라는 민영화 및 민간위탁 프로그램의 성공적 집행을 위해 과정평가와 성과평가에 관심이 집중되어야 할 때이다. 하지만 종교형 민영교도소라는 민영화 및 민간위탁사업의 집행과정과 집행결과 및 성과를 평가하는 분석기준과 평가지표를 내포한 종합적이고 체계화된 평가모형에 대한 연구는 거의 전문한 실정이다. 이러한 현실에서 주체와 이용고객에 대한 특성은 다소 차이가 있지만 공공서비스와 사회복지시설(특히 생활시설 혹은 보호시설)에서 교정복지서비스 능률성 평가에 근접한 이론과 연구를 분석대상으로 삼았다. 검토된 내용을 근거하여 분석기준과 분석항목의 설정하고 이에 따른 평가(분석)지표를 구성하였고 능률성 평가모형을 탐색적으로 구성해보았다. 요컨대 민영화 및 민간위탁의 능률성 분석기준은 대체로 인력관리, 재정관리, 면적과 공간, 프로그램, 그리고 지역사회와의 관계에서 자원봉사자들의 활동이다. 다섯 가지 분석기준에 따른 세분적인 내용을 기초로 하여 분석지표를 구성하였고 가능한 정량적 지표구성을 위해서 3단계 척도나 증감수치를 적용했다.

환경보호 분야에서는 국제협약의 원활한 이행을 위해 당사국 간의 긴밀한 협조가 요구되며, MARPOL 73/78 상 보고의무는 해양환경보호를 위한 국제협력의 일환으로서 중요한 역할을 하고 있다. 이 연구에서는 MARPOL 73/78 상 보고요건의 국제법적 의미에 대하여 살펴보고, 당사국들의 보고의무 이행현황을 조사하였다. 이를 위하여 2001년부터 2010년까지 지난 10년간의 MEPC/Circ.318의 각 항목에 따른 MARPOL 73/78 상 보고의무의 이행현황을 분석하였다. 또 다른 한편으로는 이러한 이행현황에 대한 분석을 통해 당사국의 보고의무 준수율을 향상할 수 있는 개선방안을 제시하였다.

본 연구는 현재 통폐합 위기에 처한 부산항부두관리공사의 답당 업무인 국제여객터미널, 크루즈터미널, 연안여객터미널 등 항만시설 관리업무의 합리적 민간위탁 방안을 모색하고자 하였다. 이러한 연구목적을 달성하기 위하여 이들 항만시설 관리의 위탁기간, 위탁의 당위성(장점), 위탁범위와 위탁비용 등을 탐색하였다. 연구의 결과, 부산항부두관리공사 자체를 주식회사 형태로 민간화하고, 항만시설 관리업무를 동 법인에 위탁시키는 방안이 최선의 대안으로 도출되었다.

미국에서 CAFC의 Mallinckrodt 판결, Bandaq 판결 등의 일련의 판결에 의하여 특허권소진은 실제적으로 쉽게 적용을 피할 수 있는 원칙으로서 거의 특허실무에서 실무가들의 기억에서 사라진 원칙이었다. 그런데 LG v. Quanta 사건을 통하여 미국 연방대법원이 방법특허의 예외를 인정하지 않고, 계약에 의한 배제를 위한 조건부 계약의 인정에 대해서도 특허법에 의한 적용에 있어서는 특허권 소진을 인정하지 않았다. 다만 계약에 의한 권리구제의 가능성을 남겨두었다. 미국 연방대법원이 Univis 사건에서 천명하였던 원칙은 여전히 살아있어 반제품의 경우에도 단순한 작업이 남아있다는 사실만으로 특허권의 소진이 인정되지 않는다고 함으로써 특허권침해를 방어하기 위하여 방어하는 측의 소송대리인이 특허권소진항변을 하고 이를 받아들이도록 하는 것은 쉽지 않은 원칙이었다. 미국 연방대법원이 LG v. Quanta 사건을 통하여 전통적인 특허권소진의 부활을 천명함으로써 향후 특허실무상 라이센스 계약을 체결할 때 이중 특허라이센스를 통한 라이센스의 이중수취라는 비난과 함께 특허권소진을 통한 수익감소라는 손해를 입지 않기 위해서는 특허권소진을 충분히 고려하여야 할 것이다.

The effects of the applied stretch and MgADP binding on the structure of the actin and myosin cross-bridges in rabbit fibers in the rigor state have been investigatedwith improved resolution by x-ray diffraction using synchrotron radiation. To clarify the structure of the ATP hydrolysis intermediates formed by actin and myosin cross-bridges,the effects of various phosphate analogs in the of MgADP on the structure of the thin and thick filaments in glycerinated rabbit muscle fibers in the rigor state investigated by x-ray diffraction with a short exposure time using synchrotron radiation. These results strongly suggest that when MgADP and phosphate analogs such as metallofluorides(BeF3 and AlF4)and vanadate(VO4(Vi)) were added the rigor fibers in the presence of the ATP-depletion backup system, the intensities of the actin-based layer lines were markedly weakened. We found that the intensity of the 14.5 nm-based meridional reflections increase by 20-50% when phosphate analogs such as metallofluorides(BeF3 and AlF4) and vanadate(VO4(Vi)) was added to the rigor muscle.
