This study examines the significance and problems of the Fourth Amendment to the Fisheries Act, which went into effect in January 2023. Following the passage of the Aquaculture Industry Development Act, the fourth amendment to the Fisheries Act sought to reform the fisheries legislative framework, while also including significant changes. In particular, a number of new systems for managing fishing gear have been implemented, and local governments now have some autonomy in fisheries management, which has allowed for adjustments to be made to meet the needs of the fishing industry and changes in socioeconomic situations. However, as independent legislation for each fisheries sector continues, the subject of regulation under the Fisheries Act, as well as the Act's position as a basic legal system, has been continuously reduced, overshadowing the Act's objective. As a result, a full-fledged assessment of changing the legislation's name in the future is required, as well as addressing issues such as the lack of difference in the legislative purpose clause and the necessity for further revision of the definition clause. Therefore, any future revisions to the Fisheries Act should aim to overhaul the existing framework, including fishing licenses and permits.

This study explores strategies to expand Korea's top 10 seafood export in the oversea market, with a specific focus on the impact of export concentration. For certain seafood items such as laver, crab, and mackerel, characterized by low export concentration, adopting a focused export expansion strategy is more effective. Conversely, highly concentrated seafood items such as toothfish, cod, pollack, and abalone face high risks in export performance due to their heavy reliance on a small number of key export countries. To ensure export stability, it is advisable to implement a diversified export expansion strategy for these highly concentrated seafood items. In the case of medium-concentration seafood items like tuna, oyster, and flounder, the decision between a concentrated or diversified strategy should be based on their specific export situations. Tailoring strategies to the distinctive market characteristics of each seafood item enables exporters to effectively increase oversea market share, promoting stability and sustained growth in export performance.

The development potential of the aquaculture industry is very high, but there is no financial support for investment except for the government, policy funds, fishery funds, etc. Therefore, we would like to propose a contract transaction in the aquaculture industry. This refers to a forward contract between a producer (fish farmer) and a buyer (mainly a processor or marketer) that stipulates the production and supply of fish products at a predetermined price, but it also refers to an “equity participation type” contract in which both producers and buyers can participate. In other words, it is a model in which part of the fish farm is produced in a way that meets the conditions of the buyer, and part is produced by the producer. This study aims to establish the basic contract trading process. It provides an academic approach to prevent adverse selection and moral hazard due to information asymmetry. It also provides an idea to converge the aquaculture industry with the financial industry using Pecking Order theory. By doing so, we have made it possible for venture capitalists to invest with confidence and provided a process for investors to resolve their concerns, paving the way for the aquaculture industry and the financial industry to develop together.
