필자는 이 글에서 법률행위의 성립요건과 효력발생요건은 구별되어야 한다는 입장에 서서 두 가지 점에 대해 집중적으로 살펴 살펴보고 있다. 첫째는 증명책임의 소재와 관련한 것으로, 권리장애사실에 대해서는, 그 증명책임은 권리장애사실을 주장하는 자에게 있다고 보는 통설과는 달리, 법률행위의 성립을 주장하는 자에게 있다고 보아야 한다는 것, 이는 법원의『직권판단』의 대상이라는 점을 명백히 하였다. 이와 같은 법리의 정립은 항거불능의 강제상태 하에서의 의사표시는 법률행위의 불성립으로 보아야 한다는 결론을 이끌어낸다. 종전의 통설은 이를 단순한 효력요건으로 보고 주장 및 증명책임에 대해 효력을 다투는 자에게 있다고 봄으로써, 국가권력기관의 강압에 의한 항거불능상태에서의 재산헌납 등이 단순한 법률행위의 취소사유에 그치고 제척기간의 경과로 취소권행사가 봉쇄되는 어처구니없는 판결이 양산되었다. 둘째는 법률행위의 효력요건을 효과귀속요건과 효력발생요건으로 나누는 일부학설과 관련하여, 처분권부여와 관련한 문제는 대리권의 수여와 동일한 문제로 처리하여야 한다는 점, 그리고 법률행위의 추인은 반드시 무권대리의 경우에만 허용되는 것은 아니고, 법률행위의 무효․취소에 널리 인정되기 때문에, 굳이 효력요건을 효과귀속요건과 효력발생요건으로 분류할 필요가 없다는 점을 지적하고 있다.

Heavy metal concentration of Fe, Zn, Cu, Cd and Pb were analysed from seaweeds (Ulva pertusa, Sargassum thunbergii, Caulacanthus okamurae), sediments and seawater at the two experimental sites of Daebul and Sabjin industrial complex in Mokpo coastal area

Resistance performances of a leisure yacht with different keels, which are center and double keels respectively, are investigated by model test at circulating water channel. Flow patterns around the keels are observed by tuft test to make clear the relation between resistance performance and flow around keels. The results show that the keel does not affect free surface and double keel yacht has better performance comparing single keel yacht in resistance point of view.

본 연구는 설치와 해체가 용이하여 간이식 구조에서 활용되는 시저스 전개형 구조에 관한 것으로, 입면상의 곡률변화 방법을 고찰하고 그에 따른 구조특성을 파악하고자 한 것이다. 먼저 시저스 구조의 입면상 곡률과 시저스부재의 내부절점 편심거리와의 관계를 식과 그래프를 이용하여 나타내었다. 이에 따라, 동일한 시저스부재에서 내부절점 편심거리를 조절하여 곡률을 변화시킬 수 있는 해석모델을 고찰함으로써, 곡률변화에 따른 시저스 구조부재들의 구조적 특성을 고찰하였다. 또한 고찰된 구성방식에 근거하여 실 모델을 제작하고 전개과정을 살펴봄으로써 실제 전개가능성을 검토하였다.

The unpleasant air quality surrounding Incheon airport highways which is called gateways of Korea is caused by various odor emission sources such as Sudokwon landfill and Seobu industrial complex. In this study, the air quality near Incheon airport highways was investigated. Odors could be confirmed from various sources such as Sudokwon landfill and Jumul industrial complex, and hydrogen sulfide and acetaldehydes was detected regionally. Based on this study it was suggested to manage odor controlled regions and to provide the more information to make more pleasant air quality in the studied area.

나노입자란 직경 100nm 이하의 크기를 가진 입자로 가전, 기능성 화장품, 반도체, 항균제 및 광촉매제 등에 널리 사용되어 있어 본 연구는 9종류의 나노입자가 참굴 수정란에 미치는 영향을 살펴보았다. 나인입자를 첨가하지 않은 대조구에서는 인공 수정한 참굴 수정란의 78%가 D형 유생으로 발생하였다. 은(Ag)이 2% 함유된 AGZ020, Nano silver 및 P-25의 나노입자와 주석산화물인 SnO의 나노입자는 24시간 경과 후 0.05ppm 농도에서 각 각 22%, 52%, 58% 및 76%가 D형 유생으로 발생하였으나, 20ppm 농도에서 8시간 이내 참굴 수정란을 모두 파괴하였다. In, Sb, Sn, Zn 및 Ag-TiO2의 나노입자는 24시간 경과 후 0.05ppm 농도에서 모두 70%이상의 D형 유생으로 발생하여 상대적으로 낮은 농도에서 큰 영향을 받지 않는 것으로 나타났으나, 20ppm 농도에서 대조에 비해 D형 유생 발생율이 각 각 57%, 60%, 50%, 65% 및 64%로 저해되었다.

Survey on the food intake status and health condition of the elerly over 65 years old living in Damyang Jeonnam was performed and meal menus for the pavillion were developed using local products. Allowance of the elderly less than 100,000 won was 45%. The local products of the area recognized by the elderly were bamboo shoot (30%) > bamboo (22.5%) > bamboo basket (12.5%) > do not know (15%) > green tea (10%) > rice(7.5%) > vegetable. In dental health, 52.5% of them had bad condition but 62.5% did not use denture at all. The most favorate foods were Korean (92.5%) and Chinese and Japanese were favored by 5%, and 2.5%, respectively. In percentage of eat-out and use of instant foods, 42.5% of them answered that eating-out chances were very rare and 62.5% answered that they do not use instant foods at all. Potassium intakes for the male and female elderly were significantly very low with values of 2579.2 mg and 2601 mg, respectively (p < 0.05). Calorie intakes for men were 1678.5 kcal, which was only 84% of RI and 1470.8 kcal for women (92%). Shortages of nutrition including calcium intake and others were very serious and the meal was not nutritionally balanced based upon the study of GMDFO. The menu for the elderly in busy farming season of the area were developed with the use of local products and the information from the study.

본 연구에서는 한반도 남동부의 의성분지 내에 위치하는 화산칼데라 지역을 대상으로 지구물리학적 연구를 수행하였다. 기존 연구들의 한계를 극복하기 위해 원격탐사를 통한 전체적인 구조 특성을 분석한 후에 정밀한 3차원 포텐셜 해석을 수행하는 기법을 적용하였다. 첫 번째 단계로, 수치지질도 및 DEM 자료와 인공위성 영상을 이용하여 대상 지역의 선구조를 분석하였다. 선구조 분석 결과는 선행 연구결과와 상당히 잘 부합되었고, 남-북 방향과 남동-북서방향이 가장 우세함을 보여주었다. 두 번째 단계로, 선구조 분석 결과를 고려하여 의성분지 전체 지역에서 조밀한 중력탐사 자료를 획득하였고 항공자력탐사 자료와의 복합 해석을 통해 광역적인 칼데라의 구조를 조사하였다. 파워 스펙트럼 기법을 이용한 분석 결과, 의성 분지 하부는 개략적으로 2개의 밀도 불연속면 이 존재하는 것으로 해석되었다. 첫 번째 불연속면의 심도는 약 1 km로 칼데라 지역 내에 존재하는 화산쇄설성 퇴적암의 심도나 화산칼데라의 ring vent 위치에서 관입하고 있는 관입암의 심도로 판단되며, 두 번째 심도는 약 3-5 km로 분지기반암의 심도와 관련 있는 것으로 추정된다. 또한 3차원 중력역산을 실시한 결과 남서쪽의 백악기 팔공산 화강암과 북동쪽의 불국사 관입암류에 의한 저밀도체가 나타나고, 화산칼데라 중앙부 부근에는 화산쇄설성 퇴적암류 또는 칼데라 형성 과정에서 침강된 상부의 퇴적층으로 해석된 퇴적층이 주변보다 낮은 밀도를 가지며 하부로 약 1.5 km까지 연장되어 있는 것으로 분석되었다. 그러나 포텐셜 자료는 그 특성상 수직 분해능이 양호하지 못하므로, 수직적인 발달 특성을 갖는 칼데라의 구조를 정확히 파악하기는 어렵다. 본 연구에서는 이런 한계점을 극복하기 위해서 동일 지역에서 이루어졌던 자기지전류 탐사 결과와 비교 분석하여 효과적인 해석을 수행하였다.

Dietary behavior of the elerly over 65 and local products in Yeongi Chungnam were studied during busy farming season and meal menu was developed based upon the information surveyed. In allowance, 45% of them lived with less then one hundred thousand won but 95% had their own residence(P<0.001). The dental health conditions of the male and female elderly did not show significant differences but had tendencies of bad conditions with 68% and 80%, respectively. Percentage of using denture at least one side was only 48%(P<0.05). Meal preparation was mostly done by 75% of the female elderly and only 64% of the elderly in the area took meals regularly. Recommended intakes(RIs) of calorie, protein, dietary fiber, calcium for the elderly were significantly very low(P<0.001), but those of sodium were high(P<0.05). Meal menu was developed for the meal service introduction in the pavilion of the elderly with considerations of the food habits, nutritional status, and local products studied.
