본 연구는 ‘주택재건축사업에서 부패가 왜 발생하는가? 에 대한 근본적이고 원론적인 문제 의식에서 출발하였다, 최근 일부 지방자치단체에서 도입된 공공관리제도를 포함하여 주택 재건축사업제도의 일반론을 이론적으로 고찰하고, 사업추진과정에서 발생하는 관계자의 역할과 책임을 통하여 재건축사업 추진과정에서 각 사업참여자들 사이에 발생하는 부패의 문제를 공공의 참여와 감독을 통하여 개선 가능성을 조망하고자 한다. 주택재건축사업과정 에서 발생하는 부패의 근본원인을 찾고 이를 유형화해보고 그 통제방안을 공공관리제도 제 도의 틀 안에서 제도적 개선사항과 함께 제시하고자 한다.
It is controversial to say just what kind of role the government bureaucracy actually had in the social conversions of the Korean society. By emphasizing the 'Growth First Belief' over everything else, the quality of life and happiness of the people have always taken a backseat. In the process of rapid industrialization the unattractive mingling of special privileges and rights with the blind worshipping and idolization towards power and riches which happened has led to the creation of new terms such as 'pariah capitalism' and 'bureaucratic mafia(bureaufia)'. Concentrating the state resources and consequent choices made by the developmental state have also led to the worsening of the inequality and concentration of wealth as a result. South Korea's authoritative bureaucracy is a centralized body of the state and can be seen as the party responsible for providing the seed of the present inequality of the Korean society. This paper will look at the evolution and the effects on how ‘the growth first’ public policy had on the inequality that exists within the Korean society and contemplate upon the measures that can alleviate these problems. The paper also attempts to offer several suggestions that will lead to a fairer and more equal society. First, there should be a conversion of the goal in public administration for the better quality of life which is not of a quantitative nature of the growth. Second, there should be an execution of ‘proper’ regulations that are deemed most necessary in the most effective positions which will heal the side effects of the growth. Finally, there should be a drastic embracement and investment on the part of the social welfare administration to respond to the inevitable low birth rate and aging society.
Moon-Young Lee is a layman, not a theologian or pastor, who practiced and influenced Christian values and world view during his academic journey. His impact has been felt for 130 years in Korean Christianity. Moon-Young Lee declares that the foundation of American public administration is the 95Theses of Martin Luther in his book ‘Man, Religion, State’. He also interprets the 95 Theses insections of “Methodology, Work and Men”. In relation to “Methodolgy”, Articles 1-7 and 92-95 explain repentance in its entirety. These articles show how man should live through out his life. The section about “Work” is classified in an ethereal world(articles8-55). These articles teach that the work of man is to pursue God’s justice not “profit” symbolized by purchase of indulgences. The section about “Men” is described in articles 56-91 and states that man is a being standing before God(coramDeo) not before priests or the church. Moon-Young Lee’s motive for joining public administration with Christianity is his childhood motto of: “I will study hard for my country from now on, but within the scope of Christianity.” For him, the 95 Theses of Martin Luther show the origin of and the foundation of three courses of action for public servants within administrative organizations.
This paper examines Professor Moon-Young Lee’s academic achievement, which has been less highlighted than his popular image of a pro-democracy fighter. In fact, Lee was a puritan and dissident intellectual who studied public administration and believed in God throughout his lifetime. Lee employed ‘who-what-how’ categorization and transcendence ethics (i.e., nonviolence, personal ethic, social ethic, and self-sacrifice) to describe and analyze administrative phenomena. Lee’s nonviolence in particular plays a key role in his framework of transcendence ethics and is used in unique ways. His nonviolence is (1) not to use violence but to use ‘word,’ (2) to tell the truth (right things), (3) to tell right things only, (4) to use complete nonviolence, and (5) grounded in laws, common sense, and agreements. Nonviolence will be a likely option for those who do not have strong power and must address an evil counterpart. Citizens’ rational resistance and nonviolence will protect themselves from and correct the power abuse of evil regimes. However, the weak must persevere against the violence of the strong and wait patiently on the long road from nonviolence to self-sacrifice. Accordingly, it is not easy to practice Lee’s framework of transcendence ethics in reality. Nevertheless, his transcendence ethics, nonviolence in particular, appear to provide practical and realistic guidance for public administration reform.
공공시설이라 함은 공공의 이용에 제공된 물건으로서, 직접적으로 행정목적 달성에 제공되는 것이라는 점에서 우선 강학상 공물에 해당한다. 또한 행정법은 공익실현을 최우선의 목표로 하기 때문에, 결국 행정법이 추구하는 공익실현의 물적 도구 개념이 바로 공공시설이라고 할 수 있으며, 시설물의 형태적 요소보다는 설치의 목적이 중요한 개념요소가 된다.공물이란 행정주체에 의해 직접 공적 목적에 제공된 유체물과 무체물 및 물건의 집합체를 의미하는 바, 민법상의 소유관계가 중요한 것이 아니라 비록 사법의 적용을 받는 물건이라도 일정한 관점과 일정 범위에서 공법상의 목적에 의해 제약을 받는다는 점에서 사물과 구별된다.영조물법인이란 공공서비스 경영목적의 공법상의 법인이라고 정의할 수 있는데, 공법에 의해 창설하는 인적·물적 시설의 총합체라는 조직적 개념에 공공서비스적인 측면을 부가시킨 것으로 이해할 수 있다. 영조물법인은 권리, 능력을 향유하는 법인체인데 반하여 공공시설이라 함은 공익을 만족시킬 목적에서 행해지는 공공토목공사의 결과로서 남게 되는 공공의 욕구에 할당된 단순한 구조물을 의미한다.한편, 프랑스에서 공기업이라고 하면 일반적으로 “전체적 혹은 부분적으로 사적인 소유나 경영의 지배를 피하여 국가나 지방자치단체의 다소 밀접한 감독을 받는 법인체의 회사”를 말한다. 이때의 법인격은 공법인, 사법인을 불문한다. 공기업이란 영조물과 마찬가지로 조직체의 관점에서 파악되어야 하며, 다만 기능적 관점에서 영조물과 차이가 날 뿐이다.공공시설의 개념은 방법론상으로는 강학상의 공물, 영조물, 공기업의 물적 요소들을 지칭하는 도구개념으로 사용될 수 있다. 이러한 경우, 영조물이나 공기업에 있어 조직법적 논의를 제외한 물적 요소에 관한 법적 문제에 대해 통일적 이해를 도모할 수 있게 된다.
The interest for public administration service which is regarded as the service industry recently is increasing. This means that the value of customer satisfaction pursued from enterprise section in the past is broadly accepted as the goal of struggle for existence in both public and personal domain. But, it can be said that quality problem in public administrative service is remained if it regards as simple campaign for kindness The kindness is nothing but an one of facts which consist of satisfaction.
In this paper, we develop the Lean model called LPAM(Lean Public Administration Model) to improve the public adminstration service in the base of acceptable methodology which is widely using in improvement. Also we examine that proposed model can work well as the improve process pursuing customer"s satisfaction and improvement of public administration service.
