Registration and identification of companion dos in urban areas is important for the wellbeing of the animals themselves, owner's piece of mind, and to allow city to plan for future community needs. Recently, in Korea, all dogs in urban areas must be registered at the regional city offices. Owners are encouraged to implant microchips in their cats and dogs regardless of age as it ensures these pets can be quickly reunited with the owners after separation. We are aimed to conduct the survey research to evaluate the perception of companion dog's owners on the animal registration policy. We deals with the findings obtained from extensive interviews with a representative samples. The objectives of interviews included 300 owners in Iksan city. Questions focused on how people were recognized the need and policies of animal registration. Questionnaire and technical data are analysed and summarized. As the results of the survey research, the objectives of interviews had well understood about the policies of animal registration. Conclusionally, the promotions of animal registration policies were need. The development of fanimal registration policies were desirable for the establishment of companion animal welfare.

부동산에 관한 점유취득시효의 완성 후 그 등기를 하기 전에 제3자의 처분금지가처분등기가 이루어진 부동산에 관하여 점유자가 취득시효 완성을 원인으로 소유권이전등기를 하였는데, 그 후 가처분권리자가 처분금지가처분의 본안소송에서 승소판결을 받고 그 확정판결에 따라 소유권이전등기를 하였다면, 점유자가 취득시효 완성 후 등기를 함으로써 소유권을 취득하였다는 이유로 그 등기 전에 처분금지가처분을 한 가처분권리자에게 대항할 수 없는 것이 원칙이라고 할 것이다. 그런데 부동산에 관한 점유취득시효 완성 당시의 소유명의자의 소유권등기가 무효이고, 취득시효 완성 후 그 등기 전에 이루어진 처분금지가처분의 가처분권리자가 취득시효 완성 당시 그 부동산의 진정한 소유자이며, 그 가처분의 피보전권리가 소유권에 기한 말소등기청구권 또는 진정명의회복을 위한 이전등기청구권인 경우에도, 위와 같은 원칙이 그대로 관철되어 적용되어야 하는지 여부가 문제된다.이에 대하여 대상 판결은, 부동산에 관한 점유취득시효 완성 당시의 소유명의자의 소유권등기가 무효이고, 취득시효 완성 후 그 등기 전에 이루어진 처분금지가처분의 가처분권리자가 취득시효 완성 당시 그 부동산의 진정한 소유자이며, 그 가처분의 피보전권리가 소유권에 기한 말소등기청구권 또는 진정명의회복을 위한 이전등기청구권인 경우에는, 그 가처분권리자로서는 취득시효 완성을 원인으로 하여 이루어진 소유권이전등기가 자신의 처분금지가처분에 저촉되는 것이라고 주장하여 시효취득자의 소유권취득의 효력을 부정할 수 없으며, 취득시효 완성을 원인으로 하여 그 완성 당시의 등기명의인으로부터 시효취득자 앞으로 이루어진 소유권이전등기는 실체관계에 부합하는 유효한 등기라고 판시하였다.결론적으로 이러한 판시 내용은 기존에 대법원 판례에서 설시되어 온 진정명의회복을 위한 이전등기청구권의 법리와 처분금지가처분의 법리 및 실체관계에 부합하는 등기의 법리와 논리적 일관성이 있다고 보여 법적으로 타당하다고 평가된다.

주거나 상가건물에 관하여 수요와 공급의 불균형, 소수에 의한 소유와 다수의 이용수요가 존재하는 부동산시장에서 채권관계인 임대차의 경제적 약자인 임차인의 보호를 도모하지 않을 수 없다. 그리하여 “매매는 임대차를 깨뜨린다”는 로마법상의 임대차가 독일보통법에 이르러 “매매는 임대차를 깨뜨리지 않는다(Kauf bricht nicht Miete)”는 원칙으로 변화되었으며, 우리의 경우에도 일정한 방식에 대항력을 부여하는 등의 방법으로 부동산임차권은 채권이지만 물권화하고 있다. 즉 부동산임차권의 물권화 경향은 주택임대차보호법과 상가건물임대차보호법을 통하여 부동산임차인의 지위를 강화하는 방향으로 진행되어 왔고 현재도 진행 중이다. 과거 우리는 IMF 체제라는 국가적 경제위기 상황을 겪는 과정에서 임대인으로부터 임차보증금을 반환받지 못하는 임차인들의 피해를 경험하였다. 그리하여 이러한 문제점을 시정하여 임차인을 보호하고자 임차인 단독으로 임차권등기를 신청할 수 있게 함으로써 대항력과 우선변제권을 그대로 유지하면서도 자유로이 주거이전을 할 수 있도록 하는 주거용 건물에 관한 임차권등기명령제도가 1999. 1. 21. 법률 제5641호로 주택임대차보호법(상가건물임대차보호법 제정 2001. 12. 29. 법률 제6542호)의 개정을 통하여 도입하여 현재에 이르게 되었다. 그러나 임차권등기명령제도의 이용이 그다지 높지 않았던 것이 작금의 현실인바, 이 글에서는 형식적으로 존재(임차인의 형식적 보호)하고 있는 동 제도를 활성화하고 실효성을 제고하기 위한 개선방향을 제시하고자 한다. 먼저 민법 제621조에 의한 임차권등기가 임대차의 존속기간 중에 신청할 수 있음에 비추어 임차권등기명령은 임대차의 존속기간 중(임대차계약의 성립과 보증금의 지급을 조건으로)에 임차인이 신청할 수 있도록 개선, 둘째 임차권등기를 한 임차인은 임대차가 종료되었음에도 보증금을 돌려받지 못한 경우 그 임차권등기에 기하여 직접 경매신청을 할 수 있도록 입법적으로 개선할 것을 제안한다. 이러한 제안이 임차권등기명령제도의 개선을 통하여 사회적·경제적 약자인 임차인을 보호하기 위한 임대차보호법의 목적을 달성하기를 기대한다.

성범죄에 대한 불안이 확산되면서 정부는 「성범죄자 알림e」등 특단의 조치를 마련하였다. 그러나 현재로서는 성범죄자 검색을 하기 위해 공인인증서, 주민등록번호 기입 등 추가적인 절차를 거쳐야하고, 접속이 되더라도 주어지는 정보는 매우 제한적이라 그 실효성에는 다소 의문이 든다. 「성범죄자 알림e」제도의 근거가 되는 <성폭력범죄의 처벌 등에 관한 특례법>이 개인정보침해방지를 비롯하여 인권보호를 중시한 결과라고 할 수 있다. 미국도 수년 전부터 성범죄자 신상공개와 알림이 서비스가 포함된 SORNA 정책을 시행하고 있다. SORNA 제도는 관련법률 위반시 최고 10년의 징역형이 부과되는 강력한 정책이며, 연방정부를 비롯하여 지방 50개주에서도 모두 시행할 정도로 보편화 되어 있다. 물론, 개인의 사생활 침해의 위헌문제, 예산의 부족, 사법전자시스템의 지역별 편차, 정책효율성에 대한 연구부족 등 개선할 점도 많이 지적받지만 SORNA 제도는 현재 미국 국민들에게 광범위한 지지를 받으며 운영되고 있는 정책 가운데 하나로 평가받는다. 개인정보보호와 성범죄자에 대한 테러 가능성 등 아직 해결해야 할 문제들이 많은 우리나라의 성범죄자 신상공개에 대해서 미국을 비롯한 다른 나라들의 사례는 좋은 선례(先例)가 될 것이며, 그 잘된 점은 받아들여서 더욱 개선하고 잘못한 점은 반면교사(反面敎師)로 삼아 일보해 나아가야 할 것이다. 다른 나라와의 비교를 통해서 우리의 현재 모습을 객관적으로 평가해보고 더 나은 방향을 모색해 보아, 한국의 「성범죄자 알림e」제도가 참신한 성공사례로 자리잡아 국제사회에 모범이 될 것을 기대해 본다.

본 연구는 방사선수술 치료계획 시 영상공동등록을 이용한 자기공명영상의 3차원적 위치에 대하여 구조 평가 및 뇌 정위 수술의 해부학적 기준점으로 사용되어지는 전교련(anterior commissure: AC)과 후교련(poste rior commissure: PC)의 일치성을 평가하여 방사선수술시 영상공동등록의 임상 적용 안전성을 확인하고자 한다. 정위 방사선수술 시행 후 2016년 3월~2017년 3월까지 영상공동등록을 이용한 자기공명영상 추적검 사를 시행한 32명의 영상을 이용하여 3차원 좌표 측정을 통한 후향적 연구를 시행하였다. 전교련의 3차원 좌표 오차는 1.0443 ± 0.5724 ㎜(0.10 ∼ 1.89), 후교련 3차원 좌표 오차는 1.0348 ± 0.5473 ㎜ (0.36 ∼ 2.24) 로 약 1 ㎜의 오차를 나타내었다. 자기공명영상 장비별 전교련과 후교련 좌표의 평균오차는 MR1(3.0 T)의 오차 값이 MR2 (1.5 T)에 비하여 낮게 나타났다. 영상공동등록 기법을 이용한 치료계획 시 자기공명영상의 오차를 최소화하여야 하며, 정확도를 확인하는 과정이 필요한 것으로 생각된다.

In this paper, new filtering method for sensor registration is provided to estimate and correct error of registration parameters in multiple sensor environments. Sensor registration is based on filtering method to estimate registration parameters in multiple sensor environments. Accuracy of sensor registration can increase performance of data fusion method selected. Due to various error sources, the sensor registration has registration errors recognized as multiple objects even though multiple sensors are tracking one object. In order to estimate the error parameter, new nonlinear information filtering method is developed using minimum mean square error estimation. Instead of linearization of nonlinear function like an extended Kalman filter, information estimation through unscented prediction is used. The proposed method enables to reduce estimation error without a computation of the Jacobian matrix in case that measurement dimension is large. A computer simulation is carried out to evaluate the proposed filtering method with an extended Kalman filter.
