선박의 안전한 운항과 해양사고를 사전에 예방하기 위한 방법으로 법제의 체 계적인 정비는 중요한 분야 중의 하나이다. 세월호 사고 및 돌고래호 전복사고에 서 보듯이 미흡한 법체계는 사고의 중요한 원인이 될 수 있음을 시사하고 있다. 우리나라 법은 서구법제를 계수하였을 뿐 아니라 대외의존도가 높고 아직도 선진법제를 수입하는 처지이므로 외국법제의 철저한 연구는 우리나라 법제 정 비하는데 많은 도움이 될 수 있다. 이러한 이유로 선진법제를 가지고 있는 미 국의 사법제도와 해사행정법을 고찰하였다. 미국은 우리나라와 다른 영미법계 의 법체계를 가지고 있지만, 해사행정법은 우리보다 훨씬 긴 역사와 법제의 정 비를 통하여 단일법제로 체계적으로 발전되었다. 이에 이 논문은 우리나라 해사행정법 정비 시에 적용할 수 있도록, 미국 해 사행정법의 고찰을 통하여 우리나라와 다른 점 및 시사점을 찾아 제시하고자 한다.

1. 미국에서는 지난 10여년간 벼를 주식으로 소비하는 아시아계와 라틴 아메리카계 인구의 급격한 증가와 더불어 사회적 건강에 대한 관심의 증대로 인해 벼의 생산과 소비가 점차적으로 증가하고 있다. 2. 미국에서 생산되는 모든 벼의 99 퍼센트가 알칸소, 캘리포니아, 루이지애나, 미시시피, 미주리, 텍사스 등의 6개 주에서 생산되고 있으며, 주로 인디카 장립종을 재배하고 있는 다른 주에 비해 캘리포니아에서는 주로 자포니카 중립종과 단립종을 재배하고 있다. 3. 캘리포니아는 이상적인 기후와 충분한 농업용수의 공급 및 혁신적인 농업 기술의 이용으로 미국에서 가장 높은 9,000 kg/ha이상의 수량을 보이고 있으며, 레이저를 이용한 토지 평탄 시스템의 도입과 관수 시스템의 재순환을 통해 농업용수 이용효율을 지난 30년간 1/3 정도 향상시켰다. 4. 캘리포니아에 벼재배에서 사용되는 종자의 90% 이상은 종자의 순도유지 및 잡초 종자의 유입을 배제하기 위해 등록및 특화된 종자를 사용하고 있으며, 주요 파종 방법은 최아된 종자를 이용한 100% 담수직파에 의존하고 있다. 균형있는 비료의 시비를 위해 질소비료 및 다른 형태의 비료를 토양 및식물의 잎조직분석법의 의해 평가된 비료 요구도에 따라 기비및 추비의 형태로 살포한다. 5. 캘리포니아의 벼담수직파방법은 적미와 다른 잡초를 제어하는 효율적인 재배기술인 반면 담수 환경에서 발생하는 높은농업용수공급 비용, 벼유묘활착이나 초기 생육을 방해하는 수많은 무척추동물종의 출현, 새롭게 출현하는 제초제 저항성 수생잡초 등의 문제를 해결하는 것이 시급한 과제로 남아 있다.

미국 특허침해 소송에 있어서 손해배상액의 산정은 당해 특허권과 관련하여 확립된 실시료가 알려져 있다면 이 확립된 실시료에 따른 손해배상이 허용된다. 재판부는 확립된 실시료를 그대로 손해배상으로 인용하지 않고 이를 사안이 처한 상황에 따라 조정할 수 있는 재량권을 가진다. 만약 확립된 실시료가 알려져 있지 않다면 경상실시료를 산정하기 위해 실시료 기초(Royalty Base)와 실시요율 (Royalty Rate)을 산정한다. 실시료 기초를 산정하기 위해 총 시장가치 포함의 법리(EMVR : Entire Market Value Rule)의 적용을 검토한다. 만약 EMVR의 적용이 긍정되면 침해된 청구항에 기재된 발명을 구성하는 부품들이 실질적으로 수요를 야기하는 경우 전체 제품 혹은 관련 제품들의 매출이 함께 실시료 기초로 될 수 있다. EMVR의 적용이 배제되면 침해된 청구항에 기재된 구성요소들의 매출이 실시료의 기초로 된다. 이후에 실시요율을 결정한다. Uniloc 이전에는 일방적으로 25% 규칙이 적용되어 실시료 기초가 되는 판매 이익에 25%를 곱한 값이 손해배상액의 출발점이 되었다. 그러나 연방순회법원은 이 규칙을 폐기하였고 이제 원고는 해당 산업 분야에서 해당 특허권과 유사한 기술에 대해 어느 정도의 비율을 일반적인, 즉 조지아-퍼시픽 요소의 고려 이전에 통용되는 비율로 할 것인지를 제시해야 하고, 피고는 이를 반대 입증을 통해 논박함으로써 다투게 될 것이다. 이렇게 당해 분야에 일반적인 상황에 맞추어 산출된 경상실시료는 조지아-퍼시픽 요소(GP factor)에 대해 조정함으로써 당해 사안의 특수성이 반영된다.

Developed countries especially United States of America(USA) and Canada hadn't taken any Countervailing Measures(CVM) against China before 2004, because they regarded China as a non-market economy(NME) country, and they thought NME country didn't exist the market price, and it is difficult their to calculate or apply the CVM rate in NME country. But China was invoked by Canada and USA with anti-subsidies investigation since April 2004 still they regarded China as a non-market economy(NME) country. So this paper will mainly analyze the case concerning among China, USA and Canada anti-subsidies investigations against China in the Special Import Measures Act(SIMA) in Canada, United States Countervailing Duty Law(USCVD) in USA, WTO SCM Agreement, and discuss the substantive claims of contracting parties, and find the problems of Chinese subsidy system and Chinese granted' WTO SCM Agreement. Through these cases, Chinese government should adjust its domestic industrial system and subsidy system which will lead to international disputes especially prohibited subsidies.

The purposes of this study are to suggest issues to provide more effective vocational training of inmates by investigation differences in training system between Korea and United States. Current training systems are analysed from the viewpoints of operating body, curriculum and performance measurement. The Bureau of Prisons(BOP) in both counties has long recognized the importance of vocational training as an opportunity for inmates to improve their knowledge and skills and to support successful integration into the society. While American BOP establishes open network with other administrative bodies and professional institutes to ensure quality of training, Korea BOP carries out training independently. In addition, in many cases, American institute starts with needs assessment to provide more suitable training based on the level of inmates and try to measure performance results. According to the Federal Bureau of Justice, There is an inverse relationship between recidivism rates and vocational training. The more training received, the less likely an individual is to be re-arrested or re-imprisoned. To improve quality of vocational training of inmates, Korean BOP needs to cooperate with other government bodies and to establish open training network by including professional institutes. In addition, the benefits of vocational training should be measured and publicized to ensure quality of training and to secure funds for inmate vocational program. Furthermore, various job placement programs should be accompanied to provide smooth transition to the society.

The article is to describe the recent phenomena in the area of American culture and religion such as multiculturalism, popular religion, and civil religion. It is also to evaluate those phenomena from the viewpoint of a missiological perspective. Multiculturalism is defined as all kinds of activities which try to support the various cultures and heritages of ethnic people groups and to overcome ethnocentrism. It is criticized by the conservatives as a political theory which tends to lose its truth, universality, and objectivity. From the missiological point of view, it can be used for developing the multicultural strategies for Christian missions. Popular religion exists outside the official religious institutions and it is related to the folk beliefs such as dream, charisma, trans meditation, channeling, angels, faith healing, and etc. It is criticized by Neoorthodox theologians that it tends to neglect the historical and political aspects of the social phenomena. Even though it is criticized by them as syncretism, it can be helpful for Christian missions to understand people's popular lives. Civil Religion is to respect the virtues and values of American citizens which are traced to Christian values such as temperance, private assets, individual responsibility, and patriotism. It is criticized as an ecumenical Protestant tribalism which tends to be misused by the imperialistic expansionism to destroy the cultures of minority. From the perspective of Christian missions, it should transform its selfishness into the world brotherhood in the 21 st century of the universal and multicultural world.

Purpose - The artificial intelligence industry plays an increasingly significant role in stimulating the development of United States of America’s economy. On account of this background, this paper attempts to explore the impact of artificial intelligence industry on United States of America’s macroeconomy. Research design, data, and methodology - This paper mainly focuses on the impact of artificial intelligence industry on GDP, employment, real income, import, export and foreign direct investment. Furthermore, the Phillips-Perron test and Canonical cointegrating regression will be employed to examine the impact of artificial intelligence industry on United States of America’s macroeconomy with a sample form 2010-Q1 to 2017-Q4. Results - Via the empirical analysis, the results reveal that the artificial intelligence industry has a positive effect on United States of America’s GDP, employment, real income, export and foreign direct investment. Conversely, the artificial intelligence industry has a negative effect on United States of America’s import. Conclusions - In summary, the impact of artificial intelligence industry on United States of America’s macroeconomy is positive and significant in statistics. Therefore, the government of United States of America should put more input into artificial intelligence industry.
