        The defendant consulted an attorney-at-law regarding legal issues which might constitute crimes before commencement of an investigation. The defendant received legal opinion from the counsel by e-mail, which was later seized and presented as evidence of guilt by investigative authority.The court of original instance rejected to accept written legal opinion from the counsel as evidence on the ground of Attorney-Client Privilege. The Supreme Court, however, deemed Attorney-Client Privilege is not rooted in our legal system.I concur with the opinion of the Supreme Court in that we have yet to find traditional or provisional basis for Attorney-Client Privilege. It is premature to acknowledge the concept of Attorney-Client Privilege without in-depth probe. Instead, the majority opinion of the Supreme Court looked to Articles 314 and 149 of the Criminal Procedure Act. Article 314 provides one of the exceptions to hearsay rule, which allows the written statement to be admitted as evidence of guilt without cross-examination against the person who wrote the statement, in case that the person is not available due to illness, unknown whereabouts, etc. as well as that the statement is proved to have been written under especially reliable circumstances. Article 149 confers the right to refuse to testify on the legal counsel regarding professional secrets he obtained in the course of business. The majority opinion of the Supreme Court ruled that Article 314 shall not apply in case that the legal counsel exercises his right to refuse to testify under Article 149. The majority opinion based its rationale on the fact that Article 314 had been revised with a tendency to reinforce oral hearing and direct examination by narrowing the scope of the exceptions to hearsay rule, as well as on the purpose Article 149 seeks to achieve. On the contrary, the dissenting opinion of the Supreme Court deemed that Article 314 shall apply in case of exercise of right for refusal of witness under Article 149. The dissenting opinion pointed out that Article 314 serves to discover the truth by allowing hearsay evidence under exceptional circumstances. According to the dissenting opinion, there is no difference between situation where the witness is unable to appear because of illness, etc. and situation where the witness exercises his right to refuse to testify when it comes to applying Article 314.I concur with the majority opinion of the Supreme Court. The witness who refuses to testify may or may not have lawful grounds to refuse. If he has sufficient lawful grounds, we should pay attention to the purpose of the Article which confers the right to refuse to testify. In this context, it stands to reason to declare that Article 314 shall not apply in case that the legal counsel exercises his right to refuse to testify under Article 149. By denying the admissibility of legal opinion as evidence of guilt, written by the legal counsel who lawfully exercises the right to refuse to testify, we can further the right to refuse to testify as well as the principle of oral hearing and direct examination.

        The association between human parvovirus B19 and aplastic crisis in patients with hemolytic anemia, such as sickle-cell anemia and hereditary spherocytosis, has been well described. However, most cases of parvovirus induced-aplastic crisis in patients with hereditary spherocytosis have been reported in children or adolescents. We report on a 31-year-old female with pancytopenia who was diagnosed with aplastic crisis caused by parvovirus B19 infection in hereditary spherocytosis. It should be kept in mind that hereditary spherocytosis may initially present with aplastic crisis induced by parvovirus B19 infection in adults

        To investigate the possibility of sustainable agriculture in no-tillage pepper this study was carried out in vinyl greenhouse with organic cultivation having no pesticide certification. 1. Growth and yield in pepper cultivation General growth in pepper was suppressed with decreasing hill spacing, primary branch length, and stem width. Fruit diameter and fruit weight in no-tillage increased significantly, and yield of pepper increased by 10% compared with conventional tillage. From results organic cultivation in no-tillage improved a quality of pepper compared with conventional tillage. 2. Production cost of conventional tillage and no-tillage Production cost of conventional tillage and no-tillage was not different in seed cost, inorganic fertilizer cost, pesticide cost, repair cost, light agricultural tool cost, agriculture facilities depreciation cost and so on. Intermediary goods cost in no-tillage was decreased by 11% for organic fertilizer cost, light and heat expenses and power rate, heavy agricultural tool cost, and repairing expenses compare with conventional tillage. Employment effort cost and work effort cost were decreased, and farm income and farm income rate were increased by 11% and 5%, respectively, in no-tillage. In this work, yield and gross income were increased by 10% and 25%, respectively, in no-tillage. Therefore material cost, intermediary goods cost, working expensive, farm income, and income rate were increased by 34%, 3%, 2%, 52% and 22%, respectively.

        횡방향으로 프리스트레스가 도입된 장지간 PSC 바닥판의 정적 거동을 예측하기 위한 유한요소해석 모델을 구성하고, 해석결과를 선행연구에 의한 실험결과와 비교하였다. 유한요소해석에 의하여 서로 다른 콘크리트 강도와 프리스트레스 크기를 변수로 갖는 각각의 실험체에 대한 하중-처짐 관계 곡선을 비교적 근접하게 추정할 수 있었다. 또한, 변형률 분포와 변수에 따른 극한강도 변화로부터 펀칭전단에 의한 파괴형태와 손상범위 등을 간접적으로 예측할 수 있었다. 이 연구에서 활용된 유한요소해석 모델은 펀칭전단파괴에 의한 펀칭콘의 분리를 사실적으로 재현하기 위한 목적이 아니며, 실험연구를 위한 보조적 수단으로서 정적거동예측과 실험결과의 보완 등에 효과적으로 활용될 수 있을 것으로 판단된다.

        컨테이너 선사들은 세계경제의 불황과 고유가가 지속되고 있는 상황에서 선박운영비용을 낮추기 위한 다각적인 노력들을 전개하고 있다. 이러한 상황에서, Grand Alliance는 극동 북미서안 서비스인 CCX와 극동 북미동안 서비스인 NCE에 서비스별 선박추가 투입대신에 Dedicated Feeder 투입을 하기로 결정하였다. 즉, 기간항로의 선박이 북중국항만에 기항하지 않고 환적항인 부산항에서 Feeder선을 통하여 환적 운송하게 된다. 본 연구에서는 전용피더 서비스 도입을 통한 환적의 경제성 효과를 확인하기 위하여 Grand Alliance 컨테이너 서비스의 실제 운영 자료에 대해 분석하였다. 이와 같은 전략을 통해 Grand Alliance의 'NCE, 'CCX'항로는 기간항로에 투입되는 선박의 감속운항이 가능하게 되어 선박 운영비의 절감 효과를 보이고 있다.

        이 글은 무엇보다 역사적 맥락 속에 케이지를 놓고 보려는 시도이다. 그 밑바탕에 놓인 역 사적 관심사는 “삼중의 변증법적 대립”(칼리니스쿠 1994, xviii)의 전개로 서술되는 미적 모 더니티의 서사와 케이지의 관계이다. 특히 주목하는 것은 “역사적 아방가르드”(뷔르거)와 네 오아방가르드 사이의 이행기, 즉 케이지의 《4분 33초》(1952)에서 분수령을 이루는 시기이 다. 이 무렵 케이지의 작업에서 우리는 자기부정을 함축하는 아방가르드의 딜레마를 해소할 또 다른 논리를 찾을 수 있기 때문이다. 이로써 운명(殞命)을 운명(運命)으로 타고난 아방가 르드를 살리는 법을 케이지의 말⋅글⋅음악 가운데서 찾으려는 것이 이 글의 목표이다. 이 는 케이지의 후기 작업을 이해하는 데 결정적인 ‘우연성 이전 시기’에 대한 재평가와 연결될 뿐만 아니라 그의 텍스트 실천과 음악 실천 사이의 상호영향까지 확인할 좋은 기회를 마련해 줄 것이다. 역사적 아방가르드의 실패가 자신의예술적 성공에 놓여 있는 역설을 어떻게 이해해야 하 는가? 문제는 자율성이다. 그것은 철회되어야 할 부르주아 이데올로기인가, 계속 유지되고 존중받아야 할 역사적 성취인가? 이것 아니면 저것인가? 양자택일은 어떤 식으로든 부정성 에 헌신했으나 정작 그 자신이 기존의 긍정적 질서에 기생하거나 결탁하게 되는 일을 피할 수 없다. 그 이유는 첫째 예술의 자율성은 사회와 ‘매개’된 상대적 자율성이기 때문이다. 둘 째, 미적 모더니티 자체에 내재한 모순으로 인해 자율성과 타율성은 끊임없이 대립하면서 자 신과 정반대되는 것으로 끊임없이 전도되기 때문이다. 이와 같은 변증법적 시각에서 볼 때 아방가르드는 예술의 자율성에 반작용하는 한 모더니즘의 일부이기도 하고 또 예술제도를 문제시하는 한 모더니즘과의 단절이기도 하다. 양자택일의 진퇴양난에 빠지지 않는 길은 바 로 이 양면성의 논리를 깨닫는 것부터 시작할 수 있을 것이다.

        This work was studied the effects of spore density and infection of arbuscular mycorrhizal fungi (AMF) for no-tillage organic cultivation of pepper with wintering green manure crops cultivation in greenhouse field. Spore density of arbuscular mycorrhizal fungi (AMF) in green manure crops was 189 spores/30g fresh soils in control including alive spore (82 spores). Spore density of AMF in all green manure crops was totally 196~226 spores/30g fresh soil and alive spore was 84~112 spores/30g fresh soil. Spore density of AMF in soils of Pepper crop was range of 48.0~56.7 spores/30g fresh soils after cultivation of green manure crops. Infec-tion structure of AMF was not significantly difference in soils of green manure crops and Pepper crop after cultivation of green manure crops. Infection rate of AMF in roots of green crops was low level by 2.8% in giant chickweed, 7.4% in rye, 9.3% in hairy vetch. Infection rate of AMF in roots of barley was the highest level by 20.3%. Infection rate of AMF in roots of Pepper crop was range of 5.2~7.2% after cultivation of green manure crops Also, infection rate of AMF in roots of Pepper crop was 8.1% after the harvest of barley. Infection structure of AMF in barley very well consisted of network with internal hyphae, while hairy vetch and rye tended to no network. There was not a significant relationship between spore density in soils and infection rate of AMF in rhizosphere of Pepper.

        This work studied the growth and yield of green crops, changes of mineral composition in greenhouse soil and green crops, and infection with wintering green crops cultivation in greenhouse field. At 74 days after seeding of wintering green crops, dry matter was 710㎏/10a in rye, 530㎏/10a in barley, 230㎏/10a in hairy vetch, and 240㎏/10a in bean or weeds. Total nitrogen content in green crops was 4.5% in pea and hairy vetch, and 3~4% in barley and rye. P₂O₅, CaO, and MgO contents in all green crops were about 1.0%, and K₂O content was the highest level by 4~5% among macro elements. Total nitrogen fixing content in shoot green crops uptaken from soil was 22.1㎏/10a in rye, 20.6㎏/10a in barley, 10.6㎏/10a in hairy vetch, and 9.6㎏/10a in pea and giant chickweed. P₂O₅ fixing content in shoot green crops uptaken from soil was 8.4㎏/10a in rye, 6.3㎏/10a in barley, and 2.3 ㎏/10a in hairy vetch and pea. K₂O fixing content in shoot green crops uptaken from soil was 28㎏/10a in rye, 24.7㎏/10a in barley, and 11㎏/10a in hairy vetch and pea. CaO fixing content in shoot green crops uptaken from soil was 2~3㎏/ 10a in all green crops, and MgO fixing content was 1.7~2.6㎏/10a in all green crops. Pepper growth in no-tillage was not a significant difference at all green manure crops. The number of fruit and fruit weight were higher in control, pea, hairy vetch and harvest barley than rye and barley. Soil mineral compositions in wintering green crops increased at pH, organic matter, CEC compared with control. Soil chemical compositions were stable level at green crops cultivation according as decreases of EC, available phosphoric acid, Ca, and Mg contents. After no-tillage by green manure crops, pH in soils was higher in green manure crops than control. EC content in soils was lower in green manure crops than control, and was remarkably low level in barley harvest. Organic matter content in soils increased in hairy vetch and barley green manure but decreased by 35% in barley harvest. Total nitrogen and avaliable P₂O₄ content in soils remarkably increased but was not a significant difference at all green manure crops. Cation (K, Ca, and Mg) content in soils decreased by 15~20% in K, 2~11% in Ca, and 3~6% in Mg at rye, barley and pea compared with control.

        To establish the organic cultivation of pepper using green manure crops, this work studied the growth characteristics and yield of green manure crops, mineral composition of green manure crops, mineral uptake in shoots of green manure crops, chemical composition in soil of green manure crops, and the growth characteristics and yield of pepper in vinyl house. Shoot dry weight of green manure crops was higher level in Sorghum bicolor and Sorghum than in Crotalaria juncea and Glycine max. Also, the roots were spread deeply into soil in Sorghum bicolor and Sorghum. Density of root-knot nematodes in rhizosphere of green manure crops was significantly more decrease in Crotalaria juncea and Sorghum than in Glycine max and Sorghum bicolor. Total nitrogen and CaO content of green manure crops was significantly higher in Crotalaria juncea and Glycine max than in Sorghum bicolor and Sorghum. K₂O content was significantly higher in Sorghum bicolor and Sorghum than in Crotalaria juncea and Glycine max. MgO content was not significant difference at all green manure crops. Cations content ratio of K₂O : CaO : MgO was 3.4 : 1.4 : 1. Total nitrogen uptake in shoots of green manure crops was high level in Glycine max, Sorghum bicolor and Sorghum compared with in Crotalaria juncea. K₂O and MgO uptake was significantly higher in Sorghum bicolor and Sorghum than in Crotalaria juncea and Glycine max. Value of pH in soil of green manure crops was more increase in Crotalaria juncea and Glycine max than in Sorghum bicolor, Sorghum and control, but after cultivation of pepper pH in soil was recovered with initial soil pH before seeding of green manure crops. EC value in control, green manure crops, and pepper cultivation decreased by 44%, 15~18%, and 38~61% level, respectively, compared with initial soil of green manure crops treatment. K content in soil of control, Crotalaria juncea and Glycine max cultivation was increased by 14%, but the K content in soil of Sorghum bicolor and Sorghum decreased by 24~38%. Cation exchange capacity (CEC) in soil of Crotalaria juncea and Sorghum bicolor decreased by 11%, but CEC in soil of Glycine max, Sorghum and control increased by 11%. Harvest fruit yield was higher in Crotalaria juncea, Glycine max, and Sorghum bicolor cultivation than in control and Sorghum.

        To investigate a comparison of rice yield and quality by a utilization of green crops using barley and hairyvetch, this study was carried out in rice (Oryza sativa L.) organic cultivation field. Convention barley harvest (CBH), Green barley crop (GBC), Green barley+Green Hairyvetch crop (GB+HVC), and Non-Green crop (NGC) were treated in rice cultivation field. The results obtained as following: 1) Culm length and pancile length in Convention barley harvest (CBH) cultivation were longer than organic cultivation but were not significant difference in all treatments. Yields of milled rice in Green barley crop (GBC) and Green barley+Green Hairyvetch crop (GB+HVC) were by 90.3% and 95.9%, respectively. 2) Protein contents in Green barley crop (GBC) and Green barley+Green Hairyvetch crop (GB+HVC) were by 5.7% lower than 6.6% in Convention barley harvest (CBH) cultivation. Amylose contents in all treatment were similar as range 18.8% to 19.1%. Whiteness contents in Green barley crop (GBC) and Green barley+Green Hairyvetch crop (GB+HVC) were slightly higher by 38.9% and 39.1%, respectively, than 37.7% in Convention barley harvest (CBH) cultivation. 3) Palatability values in Barley harvest (BH) and Non-Green crop (NGC) were slightly higher by 82.0 and 83.8, respectively, than 77.6 in Convention barley harvest (CBH) cultivation. 4) Head rice in Non-Green crop (NGC) was 95.5%, while that of Convention barley harvest (CBH), Green barley crop (GBC), and Green barley+Green Hairyvetch crop (GB+HVC) were slightly low as range 93.8% to 94.2%. White core and belly rice in Convention barley harvest (CBH) cultivation was the highest level by 1.7%. 5) Leaf blast, neck blast, sheath blight, rice stem maggot, rice leaf roller, rice leaf-tier, and green rice leafhopper were occurred lightly in rice field.

        에폭시 수지는 접착성, 물리적 강도, 전기적특성이 우수하여 전기적 절연재료로 널리 사용하고 있다. 그러나 설치장소 및 운전 상태를 고려한 장기수명 및 신뢰도 향상을 위해 전기적, 열적 특성변화의 열화연구가 절실히 요구된다. 본 연구에서는 부스닥트용 에폭시분체도료의 가속열화를 통해 다양한 상용 에폭시 절연재료의 전기적, 기계적 특성을 비교 분석하였으며, 특히 Class F 급과 Class B급의 에폭시 절연재료의 성능을 상호 비교 하였다. 이에 Class F급 2종 중 1종의 시편155도 이상의 온도에서 절연성능이 보장되었으며, 기계적 밴딩 테스트의 경우 Class B급의 경우가 우수한 성능을 확보하였다.

        The human-following is one of the significant procedure in human-friendly navigation of mobile robots. There are many approaches of human-following technology. Many approaches have adopted various multiple sensors such as vision system and Laser Range Finder (LRF). In this paper, we propose detection and tracking approaches for human legs by the use of a single LRF. We extract four simple attributes of human legs. To define the boundary of extracted attributes mathematically, we used a Support Vector Data Description (SVDD) scheme. We establish an efficient leg-tracking scheme by exploiting a human walking model to achieve robust tracking under occlusions. The proposed approaches were successfully verified through various experiments.

        The trailer system offers efficiency of transportation capability. However, it is difficult to control the backward motion. It is an open loop unstable problem. To solve this problem, we are proposed the driver assistance system. Driver assistance system assists a driver to control the backward motion of trailer system as if forward motion. A driver only secure the rear view of last passive trailer, and select the control input to drive the last passive trailer. The driver assistance system converts the control input of the driver into velocity and steering angle of the vehicle using the inverse kinematics. It is possible by electronic control input devices and the rear view camera. Effectiveness of driving assistance system is verified by the simulation and the experiments.

        For indoor mobile robots, the performance of autonomous navigation is affected by a variety of factors. In this paper, we focus on the characteristics of indoor absolute positioning systems. Two commercially available sensor systems are experimentally tested under various conditions. Mobile robot navigation experiments were carried out, and the results show that resultant performance of navigation is highly dependent upon the characteristics of positioning systems. The limitations and characteristics of positioning systems are analyzed from both quantitative and qualitative point of view. On the basis of the analysis, the relationship between the positioning system characteristics and the controller design are presented.

        To investigate a comparison of rice yield and quality between organic and conventional cultivation, study for occurrence of rice diseases carried out in rice (Oryza sativa L.) field of Noahn and Bannam region. The results obtained as following: 1) Bactericide and insecticide were applied twice and four times at Noahn and Bannam region in conventional cultivation (C.C) of rice field, respectively, it was applied twice at two region in organic cultivation (O.C). Rice strip virus, leaf blast, neck blast, sheath blight, bacterial leaf blight, rice water weevil, rice leaf folder, and plant hoppers were occurred mainly in rice field. Leaf blast, neck blast, and rice leaf folder were occurred highly at O.C compared with C.C. 2) Growth level of rice in clum and panicle length was lower at O.C than C.C. Number of panicles per hill was by 0.6 higher at O.C than C.C. Number of panicles per hill was by 0.6 higher at O.C than C.C in Noahn region. Number of spikelets per panicle, grain filling ratio, brown/rough rice ratio, and weight of 1,000 grains was lower at O.C than C.C. Number of panicles per hill was by 0.8 lower at O.C than C.C in Bannam region. Number of spikelets per panicle and grain filling ratio was higher at O.C than C.C while brown/rough rice ratio was lower at O.C. Total yield percentage of rice in O.C was level of 84% at Noahn region and 94% at Bannam region compared with C.C. 3) Head rice percentage was lower at in O.C than C.C at two region. Protein and palatability (Toyo value) were lower at O.C than C.C in Bannam region causing occurrence of neck blast and rice leaf folder by oversupply of nitrogen fertilizer. Protein, whiteness, and palatability (Toyo value) were adequate level at O.C in Noahn region by lower nitrogen fertilizer.

        In case of injury during a sports game, to punish the offender without exception might lead to withering of sports activities, whereas to get the offender exempted on the mere ground that injury occurred in the course of a sports game might cause plummeting of either legal stability or law-abiding spirit. So, it is vital to draw a bright line between criminal liability and moral obligation with regard to injury during a sports game. Scholars suggest the theory of victim's consent, the theory of tolerated danger, the theory of social reasonableness or the theory of non-legal issue as sources of justification to limit criminal liability. Each theory has its own merits and demerits. In order to punish the offender who inflicted injury by negligence during a sports game, general requirements of 'infliction of injury by negligence' occurrence of injury, ― causal relationship between offender's act and injury, breach of objective duty of care, etc.― should be met. Objective duty of care can be derived from statutes, past practices, social norm, logic, empirical rule or court decisions. In a sports game however, rules of the game may be the most important source of objective duty of care. As rules of the game enumerate matters that require attention in the entire course of a sports game, player's act against these rules can be treated breach of objective duty of care. It is excessive to deem all of the acts against rules of the game, including minor ones, breach of objective duty of care in light of the way a sports game is played as well as autonomy enjoyed in the sports field. Unless injury resulted from the act that had gone against rules of the game beyond reasonable expectation, the offender should not be found to breach objective duty of care. Rules of the game differ from type to type. In so-called type of rivalry sports games, rules of the game, while allowing the player or the team to make physical attack on the opponent to some extent, focus on diminishing or eliminating the possibility of injury. In so-called type of individual sports games, rules of the game prohibit dangerous act and call the attention of the players to avoid injury. To sum up, breach of rules may be treated more harshly and less flexibly in type of individual sports games than in type of rivalry sports games. The judgment under review in this paper has something to do with golf game, which belongs to type of individual sports games. The judgment thinks highly of rules of the game as source of objective duty of care. It also denies criminal liability in case of injury resulting from minor breach of rules of the game, which would reasonably be expected. On the face of it, the judgment seems to adopt the theory of social reasonableness. However, considering the courts usually dub social rule social reasonableness, the view taken by the judgment might be different from the theory of social reasonableness advocated by the scholars. The theory of social reasonableness relates to negation of applicability of criminal statute, whereas the view taken by the judgment might relate to negation of illegality. In such type of individual sports games as golf, the players enjoy game without physical contact with other participants, expecting reciprocal care to avoid unwanted injury. So it is somewhat improper to adopt the theory of victim's consent as source of justification to limit criminal liability in golf game. The judgment, in similar context, seems to have dismissed defense of 'victim's consent' raised by the accused. Even in case that the offender is held liable for infliction of injury by negligence with regard to injury during a sports game, the possibility to get relief is still open. If the offender reaches an agreement with the victim, he or she is able to avoid criminal punishment according to Art. 266 Para. 2 of the Penal Code.
