        UN해양법협약에 따르면 연안국을 자국의 법령을 위반했다고 믿을 만한 충분한 이유가 있는 경우 외국선박을 공해상에까지 추적하여 나포할 수 있는 추적권을 행사할 수 있다. 추적권은 공해상의 선박에 대해서는 기국이 관할권을 갖는다는 기국주의 원칙에 대한 중요한 예외의 하나이다. 본 논문은 국제관습법에 의해 형성되었고, UN해양법협약에 의해 인정되고 있는 해상에서의 추적권 행사시 무력사용의 한계에 관하여 사이가호 및 불심선 사건을 중심으로 고찰하였다. 추적권 행사시 가능한 한 무력의 사용은 회피되어야 할 것이며, 무력의 사용을 회피할 수 없다면 그 상황에서 합리적이고 필요한 정도를 초과해서는 안 될 것이다.

        가압경수로형 원자력발전소의 운영과정에서 발생된 폐수지내 및 의 분포특성을 조사하였다. 표준용액을 사용한 의 회수율 측정결과, 사용한 산의 종류에 관계없이, 3 N-HCl , 주입한 농도 범위에서 의 회수율을 나타내었다. 같은 장치를 사용하여 HTO 표준용액 증류에 의한 의 회수율은 주입한 농도 범위에서 이었다. 습식산화-산용출법에 의한 폐수지의 및 동시분리시, 를 사용했을 때 다른 감마핵종에 의한 방해가 없었으며, 포집액이 섬광제와 잘 혼합되었다. 그러나 3 N-HCl을 사용했을 때 포집용액에서 및 등의 감마핵종이 검출되었다. 또한 Sample Oxidizer에 의한 포집용액에서도 및 등이 검출되었으며, 포집용액에서는 이 검출되었다. 폐수지의 총 함량중 약 70% 이상이 무기 탄소로 확인되었다. 30개 폐수지 시료중 8개 고방사능 폐수지의 및 의 평균농도는 각각 이었으며 22개 저방사능폐수지에서는 각각 이 검출되었다. 고방사능 폐수지의 평균 비는 28로 저방사능 폐수지의 0.70에 비해 높게 나타났으며, 및 의 농도는 서로 비례하는 경향을 보였다.

        This study was conducted to develop a system and an control algorithm for control the environment of a plant factory. The greenhouse control system for environmental control was largely composed of a computer and a PLC. The screen of control program was composed of a greenhouse figure which was included machinery and equipments for greenhouse, the graph of environmental factors of inside greenhouse and the image of greenhouse. In order to reduce temperature change, the operation time of ventilation window was changed by 3 stage according to difference between a target and present temperature. When is heating, a temperature variation was shown to be 16.7±0.8℃. When is cooling, a temperature variation was shown to be 23.1±0.6℃. When is humidifing, a humidity variation was shown to be 39.3±1.6℃ %RH. An environmental control system and a control algorithm were proved that it was shown a good performance in a control accuracy. So a computer control system should be adapted to a control system of a greenhouse and a plant factory.

        최근 세계의 많은 항구도시들은 시대 흐름에 따른 산업구조의 변화 등으로 인해 기존의 항만공간에 대한 의의가 보다 복합적으로 변화하고 있다. 그러나 국내 항만공간의 경우 이러한 시대흐름에 발빠르게 호응하지 못하고 있으며, 일부 시행되고 있는 개발은 대규모 항만 공간에만 집중이 되고 있는 실정이다. 또한 항만공간과 항만배후지역간의 공간적, 심리적 단절감이 강해 전체적으로 조화를 이룬 항만공간의 계획이 불가능한 실정이다. 본 연구에서는 국내의 항만공간은 항만공간만의 고유한 장소성과 특이성을 충분히 반영하지 못하고, 배후지역과 의 조화를 이룬 계획이 시행되는데 많은 한계점이 있다고 판단하였다. 이에 FBCs를 활용하여 항만배후지역과 항만지역의 이질적 공간 간 연 계성을 강화하여 항만공간 전체가 조화를 이루는 도시계획적 접근방향성을 제시하고자 하였다. FBCs란, 해당 공간만의 특성 즉, 장소성과 고 유성을 반영하고, 보행자 중심의 공간 계획, 그에 따른 안전성 확보, 공공공간의 활용 등을 위해 미국에서 제시되고, 실행되고 있는 제도적 장 치이며, 아직까지 국내에는 도입되어 있지 않다.

        Under the Anglo-American law, there are two types of causation: ‘factual causation’ and ‘legal causation’. The test for factual causation is a but-for test or sine qua non test. However, there is no dominant test for legal causation. The reason for that is legal causation is a flexible analysis involving a variety of policy considerations. The structure of the theory of causation in Korean and German law is almost the same as in Anglo-American law. Under Korean and German law, causation has two aspects: ‘natural causation’, and ‘objective imputation’. Natural causation is a matter of fact and determined by the sine qua non test as in the Anglo-Americna law. The issue of objective imputation cannot be answered by a single test because it is a matter of policy or evaluation. The test for legal causation and objective imputation is determined after evaluating various policy considerations. The author of this article compares a Korean Supreme Court case and a US Supreme Court Case concerning legal causation. The US case is a very famous one commonly known as the Palsgraf case. In Palsgraf, the Plaintiff was standing on a railroad platform purchasing a ticket, when a train stopped and two men ran forward to catch it. One of the men nearly fell, and two railroad employees attempted to help him. In the process, a package containing fireworks fell and the contents exploded. As a result of the explosion some scales at the other end of the platform fell and struck the Plaintiff. Plaintiff sued and a jury found in her favor. The Appellate Division affirmed this decision. However, the Court of Appeals, the highest court in New York, reversed and dismissed Palsgraf’s complaint, deciding that the relationship of the guard’s action to Palsgraf’s injury was too remote to make the defendant liable. The dissenting opinion in Palsgraf’s viewed the case as a matter of proximate cause. The dissent takes the view that, as a matter of law, it could not be determined that the Defendant’s actions were not the proximate cause of the Plaintiff’s injuries. The structure of a Korean Supreme Court case is very similar to that of the US case. In the Korean Case, the Defendant’s car was struck by a train at a railroad crossing due to Defendant’s negligence. The Plaintiff, who was waiting for a train’s passing at the railroad crossing, fell and was injured. The Plaintiff was not hit by the Defendant’s car, but he was injured because of the impact of the crash. The Korean Supreme Court recognized the causation between the Defendant’s negligence and Plaintiff’s injury. However, the author of this article argues that this case is a matter of legal causation and Defendant’s action was not the proximate cause of the Plaintiff’s injury. This argument is almost same as the one put forward by the dissent in the US case. The tests for legal causation or objective imputation vary from view points to view points. Thus, it is important to develop certain tests for legal causation or objective imputation that can be applied generally. For that to occur, we must analyze scholarly opinions and court results from both German law and Anglo-American law.

        This study was attempted to evaluate the change of microbial community in inoculums, lag, and stationary phase using the community level physiological profiles (CLPP) base on C-substrate utilization. It was to ascertain the characterizing microbial community over time in the enrichment step of microbial fuel cells. Microbial fuel cell is a device that converts chemical energy to electricity with aid of the catalytic reaction of microorganisms using C-substrate included wastewater. Microbial fuel cells enriched by a mixture of anaerobic digestive sludge of the sewage treatment plant and livestock wastewater were used. The current after enrichment was generated about 0.84 ± 0.06 mA. Microbial community in inoculums, lag and stationary phase used amine group, phosphorylated chemical group, and carboxylic acid group (some exclusion). However, phenolic compound did not use by microorganisms in lag and stationary phase. It means that there are not the microorganisms capable of decompose the phenol in microbial fuel cell enriched by livestock wastewater. In case of substrates of amino acid and carbohydrates group, these C-substrates were only used by microorganisms in the stationary phase. It may be that electrochemically active microorganisms (EAM) which we want to know should utilize the better these C-substrates than that of lag phase. This study showed that the electrochemically active bacteria that can be distinguished by electron changes of C-substrate utilization over time could be separated.

        In recent years, environmental pollution by pharmaceuticals and personal care products (PPCPs) in the aquatic environment is of great concern worldwide. Recent studies have been reported to occur in a variety of environmental organisms such as surface, drinking and ground water, soils, sediments and hospitals. The purpose of this study was to evaluate the occurrence and environmental behavior of fourteen human PPCPs in surface waters of Mankyung River in South Korea. We were conducted to field survey for water quality and PPCPs analysis at November, 2006. PPCPs were analyzed by liquid chromatograph coupled with a tandem mass spectrometer (HPLC-MS/MS). The concentration of COD was measured to be 2.37~19.71 mg/L, which was belong to 4~5 grade in water quality criteria of lake. Station 2 that there is no pollution in upper stream, was appeared to lower concentration. The concentration of TN and TP, that is cause matter of eutrophication, were found to be 7.78~35.42 mg/L and 0.08~0.95 mg/L, respectively, which were exceeding 5 grade in Lake water quality criteria. The 11 kind of PPCPs compounds except levofloxacin and triclosan were detected to Mankyung river. PPCPs concentrations of STP(Sewer Treatment Plant) effluents and aquatic environment in Mankyung river have been detected in the range from dozens of ng/L to hundreds of μg/L that by order of atenolol, carbamazepine, propranolol, Ibuprofen, erythromycin, ifenprodil, clarithromycin, mefenamic acid, fluconazole, indomethacin, disopyramide. PPCPs concentration of Station 1 and 5, which was influenced by Jeonju STP and Wanju STP, was detected high values. Station 2 that there is no pollution, showed lower values. Station 3 which joined Gosan stream and Jeonju stream and station 4 which influenced by stock wastewater was detected to low values.
