It was legislated in Korea that the small-sized enterprise with fewer than 50 employees should appoint at least one managing officer in order to improve safety and health of the employees since 2016. Study on the effectiveness of this legislation is hardly found, however. This study tried to evaluate effectiveness of the regulations for appointing the safety and health management officer in small-sized manufacturing companies and make suggestions to improve it. It was done by pairwise comparison between the level of safety and health achievement of 52 companies before and after the legislation. A scorecard system and questionnaires were devised for assessing the level of safety and health achievement and surveying awareness and practice of the regulation in the field. Results from quantitative and qualitative analyses performed in the study confirm that the safety and health achievement score has increased significantly after appointing the managing officer. It is also revealed that the lack of expertise and motivation of the appointed officer would yield pointless outcomes. Recommendations to make it better the effectiveness of the regulation are: to administrate requirements more strictly to be appointed as a safety and health management officer, to revise the curriculum to train the expertise of the appointed officers, and to expand financial support of the government to settle the safety and health management system.

우리나라는 선박의 안전운항과 해사안전 증진을 위하여 해사안전법을 통해 3가지의 수역 지정 및 관리 제도를 제정․운영하고 있다. 우리나라의 수역 지정 및 관리제도의 목적은 교통량이 집중되거나, 특별한 주의가 필요한 해역에 특정 항로 혹은 항법을 지정하여, 선박 충돌 등 사고의 위험성을 저감하고 대형 해양사고를 미연에 방지하기 위함이다. 그러나 현재 우리 해사안전법상 3가 지 수역 및 항로지정방식은 법률, 시행령, 시행규칙, 고시 등에 산재하여 규정 되어 있어, 선박운항자가 해역별로 특정 항법을 숙지하기까지 상당한 시간이 요구되어진다. 또한 특정항법이 적용되는 지정항로에서 적용항법이 복수로 규 정되어져 있는 지정고시의 경우, 수범자인 선박운항자가 항법을 적용하는데 있어 자신이 규율받는 항법이 무엇인지 명확히 이해하지 못하는 상황이 발생할 수 있다. 이와 더불어, 국제해상충돌예방규칙(이하, ‘국제규칙’이라 한다)의 해상 교통분리제도를 수용한 우리나라 해사안전법의 통항분리제도가 제․개정 작업 중 일부 구문이 삭제되어 결과적으로 국제규칙과 상이한 해석결과를 가지게 되는 문제점이 발생하고 있다. 이러한 문제점들은 수역 및 항로 관리제도의 본래 취지인 해양사고 방지에 직접적인 영향을 미치는 문제들로 수역의 통합관리와 조문 개정을 통해 근시일 내 개선되어져야 할 것으로 판단된다. 또한, 이러한 문제점들은 우리나라 헌법원칙인 명확성의 원칙에도 어긋나며, 수범자가 규범을 오인해서 법규를 적용하는 착오가 발생할 수 있고, 이는 사실에 입각해 생성되는 과태료 부과에 있어, 수범자가 고의 및 과실의 부재를 소명해야 하는 행정력 낭비로 이어질 수도 있으므로, 이러한 문제점을 고려하여 현행 항로지 정방식 및 관리제도에 관한 개선이 이루어져야 한다.

본 연구는 우리나라 컨테이너터미널 안전관리제도에 관한 효과적인 개선 방 안을 제시하여 컨테이너터미널 내 작업자가 보다 안전한 환경에서 작업할 수 있는 여건을 조성하여 부산항이 선진 안전항만으로 도약하기 위한 단초를 제공 하는데 그 목적이 있다. 우리나라의 경우, 효과적인 재발방지 대책과 대안 마련 의 기초가 되는 재해 통계 수집에서부터 많은 문제점이 있었으며, 관련법과 제도 등의 미비로 운영회사와 정부기관에서는 체계적인 항만 안전관리 조직과 시스템을 갖추지 못하고 있는 것으로 나타나 이에 대한 개선이 필요한 것으로 보 인다. 컨테이너터미널 내 사고원인의 대부분은 작업자의 안전 불감증으로 인해 발생된다. 하지만 이제는 이러한 안전의식 부족이라는 결론만 내고 그칠 것이 아니라 작업자의 안전의식이 장기적이고 지속적으로 현장에 작용하기 힘든 요 인들에는 어떠한 것이 있는지 살펴보고 이를 제어할 수 있는 강력한 법·제도 등을 보완한 다음, 그 틀 안에서 조직적이고 체계적인 예방 활동들이 이루어져 야 할 필요성이 있다.

세월호 사고 이후 내항선 안전관리분야에서의 가장 큰 변화는 해사안전감독관 제도의 도입이라 할 수 있다. 이 제도의 도입으로 내항여객선의 안전관리는 운항관리자와 해양경찰로부터 운항관리자와 새로이 도입된 해사안전감독관으로 변경되었다. 또한 내항화물선의 안전관리도 선박검사관으로부터 해사안전감독관과 선박검사관에 의한 안전관리의 체계로 전환되었다. 그러나 새로이 도입된 이 제도는 전문임기제에 따른 감독관의 신분상의 불안으로 인한 업무연속성 부족, 감독대상의 현실을 무시한 감독관의 자격요건 설정, 내항화물선에 대한 심사와 지도·감독기관의 분리로 인한 업무혼선 및 감항성 확보를 위한 항행정지 개선명령 분야의 한계 등에 대한 문제점이 여전히 남아 있다. 내항선의 안전관리를 보다 강화하기 위해서는 내항선 안전관리 업무를 실질적으로 수행하고 있는 해사안전 감독관 제도의 정착이 필수적이라 아니할 수 없다. 따라서 이러한 문제점을 개선하기 위해서는, 내항화물선에 대해서 통합된 단일기관에 의한 체계적인 안전관리가 이루어져야 하며, 전문임기제인 감독관의 신분상의 제약에 대한 개선이 동시에 이루어져야 한다. 또한 항행정지 개선명령의 분야를 확대하고, 선장·기관장 및 국제선급의 검사원 경험자 위주로 감독관의 자격을 강화해서 보다 체계적이고 실질적인 내항선의 안전관리가 되도록 해야 할 것이다.

The Occupational Safety and Health Act stipulates that the safety managers must be distinguished and the safety managers perform the task of conducting industrial accidents by balancing the duties and regulations specified in the Act on Special Measures for Deregulation. Safety administrators providing advice on issues needed to prevent industrial accidents and preventive measures We would like to present the problems and improvements that may arise due to safety managers ' replacement due to accidents caused by industrial accidents or accidents.

해상교통안전진단제도는 연안에서 선박의 항행에 영향을 미치는 각종 해상사업으로 인해 발생할 수 있는 위험요인을 전문적으로 조사·측정·평가하기 위해 2009년에 법제화된 이후에 제도 발전에 관한 여러 연구가 수행되어 왔다. 이러한 연구결과를 분석하여 현 제도의 미비점을 색인한 결과, 안전진단 결과에 따라 해상사업이 수행되었는지 검증하기 위한 절차와 안전진단의 주요 과정 중 하나인 선박조종 시뮬레이션의 정확성을 검증하기 위한 사후관리 관련 규정이 미흡했다. 사후관리제도 도입 필요성이 드러남에 따라 법령화된 유사 제도인 환경영향평가제도와 도로교통안전진단제도의 법체계를 분석하였다. 그리고 해상교통분야의 미비점을 개선하기 위한 법령안을 구체적으로 제시하였다. 본 고의 법령안은 진단의 정확도를 검증하고 진단결과의 이행을 담보함으로써 해상사업과 관련된 잠재적 위험요인을 제거하고 해상교통안전에 기여할 것으로 기대된다.

The main point of this study is to find out duplicates and differences among various regulations from different organizations. Also, it focuses on creating a reasonably unified regulation system to standardize safety & environment management. In this study, I analyzed the commonalities and the differences of two systems which are typical korean Process Safety Management System and off-site Consequence Analysis. It is confirmed that there are 25 species of overlapped material of those two systems and assessment like handling material information, facilities lists, hazardous substances and list of machine power. Process safety report focuses on onsite workers and facility protect. On the other hand, off-site Consequence Analysis focuses on design, arrangement and management of handling facility from off-site influence. I found difference two system of Enforcement purposes and way. Contradiction of Harmful information of Chemicals Control Act and occupation safety and health acts from same material. To be specific, There are no unit rule of occupation safety and health acts. so it permit inch, psi etc. But Chemicals Control Act provides that m, Mpa units. Therefore, Each regulatory duplication of items for chemicals management, standardization is writing so that you can coordinate overlapping items in the measures the need to be presented.

In the industrial accident that occurred in the recent contract type of business or establishment (including subcontractor) employers and contractors who demand among employers, would be liable to have a proper discussion on how to prevent industrial accidents. To resolve this issue, it introduced the discussion with the Japanese legal system, which has a system similar to the Occupational Safety and seeks to help us in our country's future institutional improvements.

해양에서의 안전확보는 아무리 강조해도 지나치지 않다. 요즘 국내의 관심을 집중시켰던 해양사고중의 하나는 세월호 사고와 더불어 우이산호 사고이다. 이 사고는 2014년 1월 31일 여수 GS-Caltex 원유부두로 진입하던 싱가포르 국적 초대형 유조선(VLCC) “우이산호(WU YI SAN)”가 원유부두와 원유이송 송유관과 충돌하여 송유관 내부에 있던 유류가 해상으로 유출된 사고로서 1995년 여수해안에서 발생한 5천톤 가량의 유류유출사고가 발생한지 거의 20년만의 일이다. 울산항의 유출사고 사례는 2013년에 대형정유업체인 SK 에너지에서 운영하는 부유식 호스의 파손으로 인한 유출사고가 있었다. 이와 관련하여 현재 각 회사에서 운영중인 자체안전관리계획서 승인제도는 위험물 취급에 관한 최고경영자의 관심 결여 및 정부당국의 안전 관리 감독 소홀로 인하여 큰 역할을 못하고 있는 실정이다. 이에 이 논문에서는 현행 개항질서법상 규정되어 있는 위험물 취급 시설물에 대한 자체안전관리계획서 승인제도의 문제점을 파악하고 이에 대한 개선방안을 도출하여 위험물 취급 시설물에 기인한 사고방지, 환경보호 및 안전 확보에 기여하고자 한다.

국가 간 국제무역 확대로 인한 물동량 증가, 국민의 삶의 질 향상에 따른 해양레저 활동의 증가 등 해상교통 환경은 빠르게 변하고 있다. 또한 선원의 고령화, 외국인 선원 증가 등 선박운항 환경도 변화하고 있다. 이러한 해상교통 및 선박운항 환경변화에 따라 시장에서는 해운선사의 수준 높은 안전관리 능력을 요구하고 있다. 본 논문에서는 해운선사의 해양사고, 항만국통제, 안전관리체제 등 개별 제도에 따른 안전관리 결과를 종합적으로 평가 및 관리할 수 있는 제도 도입을 위하여 국내외 유사사례를 조사 분석하고 모방전략을 적용했다. 모방전략을 이용한 연구결과에 있어서 모방산업과 제도는 건설업체 환산재해율 산정제도, 교통안전 우수사업자 지정제도를 선정했다. 두 제도를 분석하여 모방대상으로 근거법률, 평가지표, 인센티브를 추출하고 해운선사 안전관리 수준 평가제도를 위한 근거법 도입, 해양사고율, 항만국통제 점검률, 안전관리체제 심사율로 구성된 평가지표와 안전점검의 면제, 수수료 감면 및 심사시간 단축 등의 인센티브 방안을 제안하였다. 또한 제도의 신속한 도입과 지속적인 시행을 위한 모방시점과 방법을 단계별로 제시하여 제도의 지속발전이 가능하도록 하였다.
