기업가선택을 높이는 요인들 중 인적자본가설은 다양한 지식축적을 통해 기업가가 되고 이는 소득을 높인다고 주장하는 반면 기호가설은 다양한 활동에 대한 기호 때문에 기업가가 되지만 예상소득이 피고용 상태보다 저조할 것으로 본다. 기술기업의 경우 전문성에 대한 이득이 커서 이러한 효과들은 약화될 수 있다. 이민의 경우 고용차별압력에 의한 자영선택가능성도 증가할 수 있다. 의료를 제외한 과학기술직의 자영업을 기술기업가로 보고 이의 소득방정식을 미국 인구센서스 데이터에 대해 추정하여 기업가 이론중 인적자본 가설과 기호가설, 차별요소, 선택편이를 비교추정 하였다. 특히 미국 기술기업 내 비중이 커지고 있는 아시아인을 백인집단과 비교하여 소득을 분해 비교하였다. 기업가선택에 대한 인적자본가설이나 자기선택에 의한 경쟁적 가설보다는 떠돌이 가설의 가능성이 크게 보인다.

매스컴에 떠들썩한 살인마 피의자의 얼굴 공개 문제 그리고 이광재 강원지사 당선 직후이나 확정판결 전이라도 금고 이상의 유죄일 경우 그 직무정지를 규정한 지방자치법을 두고 내내 무죄추정의 원칙에 대한 기사가 국내 뉴스를 장식하였다. 미국 오바마 대통령의 관타나모 수용소 폐쇄와 유지 번복은 세계 뉴스에 회자되고 있는데 알고 보니 이것 또한 무죄추정이라는 법원리에서 다투어지는 논쟁거리였다. 이 글을 쓰면서 인용한 많은 미국 관련 문헌들이 대부분 플리바게닝이 무죄추정의 원칙을 무용지물로 만드는 기술적 ․ 편의적 산물이라는 비판들도 지나칠 수 없었다. 이에 무죄추정의 원칙이라는 중요한 법적 원리가 한국과 미국에서 역사적으로 어떻게 형성되었고 현대 사회에 어떤 의미를 가지고 있으며 양국에서 어떤 위상의 법원리로 다루어지고 있는지 비교적인 고찰을 시도하고자 하였다. 우리나라보다 100년 훨씬 이전부터 무죄추정의 원칙을 법원리의 초석으로 굳게 적용해온 미국 법제 하에서 플리바게닝의 유지는 사실 무죄추정의 원칙을 제한적으로 해석하려는 의도로 파악되고 있다. 비록 짧은 역사이지만 헌법과 형사소송법에 명문의 규정을 두고 판례를 통하여 다른 법원리와 조화를 이루면서 무죄추정의 원칙에 대한 강건한 기준을 세우고 있는 한국법제를 살펴보았을 때 사법정의(Justice)라는 법정신을 느낄 수 있었다. 이 글은 바로 이러한 비교를 위한 것이다.

공동체적 가치가 보다 중시되는 우리 사회에서는 정치적 표현의 영역에서조차 보호의 범위가 완벽하지 못한 실정이지만, 표현의 자유의 규범적 중요도를 훨씬 높게 바라보는 미국 사회에서는 상업적 표현까지도 정치적 표현 못지않은 보호를 받아야 한다는 주장이 존재한다. 개인이 중심이 된 전통적 자유주의(혹은 여기에서 더 나아간 자유지상주의)를 바탕으로 한 이 논리는 표현의 자유가 지향하여야 할 가치 중에서 개인의 자아실현을 최고의 것으로 꼽는다. 자본주의의 급격한 개인주의화 경향으로 나아가는 우리 사회 또한 앞으로 경험할 가능성이 높은 주제의 논의이다. 이 글에서는 이 입장의 대표적 주창자인 마틴 레디쉬(Martin Redish)의 자아실현에 기반한 자유주의 논리가 가지는 취약점을 고찰하여 상업적 표현의 절대적 보호론을 반박한다.

국제법의 일반원칙에 따르면, 연안국은 공해상의 범죄혐의가 있는 외국선박에 대하여 관할권을 행사할 수 없다. 공해상의 선박에 대해서는 국제법상 원칙적으로 기국이 관할권을 가지며, 공해상의 항해 자유의 원칙은 확립된 국제해양법의 원칙이기 때문이다. 따라서 공해상에서 연안국의 관할권 행사에 있어 국제법상 법리적 한계를 인식하고, 외교적 측면에서 실효적인 관할권 행사를 위한 노력이 필요하다는 점을 유념해야 할 것이다. 한편, 국제법상 해석학적 현장성의 법리나, 일부실행행위이론에 따르면, 공해상의 외국 선박에 대하여 연안국의 관할권 행사가 법리상 가능하다. 우리 해양경찰함정과 어업지도선의 공해상의 위법 외국선박의 단속에 있어 국제법상 판례를 통해 확립된 이러한 법리들을 활발히 적용하여 우리의 해상관할권을 적극 행사하도록 해야 할 것이다.

유엔해양법협약과 의제21의 17장에서 해양의 통합관리를 권고한 이후 미국, 캐나다, 호주 등 선진 해양국가들은 해양법 제정과 해양정책의 수립을 통해 통합적인 해양관리를 지향하고 있다. 그러나 이들 국가는 연방정부의 체제로서 해양관련 조직의 통합과 정책의 통합에 있어 일정한 한계를 보이고 있다. 즉, 이들 국가에서는 해양관련 주관부서가 없으며, 지방정부 관할해역을 연방정부의 해양정책에 포함하지 못하고, 민간부문 관련 산업의 육성을 직접적으로 언급하지 않고 있다. 이들 연방국가의 해양정책은 범부처 및 산업계를 포함한 위원회 등을 설립하여 관련 부처 및 지방정부의 다양한 이해관계를 조정하고 있다.

HACCP is applicable when there are control measures which can be applied to prevent, eliminate, or reduce the occurrence of a food safety hazard to a consumer, but much of the life cycle of a food does not lend itself to strict application of HACCP principles. FSIS HACCP is mandatorily applied to meat and poultry slaughter and processing establishments to reduce harmful bacteria on their products. FSIS manages the HACCP plants under continuous inspection of the FSIS inspectors: Inspector in Charge (IIC), Public Health Veterinarian (PHV), on line/off line Consumer Safety Inspectors (CSI). More than 7,600 inspection personnel inspect nearly 6,500 meat, poultry, and egg processing plants, and verify that regulations regarding food safety and other consumer protection concerns are met. But only half of violations observed are recorded on the non-compliance report due to inspector shortages. The change from traditional sanitation system to HACCP system has been difficult because of several factors: Lack of technical expertise in processing facilities makes a scientific hazard analysis difficult, preventive measures and validation efforts are not supported by data, plant management and inspectors concentrate on what they know, plants are still very dependent on the regulatory agency for guidance, focus is on regulatory procedures more than determining food safety issues, and also plants are less efficient at producing and maintaining records that are not specifically tied to production lots. However HACCP is an effective tool in food safety continuum.

As directly imported apparel brands are actively entering the domestic market, studies of the marketing aspects of these imported apparel products and their overall consumption trend have been done. However, studies of whether are not the directly imported apparel products provide Korean consumers with an appropriate fit are not as common. Therefore, this study investigates the satisfaction with and problems associated with the fit along with the recognition of and preference for directly imported US apparel brands. 100 female college students who purchased directly imported US apparel brands participated in a survey. The results of this survey showed that their recognition of, preference for, possession rate of and satisfaction with the directly imported US apparel brands tend to be high. The major purchasing motivations were the excellent ‘design’ and ‘color’ of the products. The subjects reported that they were satisfied with the quality of ‘materials’ and ‘sewing condition’. However, they were not satisfied with the ‘comfort’ or the ‘size’. Their level of satisfaction with the fit of these products differed depending on the specific item. Their level of satisfaction with the fit of T-shirts and knits was high, whereas the level for pants was relatively low. They complained mostly about the sleeve length and garment length of upper-body garments and coats. They were not satisfied with how the pants fit. The areas of dissatisfaction regarding the pants were the waist girth, the crotch length and the pants length.

2010년 4월 20일, 반잠수식 시추선 Deepwater Horizon호가 폭발, 침몰하는 사고가 발생하였으며, 이로 인해 490만배럴(약 77.8만톤)의 원유가 미국 멕시코만으로 유출되었다. 이 사고는 석유산업 역사상 가장 규모가 큰 사고로서, 미국 해안경비대, 주정부 및 사고책임자인 BP가 서로 협력하여 적극적으로 사고에 대응하였다. 본 논문에서는 이번 사고대응의 특징으로 1) 연방-주-행위자 통합지휘, 2) 국가사고관리체제 (NIMS)의 시행, 3) 어선을 임시방제정으로 이용하는 프로그램 시행, 4) 과학적 지원에 기초한 대응, 5) 국민의 알 권리 충족에 주력, 6) 정확한 상황인식에 의한 효율적 방제, 7) 사고를 연구개발의 기회로 활용 등에 대하여 살펴보았다.

The purpose of this study was to investigate American's perception and preference for Korean kimchi. A questionnaire was used to examine the perceptions of 126 males (40.4%) and 186 females (59.6%) residing in Illinois and California. Approximately 68% of the respondents had eaten Korean food. The perception of kimchi was the highest with a mean of 3.62. The respondents felt that the "Kimchi is a good side dish with cooked rice", "Kimchi (with garlic) prevents SARS", which was significantly different (M=3.06, p< .001), and "Kimchi prevents adult diseases" (M=3.24, p< .01). When evaluating the different kinds of kimchi, onion juice kimchi had the most preferred taste and also the highest overall acceptability (M=5.50, p< .05) of the second days. In the sensory evaluation by kimchi use, the best taste (p< .001) was in the order of kimchi pizza (M=6.58), kimchi dumplings (M=6.40), and kimchi chicken a'laking (M=6.33). The order for overall acceptability (p< .001) was kimchi dumplings (M=6.30), kimchi pizza (M=6.25), kimchi bacon roll, kimchi fried rice, and kimchi chicken a'laking (M=6.17).
