우리나라 헌법 제107조 제3항은 재판의 전심절차로서 행정심판을 할 수 있 으며 절차는 법률로 정하되, 사법절차가 준용되어야 한다고 규정한다. 그리고 행정심판법 제4조 제1항에서는 사안의 전문성과 특수성이 인정되면 필요에 따 라 개별법이 정한 특례절차에 따라 심판을 할 수 있도록 규정하고 있다. 이러 한 특례절차에 따른 행정심판을 특별행정심판이라 하는데, 해양안전심판, 특허 심판 및 조세심판 등이 있다. 특별행정심판 중에서도 해양안전심판은 해양사고의 원인규명재결뿐만 아니 라 해기사 등에 대한 징계재결까지도 심판의 결과로 도출하는 특별한 형태의 행정심판으로서 구술변론주의, 대심주의 및 조사관의 청구독점주의 등을 채택 하고 있다. 그러나 조사관은 해양사고관련자를 조사하는 권한을 가지고 있어 해양사고관련자와 대등한 입장이라 보기 어렵다. 그러므로 상대적 약자인 해양 사고관련자의 정당한 권리구제와 방어권을 보장하기 위해서는 심판변론인 제 도의 적극적 활용이 무엇보다 중요하다. 이 연구에서는 해양사고심판의 심판변론인제도를 다양한 측면에서 살펴보 고, 다른 특별행정심판인 특허심판과 조세심판 제도와 비교·분석하여 해양안전 심판의 심판변론인제도에 대한 문제점을 도출하고 개선방안을 제안하고자 한다.
This study analyzes the importance-performance analysis (IPA) of the 10 dimensions of the smart construction safety management system, and analyzes which dimensions are important and which dimensions are performing to determine key improvement tasks, incremental improvement tasks, Maintenance and reinforcement tasks and continuous maintenance tasks were derived. Among the 10 dimensions of the smart construction safety management system, the dimensions that are recognized as important by all field managers and field workers and have high performance are the automatic risk displacement measurement system, smart environmental sensor system, and heavy equipment seizure prevention system. However, areas that were perceived as having high importance but low performance were worker location tracking systems, smart safety helmet chin muscles, and smart safety ring fastening. Among the smart construction safety management systems perceived by field managers, areas for key improvement with high importance and low performance included worker location tracking system and smart safety ring fastening. Among the smart construction safety management systems perceived by field workers, the area for key improvement with high importance and low performance was the automatic risk displacement measurement system.
The public safety management guidelines were introduced in 2019 and continue to be dedicated to advancing comprehensive measures for public safety management, with a primary focus on prioritizing the safety and well-being of the public within governmental institutions. To achieve this goal, our previous study developed a establishment procedure of risk assessment-based safety inspection system for public institutions that order construction projects and applied it to highway construction projects to evaluate its effectiveness. To enhance the practicality of the establishment procedure, it is essential to collect and analyze feedback from stakeholders regarding its performance and suitability. This study conducted a survey involving 200 participants who had experience with the establishment procedure, and performed statistical analyses to evaluate its performance and applicability. The survey results indicated that the participants reported a high level of satisfaction (scoring 4 and above on a 5-point Likert scale) in several areas: specialization of safety inspection items for different types of work (with a satisfaction rate of 65%), the evaluation process for safety ratings (64.5%), and their willingness to recommend the procedure to other institutions (75.5%). In the factor analysis with Varimax rotation, two factors emerged: (1) a specialization factor related to safety inspection items, and (2) a grading factor associated with safety evaluation results. Regression analyses of these factors unveiled significant positive relationships with improvements in safety and health performance, including the prevention of fatal accidents, heightened safety responsibility, and raised safety inspection standards. The establishment procedure of safety inspection system developed in our previous study can play a crucial role in reducing accidents resulting in fatalities and injuries at construction sites, ultimately contributing to a safer working environment for all involved parties.
In order to ensure the long-term safety of a deep geological repository, the performance assessment of the Engineered Barrier System (EBS) considering a thermal process should be performed. The maximum temperature at the side wall of a disposal canister for the technical design requirement should not exceed 100°C. In this study, the thermal modelling was conducted to analyze the effects of the thermal process from a disposal canister to the surrounding near-field host rock using the PFLOTRAN code. The mesh was generated using the LaGriT code and the material properties were assigned by applying the FracMan code. Initial conditions were set as the average geothermal gradient (25.7°C/km) and an average surface temperature (14.7°C) in Korea. The highest temperature was observed at the middle of the canister side wall. The temperature of the buffer was lower than that of the canister, and the temperature increase of the deposition tunnel and the host rock was insignificant due to the lower effect of the heat source. The result of the thermal evolution of the EBS represented the highest thermal effects in the vicinity of the canister. In addition, the thermal effects were largely decreased after 10 years of the entire simulation period. It demonstrated that the model took 3 years to heat up the buffer around the canister. The temperature at the canister side wall increased until 3 years and then decreased after that time. This is because that the radioactive decay heat from the heat source was emitted enough to raise the overall temperature of the EBS by 3 years. However, the decay heat rate of the canister decreased exponentially with the disposal time and then its decay heat was not emitted enough after 3 years. In conclusion, the peak temperature results of the EBS were lower than 70°C to meet the technical design requirement.
This study attempted to analyze the comparative advantage in terms of disaster safety costs in verifying the effectiveness and economic feasibility of the high-performance water-bulwark system in the pole tunnel, which was recently promoted as a part of the acceleration of vehicles. The tunnel to be analyzed was divided into a short tunnel(Anyang, Cheonggye) and a long tunnel(Suraksan, Sapaesan). As a result, it was analyzed that 25% of the improvement effect would occur if one lane was secured by applying the Water-Bulwark System. It was analyzed that this is because the time value cost, which accounts for a large proportion of the traffic congestion cost of short tunnels and pole tunnels, differs depending on the congestion time and traffic volume, not the length of the tunnel.
The Severe Disaster Punishment Act had recently been established in order to promote safety and health (OSH) management system for severe accident prevention. OSH management system is primarily designed based on risk assessments; however, companies in industries have been experiencing difficulties in hazard identification and selecting proper measures for risk assessments and accident prevention. This study intended to introduce an accident analysis method based on epidemiological model in finding hazard and preventive measures. The accident analysis method employed in this study was proposed by the U.S. Department of Energy. To demonstrate the effectiveness of the accident analysis method, this study applied it to two accident cases occurred in construction and manufacturing industries. The application process and results of this study can be utilized in improving OSH management system and preventing severe accidents.
Since high-level radioactive wastes contain long-lived nuclides and emit high energy, they should be disposed of permanently through a deep geological disposal system. In Korea, the first (2016.07) and the second (2021.12) basic plans for the management of high-level disposal systems were proposed to select sites for deep geological disposal facilities and to implement business strategies. Leading countries such as Finland, Sweden and France have developed and applied safety cases to verify the safety of deep geological disposal systems. By examining the regulatory status of foreign leading countries, we analyze the safety cases ranging from the site selection stage of the deep geological disposal system to the securing of the permanent disposal system to the investigation, analysis, evaluation, design, construction, operation, and closure. Based on this analysis, we will develop safety case elements for long-term safety of deep geological disposal systems suitable for domestic situation. To systemically analyze data based on safety cases, we have established a database of deep geological disposal system regulations in leading foreign countries. Artificial intelligence text mining and data visualization techniques are used to provide database in dashboard form rather than simple lists of data items, which is a limitation of existing methods. This allows regulatory developers to understand information more quickly and intuitively and provide a convenient interface so that anyone can easily access the analyzed data and create meaningful information. Furthermore, based on the accumulated bigdata, the artificial intelligence learns and analyzes the information in the database through deep learning, and aims to derive a more accurate safety case. Based on these technologies, this study analyzed the legal systems, regulatory standards, and cases of major international leading countries and international organizations such as the United States, Sweden, Finland, Canada, Switzerland, and the IAEA to establish a database management system. To establish a safety regulation base suitable for the domestic deep geological disposal environment, the database is provided as data to refer to and apply systematic information management on regulatory standards and regulatory cases of overseas leading countries, and it is expected that it will play a key role as a forum for understanding and discussing the level of safety of deep geological disposal system among stakeholders.
The growth of the online market is accelerating due to the development of technology and the pandemic era. The delivery service through the courier must be used to deliver the ordered goods to the customer through the online market. With the growth of the online market, the logistics market for delivery is also growing. The traffic and environmental problems are emerging as social issues. Urban logistics technology using underground space based on the urban railway developed to improve logistics efficiency in a metropolitan area and a new alternative to environmental problems. This study proposed a plan to secure system safety through safety analysis based on operational concept definition and scenario analysis by applying model-based perspective analysis to the system under development.
In this study, algorithms for analyzing the torsion of buildings under earthquake excitation are developed. The algorithm and formulations to account for the torsional angle are verified by analyzing the seismic acceleration time history data. The method was applied to the reference buildings to examine their operation and usability. The reference application demonstrated that the noise-canceling scheme successfully overcame various obstacles in the field measurements. The developed method is expected to be used as a tool to support a loss assessment system for determining the direction and priority of disaster response in the event of an earthquake.
The purpose of this study is to keep the safety of the car ferry passengers and vessels by investigating and analyzing vessel safety management systems in Korea and China. To this end, we investigated Korea-China car ferries and the current status and causes of global marine accidents corresponding to the sizes of the vessels from Korea and China. Furthermore, we investigated car ferries’ crew management and safety management. As a result of the analysis of the ferry accident, the causes of human error and ship’s age were the greatest, but the ship’s companies showed a negative stance regarding the age restriction. It seems that it is necessary to utilize the near-miss accident reporting system and differentiate the management of ship’s aging. Also, it was analyzed that both the ship company and the crew of the ship need to strengthen their awareness of safety management.
As the demand for automation (or autonmation) or clean workplace has grown, the interest in the knowledge and skill regarding safety is rising in manager duty. Moreover, the importance of severity rate of injury has increased due to the enlargement of industry scale, even safety management area has developed. Thus, it is important that production managers, the core of the line process, realize the safety in their production line, even if a safety manager acts as a staff. However, in the duty oriented National Competency Standard (NCS), the education about the safety duty of production management part is insufficient. According to NCS, it is calculated production managers receive only 6.7% of whole safety education regarding the duty related the safety management for production manager in mechanical industry. However, the ability in safety is more demanded from production managers as the concept of “production and safety” turns into the concept of “production with safety”. And then in this paper, we will compare and analyze the safety management duty in Korean NCS and the safety management duty in State Leaders Connecting Learning to Work in US manufacturing industry, in terms of the duty of the production manage in mechanical industry (05). And, we will develop the safety duty education system for production manager, by classifying the safety education in domestic mechanical industry into knowledge education, skill education, and attitude education with using AHP(Analytic Hierarchy Process).
The main point of this study is to find out duplicates and differences among various regulations from different organizations. Also, it focuses on creating a reasonably unified regulation system to standardize safety & environment management. In this study, I analyzed the commonalities and the differences of two systems which are typical korean Process Safety Management System and off-site Consequence Analysis. It is confirmed that there are 25 species of overlapped material of those two systems and assessment like handling material information, facilities lists, hazardous substances and list of machine power. Process safety report focuses on onsite workers and facility protect. On the other hand, off-site Consequence Analysis focuses on design, arrangement and management of handling facility from off-site influence. I found difference two system of Enforcement purposes and way. Contradiction of Harmful information of Chemicals Control Act and occupation safety and health acts from same material. To be specific, There are no unit rule of occupation safety and health acts. so it permit inch, psi etc. But Chemicals Control Act provides that m, Mpa units. Therefore, Each regulatory duplication of items for chemicals management, standardization is writing so that you can coordinate overlapping items in the measures the need to be presented.
This study on Structural analysis of kickboard used two types suspension systems. Kickboard is very dangerous in rider because of unstable in diving conditions. Thus suspension system of kickboard are very important component parts. This study focus on two suspensions for stability in kickboard which coil spring and aluminium leaf spring.
The study examined the relationship between workers’safety awareness, safety performance and the components of the intelligent image analysis system in accordance with preventing the workers from safety hazard in dangerous working area. Based on the safety performance model, we include safety knowledge, safety motivation, safety compliance and safety participation, and we also define three additional factors of the intelligent image analysis system such as functional feature, penalty and incentive by using factor analysis. SEM(Structural Equation Modeling) analyses on the data from the total of 73 workers showed that functional feature of intelligent analysis system and incentive were positively related to safety knowledge and safety motivation. And mediation effects of the relationship were verified to safety compliance and safety participation through safety knowledge as well.
