상표패러디는 타인의 상표를 이용해야 하는 것이 필수적인바, 상표소유자의 상표권과 패러디스 트의 헌법상 표현의 자유가 충돌하는 상황을 조율해야 하는 문제가 발생한다. 상표패러디는 소비자들에게 원상표를 떠올리게 하면서 동시에 패러디상표를 그 패러디로 인식하게 하므로 상표가 외관상으로 유사해 보일지 라도 상표에 대한 혼동을 일으키지 않는다. 상표패러디는 주로 원상표를 희화하거나 조롱하여 비평이나 풍자의 목적을 달성하기 때문에 명성의 손상에 의한 희석화가 문제된다. 부정경쟁 방지법은 공정사용의 예를 확인하는 의미에서 타인의 상표를 비상업적으로 사용하는 경우 희석화 조항이 적용되지 않는 것으로 규정하고 있는바, 비상업적 상표패러디는 공정사용으로서 보호될 수 있을 것이다. 상표패러디의 명확한 인정여부를 위해 상표의 사용으로 인하여 상표권자가 받는 불이익, 패러디로 인하여 소비자 등이 받는 공적 이익, 공정한 거 래관행에 위반하는지 여부 등의 요소를 고려하여 상표법과 부정경쟁방지법 전반에 걸쳐 적용할 수 있는 상표의 공정사용 조항의 도입이 필요하다.
This paper proposes an improved standard genetic algorithm (GA) of making a near optimal schedule for integrated process planning and scheduling problem (IPPS) considering tool flexibility and tool related constraints. Process planning involves the selection of operations and the allocation of resources. Scheduling, meanwhile, determines the sequence order in which operations are executed on each machine. Due to the high degree of complexity, traditionally, a sequential approach has been preferred, which determines process planning firstly and then performs scheduling independently based on the results. The two sub-problems, however, are complicatedly interrelated to each other, so the IPPS tend to solve the two problems simultaneously. Although many studies for IPPS have been conducted in the past, tool flexibility and capacity constraints are rarely considered. Various meta-heuristics, especially GA, have been applied for IPPS, but the performance is yet satisfactory. To improve solution quality against computation time in GA, we adopted three methods. First, we used a random circular queue during generation of an initial population. It can provide sufficient diversity of individuals at the beginning of GA. Second, we adopted an inferior selection to choose the parents for the crossover and mutation operations. It helps to maintain exploitation capability throughout the evolution process. Third, we employed a modification of the hybrid scheduling algorithm to decode the chromosome of the individual into a schedule, which can generate an active and non-delay schedule. The experimental results show that our proposed algorithm is superior to the current best evolutionary algorithms at most benchmark problems.
Distributed genetic algorithm (DGA), also known as island model or coarse-grained model, is a kind of parallel genetic algorithm, in which a population is partitioned into several sub-populations and each of them evolves with its own genetic operators to maintain diversity of individuals. It is known that DGA is superior to conventional genetic algorithm with a single population in terms of solution quality and computation time. Several researches have been conducted to evaluate effects of parameters on GAs, but there is no research work yet that deals with structure of DGA. In this study, we tried to evaluate performance of various genetic algorithms (GAs) for the famous symmetric traveling salesman problems. The considered GAs include a conventional serial GA (SGA) with IGX (Improved Greedy Crossover) and several DGAs with various combinations of crossover operators such as OX (Order Crossover), DPX (Distance Preserving Crossover), GX (Greedy Crossover), and IGX. Two distinct immigration policies, conventional noncompetitive policy and newly proposed competitive policy are also considered. To compare performance of GAs clearly, a series of analysis of variance (ANOVA) is conducted for several scenarios. The experimental results and ANOVAs show that DGAs outperform SGA in terms of computation time, while the solution quality is statistically the same. The most effective crossover operators are revealed as IGX and DPX, especially IGX is outstanding to improve solution quality regardless of type of GAs. In the perspective of immigration policy, the proposed competitive policy is slightly superior to the conventional policy when the problem size is large.
The purpose of this study was to determine anthropometric measurements, dietary nutrient intakes, simple food intake frequencies, and rates of obesity in Cambodian women. A total 186 women, aged 20-69 years, living in Kampong Spue province of Cambodia and having the responsibility to prepare family meals participated in this study. Height and weight were measured body mass index (BMI) was calculated, and one-day 24-hour recall and food frequency questionnaires were conducted. In total, 18.8% were underweight, 49.5% were normal weight, 13.4% were overweight, and 18.3% were obese according to the World Health Organization BMI standard for Asians. No significant difference in height by obesity level was determined (p≥0.05). The mean energy intake was 1571.2 kcal/day and protein intake was 43.6 g/day. There were significant differences in protein, niacin, and vitamin C intakes by obesity level (p<0.05). The prevalence of subjects consuming vitamins and minerals less than 75% of Recommended Dietary Allowances was 73-99%. All Cambodian women consumed rice ≥1 time/day. Approximately 50% of subjects reported ≥1 time/day intake frequency of bread, cookies, and chips. In total, 35% indicated no intake of beans or bean products. For intake frequencies of carbonated beverages and sports drinks, there was a significant difference by obesity level (p<0.05). These results may be very helpful to prepare nutrition education programs for Cambodian women
Metastatic tumors in oral cavity are rare, where their prognoses are considered to be extremely poor. Unless recognizing its primary origin, pathologic diagnoses for metastatic cancer have been troublesome for oral pathologists. This retrograde analysis was aimed at providing practical suggestion for the diagnoses of metastatic cancers to oral and maxillofacial region. We reviewed 20 patients diagnosed as metastatic cancers to oral cavity from 1991 to 2007. The patients were classified according to their clinical and histologic findings. We also reviewed 19 patients of mucoepidermoid carcinoma and 16 patients of adenoid cystic carcinoma to compare with those of metastatic cancers. Immunohistochemical staining for CK 5/6, CK 17, TTF-1, CEA was performed for differential diagnosis. Histologically, 20 cases compromised 11 cases of adenocarcinoma, 5 cases of undifferentiated carcinoma, 3 cases of squamous cell carcinoma, and one papillary carcinoma. The lung was the most common site for primary site (5/20), followed by the breast (2/20). In metastatic adenocarcinoma, TTF-1 positive cases were one lung cancer and a rectal cancer, and carcinomas from breast and rectum showed CK5/6 positive reaction. CEA was expressed in gastric and rectal carcinomas. In 19 cases of mucoepidermoid carcinoma, 13 cases (68.4%) are CK5/6 (+). In 16 cases of adenoid cystic carcinoma, 11 cases (68.8%) showed the positive reaction for CK5/6. TTF-1 is an antibody to show high sensitivity and specificity for lung adenocarcinoma, therefore, TTF-1 is helpful to make a diagnosis of metastatic adenocarcinomas from lung. Adenocarcinomas originated from salivary glands show high CK5/6 expression, but metastatic adenocarcinomas, except of those from breast and rectum, show no CK5/6 expression, lending support that CK5/6 may be useful to differentiate metastatic adenocarcinomas from carcinomas of salivary gland origin.
This study is on issues of Muslim women’s predicament in Islamic culture, exarrurung these issues with the purpose to presenting the Christian mission imprative and its approach to Muslim women who are under oppression of Islamic systems. The hypothesis of this study is that the discrimination against women is due to Islamic social systems, which have been intensified according to the rulers' disposition supported by Islamists. Pakistan is a representative case of it. Pakistan established a Muslim state separately at the time of the independence of India from British rule, and required an attempt to solidifY the nation consisting of various ethnic groups under Islam for the social and political stability. Since political leaders have recognized Islamization as an effective means for Pakistani solidarity, they have established social systems by introducing Islamic laws as a part of Isamization. Islam has functioned importantly in uniting various component segments of society, and has been the ideology and crucial motive for the founding of Pakistan. The revival of the Islamic •fundamentalism in Pakistan was supported by rulers who thought of Islam as the ideology to solidify the nation. The impact of Ismization on the social status of women has been serious because women’s low place in that culrure in grounded on Isalmic Scriprure, Qur’an and Islamic traditions, Hadith. The gender discriminative references implied in Qur’an and Hadith have helped social systems to justify the discrimination against women over the time. Their usual practices are the purdah, the punitive law, the evidence law, the revenge and compensation law, and the family law. Those gender discriminative sαial systems have given rise to the domestic violences against women as well as restriaion of sphere of women, and the violences against women such as the honor killing in Pakistan have increasecL The honor killings in the name of the family honor have become a serious problem in Islamic countnes. Recently, the static of women’s education reveals an increasing nU01ber of women in education and in high position in Pakistan society. But many women in lower classes are still in illiteracy and poverty, and those women observe purdah,an Islamic social system. The image of women in God's Kingdom is srudied for understanding of the missions perspective toward muslim women who are segregated and have lost their rights under Islamization. The heaven which muslims describe is a paradise to be given to faithful Muslim men, where beautiful women among other compensation are prepared. πlÏs description of heaven suggests that women is subordinated to men. This srudy argues that the true image of women in the God's Kingdom is accomplished by liberation through Christ from patriarchism at the level of social structure and oppression by dark spirirual powers. To present true liberation to Muslim women, Christian misslon should be a rrusslon being with them, sharing their suffering, and thereby giving rise to transformation in their life and spirit. That is termed incarnational missions, which need hermeneutics considering the social and cultural contexts. The contextualization, however, should not allow the culture in which oppressing human right is justfied in the perspectibe of cultural relativism
This paper is to study the energy absorption characteristics of CF/Epoxy(Carbon Fiber/Epoxy Resin) laminated shell with the various curvatures subjected to transverse impact loadings under the low impact velocity in consideration of design of structural members for use of transportation machine, which are consisted of the characteristics of high stiffness, strength and lightweight. The curvature radius are associated with the energy absorption characteristics of CF/Epoxy laminated shell which is brittleness material. In all tests, maximum load of CF/Epoxy laminated plate is higher than that of laminated shell with curvature, but maximum deflection is lower. And then absorbed energy of laminated shell with curvature is higher than laminated plate(curvature radius is unlimited), As curvature radius is increased, the absorbed energy is increased in laminated shell with curvature.
Composites have wide applications in aerospace vehicles and automobiles because of the inherent flexibility in their design lot improved material properties. Composite tubes in particular, are potential candidates for their use as energy absorbing elements in crashworthiness applications due to their high specific energy absorbing capacity and the stroke efficiency. Their failure mechanism however is highly complicated and rather difficult to analyze. This includes fracture in fibers, in the matrix and in the fiber-matrix interface in tension, compression and shear. The purpose of this study is to investigate the energy absorption characteristics of Gr/E(Graphite/Epoxy) tubes on static and impact tests. The collapse characteristics and energy absorption of a variety of tubes have been examined. Changes in the lay-up which increased the modulus increased the energy absorption of the tubes. Based on the test results, the following remarks can be made: Among CA15, CA00 and CA90 curves the CA90 tube exhibits the highest crush load throughout the whole crush process, and max load increases as interlaminar number increase. Among all the tubes type CC90 has the largest specific crushing stress of 52.60 kJ/kg which is much larger than other tubes.
It is the basic requirement of product characteristics to specify geometric dimensions and tolerances during design process of parts assembly. Therefore, there are many tolerance stack analysis method to explain tolerance zone. Tolerance stack analysis is to calculate gap using tolerances which includes geometric and coordinate dimension. In this study, we compared several different stack analysis method and try to suggest more general method called the Virtual Method to analyze tolerance stack.
Because of the inherent flexibility in their design for improved material properties, composites have wide applications in aerospace vehicles and automobiles. The purpose of this study is to investigate the energy absorption characteristics of CFRf (Carbon Fiber Reinforced Plastics) tubes on static and impact tests. Static compression tests have been carried out using the static testing machine(Shin-gang buckling testing machine) and impact compression tests have been carried out using the vertical crushing testing machine. When such tubes were subjected to crushing loads, the response is complex and depends on the interaction between the different mechanisms that control the crushing process. The collapse characteristics and energy absorption were examined. Trigger and interlaminar number affect the energy absorption capability of CFRP tubes.
(PbZr52,Ti48)O3인 composite ceramic target을 사용하여 R. F. 마그네트론 스퍼터링 방법으로 기판온도 300˚C에서 Pt/Ti/Si 기판위에 PZT 박막을 증착하였다. 페롭스 카이트 PZT박막을 얻기 위하여 PbO분위기에서 로열처리를 행하였다. 하부전극으로 Pt를 사용하였으며 Pt(205Å)/Ti(500 Å)/Si 및 Pt(1000Å)/Ti(500Å)/Si기판을 준비하여 Pt두께화 Ti층이 산소의sink로 작용함으로서 이를 가속화하였다. Ti층의 상부는 산소의 확산으로 인하여 TiOx층으로 변태하였고 하부는 in diffused Pt와 함께 실리사이드층을 형성하였다. TiOx 층의 형성은PZT층의 방향성에 영향을 주었다. 유전상수 (10kHz), 누설전류, 파괴전압, 잔류분극 및 항전계는 각각 571, 32,65μ A /cm2, 0.40MV/cm, 3.3μ C /cm2, 0.15MV/cm이었다.
Single-Si 기판과 poly-Si 기판에 각각 Ti을 sputter한 후 RTA 처리하여 안정한 TiSi2를 형성하였다. 그 위에 Si이 1% 첨가된 Al-1% Si을 600nm sputter한 후 후속 열처리로서 400-600˚C 에서 30분간 N2분위기로 furnace어닐링을 실시하였다. 이렇게 준비된 각 시편에 대하여 면저항 측정, Auger분석, SEM 사진으로 Al-1% Si/TiSi2이중층 구조에서 Ti-silicide의 열적 안정성을 살펴 보았고, EDS 분석과 X-ray 회절 peak 분석을 통하여 Al-1% Si 층과 TiSi2층의 반응으로 생긴 석출물의 성분과 상을 조사하였다. 이로 부터 다음과 같은 결과를 얻었다 Single-Si 기관에서 형성한 TiSi2층은 Al-1% Si 층과 550˚C에서 완전히 반응하여 석출물을 형성하였고, poly-Si 기판에서 형성한 TiSi2층은 Al-1% Si 층과 500˚C에서 완전히 반응하여 석출물을 형성하였는데 전반적으로 기판이 poly-Si인 경우가 반응이 더 잘 일어났고, 석출물의 크기도 비교적 컸다. 이는 poly-Si에 존재하는 grain boundary로 인해 poly-Si에서 형성된 Ti-silicide 층이single-Si 기관에서 형성된 Ti-silicide 층보다 불안정하기 때문으로 생각된다. EDS 분석에 의하여 석출물은 Ti, Al, 그리고 Si로 이루어진 3상 화합물이라고 추정되었고, X-ray회절 분석에 의해 석출물은 Ti, Al, 그리고 Si간의 3상 화합물인 Ti7Al5Si12로 확인되었다.
Ta2O5 박막은 실리콘산화막, 실리콘질화막 박막에 비해 유전율은 높으나 누설전류밀도가 높고, 절연파괴강도가 낮아 DRAM의 커패시터용 재료로서 실용화가 되지 못하고 있다. 본 연구에서는 LPCVD법으로 형성시킨 300Å 두께의 Ta2O5 유전체박막에 대해 후속열처리 또는 전극재료를 변화시켜 열악한 전기적 특성의 원인을 규명하고자 하였다. 그 결과 다결정 실리콘 전극의 경우 성막상태의 Ta2O5 박막은 전극에 의한 환원반응에 의해 전기적 특성이 열화됨을 알 수 있었고, 이를 TiN 전극의 사용으로 억제시킬 수 있었다. 다결정 실리콘 전극의 경우 성막상태의 Ta2O5 유전체는 누설정류밀도가 10-1A/cm2, 절연파괴강도가 1.5MV/cm 정도였으며, 800˚C에서 O2열처리를 하면 전기적 특성은 개선되나, 유전율이 낮아진다 TiN 전극을 채용할 경우 누설전류밀도 10-6~10-7A/cm2, 절연파괴강도 7~12MV/cm 로 ONO(Oxide-Nitride-Oxide) 박막과 비슷한 Ta2O5 고유전막을 얻을 수 있었다.
Ti-Silicides를 single-Si wafer와 그 위에 oxide를 성장시킨 기판위에 composite target(TiSi2.6)을 sputtering함으로써 증착시켰다. 증착된 비정질 상태의 Ti-silicide는 급속 열처리(RTA)방법으로 600˚C에서 850˚C가지 20초간 처리하였다. RTA온도가 800˚C가 되어서야 비로소 안정한 TiSi2가 형성되었으며, 그 때의 비저항 값은 27~29μΩ-cm로 Ti-metal reactive방법에 의한 TiSi2보다 약간 높은 값으로 드러났다. X-ray로 상천이를 조사한 결과 역시 750˚C가지 C49 TiSi2가 형성되고, 800˚C가 되어서야 안정한 C54 TiSi2로의 상천이가 일어남을 나타내고 있다. 또한 완전히 형성된 Ti-silicide의 조성비는 x-ray photoelectron spectroscopy(XPS)결과에서 Ti : Si이 1 : 2로 드러났으며, 그 동안 reactive 시켰을 때 TiSi2의 단점으로 지적되어 왔던 형성 완료된 TiSi2의 surface roughness는 17±1mm이내로 매우 우수한 값으로 판명되어, device에 대한 응용 가능성을 높이고 있다.
This study was carried out to investigate the physiochemical and microbiological changes of dandelion during fermentation. Thirty and fifty percentage raw sugar groups (SFE30 and SFE50) were introduced into dandelions and fermented for 120 days at 15-20℃. This study was conducted to investigate the utilization of sucrose on lactic acid bacteria from dandelions and their effect on the pH, titratable acidity, microorganism and formation of organic acids in dandelions during fermentation. The number of lactic acid bacteria increased remarkably up to 15 days of fermentation and then decreased rapidly thereafter. The maximum number of lactic acid bacteria, 7.9 log CFU/mL was reached at pH 4.17 and the pH of dandelion showed a slight decrease during fermentation and decreased steadily up to 90 days to reach an optimum pH of 4.0. The titratable acidity of dandelions fermented increased during fermentation. The concentration of organic acid, amino acid and free sugar in SFE30 was higher than both SFE50 and DWE. The results of dandelions fermented were remarkably retarded in the 50% raw sugar group compared to the 30% raw sugar group.
본 연구는 초등학교 5, 6학년 학생을 대상으로 학교에서의 수업 시수 차이에 따른 학외활동의 소비시간 변화와 활동종류별 평균활동계수를 파악하여 초등학생의 활동량을 증가시킬 수 있는 방안 마련의 기초자료를 제공하고자 한다. 초등학생의 활동 내역을 사전 조사하여 기존의 인터넷 프로그램을 보완한 다음, 서울시내 거주 초등학교 5, 6학년 학생 386명을 대상으로 인터넷 프로그램을 활용하여 4교시 수업일과 6교시 수업일의 활동별 소비시간을 조사하였다. 활동의 종류는 학내활동과 학외활동으로 구분하고, 학외활동은 학습, 휴식, 여가, 통학, 가사, 생리 활동으로 구분하였다. 총에너지소비량은 4교시 수업일 2300㎉, 6교시 수업일 2230㎉로 조사되었으며, 1일 평균활동계수는 각각 1.73, 1.67로, 6교시 수업일이 4교시 수업일보다 낮았다. 학교에서의 수업시간이 길어지면 여가활동의 시간 및 소비 에너지가 가장 많이 감소하는 것으로 나타났다. 학내활동의 활동 강도는 평균활동계수(PAL)가 1.8 가량으로 저강도 활동(PAL = 2.0~2.9)에 미치지 못하는 것으로 확인되었다. 활동실태를 4단계 활동수준으로 분류하였을 때, 조사 대상 학생의 35% 가량은 저활동적 단계, 40% 가량은 활동적 단계로 밝혀졌다. 총에너지소비량은 6학년이 5학년보다, 남자가 여자보다 많았으며, 과체중 및 비만, 정상, 저체중 집단의 순으로 나타났다. 학외활동 가운데 학습활동과 가사활동의 소비 에너지는 학년별, 성별, 비만도 집단별 차이가 없었으며, 휴식활동과 여가활동의 소비 에너지는 학년별 차이는 없고, 성별, 비만도 집단별 차이는 있었다.
