2022년 1월 「중대재해 처벌 등에 관한 법률」이 시행되고 건설업계에서는 안전에 대한 중요성이 매우 강조되고 있다. 특히, 작년 6월 광주지역 아파트 철거건물 붕괴 사고와 관련하여 안전사고의 원인 중 하나로 불법 재하도급이 거론되었다. 즉, 재 하도급으로 인한 과도한 공사비 삭감이 부실시공을 불러왔다는 것이다. 이에 정부는 2021년 8월 재하도급 근절을 위한 대책을 내놓았지만, 실제 건설현장에서 불법적인 재하도급이 근절되거나 줄어들었는지는 미지수이다. 하수급인은 공사를 직접 수행 하는데서 오는 부담과 비용 없이 일정 수수료를 챙길 수 있고, 재하수급인은 하도급 공사를 수주하기 위한 경쟁과 영업비용 등을 절감할 수 있어 재하도급이 건설현장 에서 계속 발생하고 있는 것으로 보인다. 그 외에는 전체 공사를 종합관리 하는 수급인의 무관심과 하수급인 등 이해관계자들이 건설 생산유형에 따른 재하도급에 대한 판단법리의 이해 부족으로 발생하는 경우도 있을 것으로 본다. 본 연구에서는 「건설산업기본법」 상 재하도급에 대한 기본적인 판단법리를 살펴보고 건설공사 현장 실무 유형별로 재하도급에 대한 해석기준을 제시함과 더불어 입법적, 실무적 개선방안을 제시하고자 한다.
This paper is a review of the construction process, craftsmanship, architectural economy of Bungang Seowon through the Changwon Ilgi(diary). The Bungang Seowon, which was built in the early 18th century, was initially built as a shrine, but was later completed as a seowon upon the decision of the scholars. It was the descendants of Nongam and the Hyanggyo, Seowon, and the government offices that provided economic, human and material support to the construction of Seowon. The small building of Bungang Seowon was run by a civilian carpenter, while the large building was run by a monk carpenter. The mobilization of the building workers was done by local scholars assigning the number of workers needed for each village.
오늘날 기성고 산정에 따른 완성공사비 대금지급의 산정에 대한 기준이 미흡하여 적정한 기성대금 산출이 이루어지지 않고 있어 분쟁이 많이 발생되고 있는 것이 현실이다. 선행논문은 기성고 해지비용, 건설 분쟁 예방 및 해결방안, 분쟁조정제도, 재판 외 분쟁해결방식 ADR(Alternation Dispute Resolution) 등으로 제도개선 이전에 단순한 여론조사 수준으로 시장분석을 기본으로 하는 연구가 진행되었다. 본 연구는 선행논문 검토와 문헌 조사, 전문가들의 실증적 분석, 본인 연구자의 실무 경험을 통해 국내ㆍ외 건설공사 기성고 산정에 대한 자료를 수집하고 분석하여 현행 건설공사 기성고 산정제도의 현황과 문제점을 검토하고 담론적ㆍ실증적으로 병행 분석하였다. 또한 실증적 분석에서 552명 중 33.10%가 내역서가 있는 경우 완성된 기성금액은 계약 수량에 완성된 수량을 곱하여 산정하는 것으로 조사되어 별도의 미완성공사비를 산정하지 않는 것으로 분석하였다.
This paper suggests a specific model that could efficiently improve the interaction and the interface between MES(Manufacturing Execution System) server and POP(Point of Production) terminal through electronic document server and electronic pen, bluetooth receiver and form paper in disassembly and process inspection works. The proposed model shows that the new method by electronic document automation system can more efficiently perform to reduce processing time for maintenance work, compared with the current approach by handwritten processing system. It is noted in case of the method by electronic document automation system that the effects of proposed model are as follows; (a) While the processing time per equipment for maintenance by the current method was 300 minutes, the processing time by the new method was 50 minutes. (b) While the processing error ratio by the current method was 20%, the error ratio by the new method was 1%.
공공 건설공사 수행 중 계약기간내 공사를 완성하지 못하고 공사기간이 연장된 경우 그 지 연 사유에 대한 귀책과 추가비용 발생의 부담주체를 놓고 계약당사자간에 논란과 분쟁이 심화되고 있다. 건설공사에 있어서 공기지연에 따른 전체 공사기간이 연장된 경우 그 원인 제공을 누가 했 는지에 대한 책임을 분명히 할 필요가 있다. 공기지연 원인의 책임구분의 결과는 분명 일 방의 권리와 타방의 손해로 직결되고 명확한 책임구분이 되지 않는 경우 분쟁이 발생하게 되며 결과적으로 어느 일방은 정당하지 않은 손해를 입게 된다. 계약법상 공사기간의 연장은 계약상대자에게 책임이 있는 사유로 인해 약정한 계약기간 내 에 공사를 완성할 수 없는 경우와, 발주기관의 사정에 의해서 공사가 연장되는 경우가 대 부분을 차지하고 있다. 일반적으로 공기지연 사건이 발생한 경우 클레임을 제기하는 주체에 그 입증책임이 있는데 보통 계약상대자인 건설사가 주장·입증을 하게 된다. 이때 이를 증명 입증시 공식적인 문서 즉, 채무자에게 채무가 있고 이를 이행하지 않는 사실과 채무자에게 귀책사유가 있는 사실, 그로 인해 일정한 손해가 발생한 사실에 대한 근거를 함께 제시하여 명확히 밝혀야 한다. 또한 그 입증 결과에 따른 손해배상으로서 계약상대자인 시공사의 책임없는 사유로 인한 계약기간의 연장이 입증되면 발주기관에 연장기간 동안 발생된 ‘실비’ 보상 요구와 계약금 액 증액 청구 등의 행위가 가능함을 명심해야 한다. 하지만, 공기 연장으로 인해 발생한 손 실에 대한 보상이 가능한지의 여부는 계약당사자가 계약 문서를 통해 어떻게 합의 하였는 지에 따라 결정될 것이지만, 공기지연에 대한 귀책이 발주자나 시공자 모두에게 없는 경우 라면 원칙적으로 공기 연장은 가능하나 이에 대한 보상은 가능하지 않은 것으로 이해하여 야 한다
This study is intended to look into the effects of employee's working environment on work loss and productivity in overseas construction sites of Korean construction companies. To achieve this, a survey was empirically carried out to overseas construction site experts. The results were as follows. The weight by 5 loss factors of overseas construction projects showed that project management environment was the highest, followed by construction company environment, owner environment, government support environment and entry country environment, which the biggest work loss factor was the project management section. The weight by loss factors of entry country environment showed that local environment was highest, followed by social environment, economical environment, political environment and cultural environment. In other words, awareness and management of weak social bases, which are not well-institutionalized as properties of most preferred loss, are important in that local environment of new entry countries is the most important thing. As for the above-mentioned findings, the most important project management of overseas construction projects will need to take advantage and have know-how for construction companies' ability to cope with a crisis or the most preferred management and loss prevention of owner environment, government support environment and entry country environment.
In the construction sites, rush (speedy construction) work have recently been overused because of budget reductions by reducing the construction duration after the long-term economic recession and construction business stagnation with institutional change including the instruction of the duration shortening bidding system and the introduction of the post-construction sales system by the Korea Research Institute for Human Settlements. Due to this, negligent accidents have frequently occurred by forcing manpower, equipment, finance, and material procurement and pressing ahead with impractical construction wok at night according to the reduction of construction schedules. Therefore, this paper has the necessity of this study to seek for alternatives to prevent negligent accidents by finding factors related to rush work in the reality that the importance for preventing negligent accidents is more emphasized while they have not been reduced in construction sites.
According to the statistics of occupational injuries in 2013, the work platforms were main objects causing fall injuries in construction sites. But many scaffold and platform workers use and install the work platforms and the fixed and mobile scaffolding without considering about safety and health standards. We had done a nationwide survey about how the platform workers obey safety and health standards. As the result of this survey, in order to ensure the safety of the work platforms, we founded that the platform workers must obey the safety and health standards when using and installing the work platforms. To improve the safety and health conscious of the workers, it needs to educate a worker on safety and health standards for work platforms. Also, to effectively prevent constructin injuries for the work platforms, it is rextricted for workers to use only safety certified work platforms. And, before installing and using work platforms, it needs to make a work plan for work platforms and obey it.

During five years (Year 2009~2013), Total victims of 72 %( 81,560 people) and those 50.6 %( 1,258 people) of death accident occurs in small scale construction site which operate 2 million USD less construction budget. Especially, falling death accident account for 785 people, in the share of 33.2 %( 261 people) death disaster takes due to defect of original cause materials. The major safety issues in small scale work place take place while scaffold installation, disassembling, work-plate improper installation or non-professional skills of workers. Furthermore, labor subcontract systems make small construction site shortage of resources. Those workers regard work-plate as unnecessary and consumables supplies. Because of that most of workers use unsafe workplace in most construction site. Therefore, in order to prevent falling accident occurring in small scale work site, government should organize related regulations such as “Work site safety construction method” and then expands education support, financial aid, and sourcing safety supplies for work plate which offer broad variety experiences. Also, introduce certificate solutions for various work plates to improve safety function such as anchoring type method and anti sliding function.

In this paper, a research was carried out to extract the more concrete and systematic method for the safety management of skyscraper construction. Here, the most risky processes in the construction of skyscrapers were extracted through the general risk evaluation for safety management processes and their characteristics and trends were analyzed for the suggestion of safety management methods and safety inspection factors in the construction of skyscrapers, as well as for the suggestion of prevention measures for major disasters. The result of this paper will be well used as a basic data in establishing the manual necessary for executing the construction of skyscrapers more safely than the present where there is no specific direction for the safe management of skyscraper construction yet.

Aa a result, most of the project with low-priced contract needs a speedy progress during all construction period. For the last five years major incident frequently occurs and results in the death of 189 workers at major top 6 construction builders. In most recent 10 years, the cause of major incidents happened in construction company is the speedy construction work that is affecting on the safety management. To prevent these accidents in the speedy construction work, four factors were chosed and analysed such as the personnel/organization, the working budget, the subcontractor selection and the employee motivation. The head office taked the support plan and tested it at the pilot work site. It showed a reduced accident and the harmful factors can be eliminated. It should be able to apply to the field to secure safety and prevent accidents.
This study compared the disasters in construction field under construction amount of 300,000,000 won and the whole construction fields in order to improve the efficacy of various industrial safety and health policies and services and examined the characteristics of disasters in construction field under 300,000,000 won. It also examined, compared and analyzed the characteristics of disaster in construction field under construction amount of 300,000,000 won that disaster prevention technical experts saw. The subjects of comparison were selected with statistical data of disaster for 2011 and those of disaster in construction field under construction amount of 300,000,000 won from January to August of 2012. And questionnaire was conducted with technical instruction experts of small-sized construction field and priority was drawn, compared and analyzed with AHP. Consequently, the results of different views between actual disaster data and experts' views were obtained. Therefore, this study suggested the characteristics of disaster in construction field under construction amount of 300,000,000 won and presented the methods for improving disaster prevention technical experts.

There are insufficient models that find problems and solutions for accident prevention through risk assessment and suggest safe work process and work instruction from foundation works to finish work for accident decrease. This paper presents a quantitative risk assessment model by analysis of risk factors in each process such as appurtenant works, temporary works, structural works, equipment work, finishing work and etc based on accident examples and investigation on actual condition in plants construction work. In addition, the safety management system was developed to perform risk assessment of plants construction and use it for effective safety training for labor.
Proportion of falling from height accident at construction work accounts for more than 40%, and the number of injuries is getting increased. So without considering falling from height, we can say that it's hard to achieve our goal(accident prevention). Another critical point that we have to think about theses days is the fact that construction workers are getting older. To be specific, the number of workers who are above 50 years old accounts for 65.6% among the fatalities(2007~2011, KOSHA inspection). Accordingly, to effectively prevent construction accedents, especially falls from height, we need to focus on motion analysis of older construction workers and then make suitable measures for growing accident rates at construction work.

Because of this, a method was drawn which could grasp the present state of construction equipment management and manage safety of the equipment more easily for accident prevention by choosing 2 kinds of Construction equipment which cause safety accident frequently among the equipment mainly used in construction site. This study suggested a method about construction equipment safety management using "smart phone" base which could be used in safety management for construction equipment by whomever in construction site. After attachment of QR code included safety checklist, It became possible that site managers could check more efficiently by scanning with their smart phone when they inspect equipment. Moreover, by the construction interested who didn't know what and how they have to inspect could point out unsafe condition in the early stage of equipment entering or take unsafe one out of the site by using new smart phone safety checking system is installed, it became possible that critical accident caused by construction equipment was prevented in advance.

Risk Assessment, a basis of health and safety management system, is an calamity prevention activity which regularly measure the level of a risk to passively improve potential hazard. A problem, the assessment not being improved to be applied to the construction work site where requires diversity and complexity, causes the assessment to be inefficient to bring quality results. A study on the investigates and compares the surveyed degree of recognitions of workers who works in companies executing the risk assessment By the investigation and comparison, it is expected to bring the better solution for early and efficient application for those companies which are not taking the risk assessment.
