엔터테인먼트 산업의 새로운 수익창출을 위해 사업다각화는 반드시 필요하며, 이러한 프랜차이즈 산업에 있어서 중요한 컨텐츠는 구체적으로 표현된 문구나 이미지보다는 창작자 또는 창작물의 개성 내지 정체성이라고 할 수 있다. 그러나 이러한 컨텐츠는 아이디어와 표현 이분법에 기초하고 있는 저작권법 하에서는 저작권으로 보호받기가 어려운 것이 사실이다. 한편 현재까지도 실무상 광범위하게 사용되고 있는‘판권’용어는 법률상 사어에 불과하여 그것이 구체적으로 무엇을 의미하는지는 개개의 계약내용을 분석하여 당사자의 의사를 해석하여야 한다. 그러나 상황에 따라‘판권’이라는 용어가 법률에 규정된 권리 이외의 것을 의미하는 경우가 종종 발견되며, 따라서‘판권’은 법률상 권리보다 더욱 폭넓은 권리로 인식되고 있는 것으로 보인다. 그렇다면“현재의 지적재산권법 상 권리로 보호하는 것은 불가능하지만, 산업적으로 경제적인 가치가 매우 크고 당사자 간에 권리로 보호할 필요성을 인정하고 있는 컨텐츠”를 의율하는 개념으로서‘판권’이라는 용어를 정의하여 실무상 활용하는 것을 검토할 필요가 있다고 생각된다. 이와 같은 조치만으로‘판권’이 침해금지의 권원으로 작동하기에는 부족하지만, 최근 판례의 경향에 따라 민법상 불법행위로 구성하여 권리보호를 하는 방안을 도모할 수 있을 것으로 보인다. 또한‘판권’개념을 계약 상 인정함으로써 거래 상 수익창출 모델을 활성화시키는 것이 우리 엔터테인먼트 산업의 파이를 키우는 데에 큰 도움이 되지 않을까 한다.

The law(construction standard specification, construction, standard-work regulation, Industry safety standard related regulation) related to the installation of scaffolding being used commonly on the construction site is regulated that the gap of ledger is within 1.5m and first ledger is within 2m. The gap of ledger here is essential for the stability of scaffolding structure. But it is determined that it is possible for the gap of ledger is applied by explaining safety handrail as ledger, because of the fact that in current, on the construction site, safety handrail is installed with the material of scaffolding ledger as a steel tube pipe. On this study, it is aimed to guarantee the safety by analyzing the ledger of scaffolding practically and prevent the accident of manager and laborer through the actualization.

The research presents a guideline for quality practitioners to provide a full comprehension of differences in theoretical and practical interpretations of assumed sampling errors of and significance probability of calculated p-value. Besides, the study recommends the use of statistical inferences methods with known parameters to identify the improvement effects. In practice, the quality practitioners obtain the known parameters through systematic quality Database (DB) activities.

The papaer reviews four theoretical acceptance sampling plans as OC (Operating Characteristics) curve based inspection, rectifying inspection, switching inspection, and continuous inspection. In addition, the study presents practical limitations of theoretical acceptance sampling by attribute and by variable. Finally, following research also recommends the sampling inspection based on production technology. However, the inspection method requires quality expertise with various experience and implicit knowledge of the field.

The study interprets each of three classification models based on Bath-Tub Failure Rate (BTFR), Extreme Value Distribution (EVD) and Conjugate Bayesian Distribution (CBD). The classification model based on BTFR is analyzed by three failure patterns of decreasing, constant, or increasing which utilize systematic management strategies for reliability of time. Distribution model based on BTFR is identified using individual factors for each of three corresponding cases. First, in case of using shape parameter, the distribution based on BTFR is analyzed with a factor of component or part number. In case of using scale parameter, the distribution model based on BTFR is analyzed with a factor of time precision. Meanwhile, in case of using location parameter, the distribution model based on BTFR is analyzed with a factor of guarantee time. The classification model based on EVD is assorted into long-tailed distribution, medium-tailed distribution, and short-tailed distribution by the length of right-tail in distribution, and depended on asymptotic reliability property which signifies skewness and kurtosis of distribution curve. Furthermore, the classification model based on CBD is relied upon conjugate distribution relations between prior function, likelihood function and posterior function for dimension reduction and easy tractability under the occasion of Bayesian posterior updating.

In the policy management system of the safety&health(same as the environment and the quality), the documentation of the management system is required in various international standards & guides. In case of 3 level classification of the system documents, it generally will be identified such name as the manual, the procedure(or the process) and the job instruction. Each level of the document has the unique role and usage though, the job instructions, especially, would be developed to support the practical job worker. Considering such document level, the job instructions should be reflect the latest know-how of the job-handling methods. And that, it should be used at any times by the related job worker. This paper is prepared for surveying the actual usage status of the job instructions of the domestic enterprises holding ISO certificate and trying to suggest the better way of application of the system documents.

지난 10년 동안 법원에서는 일반 형사사범에 대하여 집행유예 선고 시 많은 경우 사회봉사명령을 부과하여 외형적으로는 사회봉사명령제도가 정착되어 있는 것으로 보인다. 그런데 법원에서는 사회봉사명령을 어떠한 범죄에 대하여, 어느 정도, 어떠한 내용으로 부과하여야 하는 문제에 있어서 진지한 고민과 그 효과를 고려하기 보다는 과거의 관행대로 부과해온 경향이 적지 않아 보인다. 사회봉사명령제도의 발전은 집행하는 보호관찰소 만의 일이 아니고 부과하는 법원의 결정내용에 따라 이루어 질 수 있다. 법원에서는 우선 사회봉사명령 제도의 중요성을 인식하는 것이 중요하고, 그 부과 대상의 확대와 시간의 탄력적 부과를 통하여 종래의 관행에 안주하지 말고 피고인의 재사회화를 위한 과감한 부과결정을 하여야 할 것이다. 또한 봉사내용의 지정, 봉사기관에 대한 법률상의 감독권의 행사와 집행유예의 취소에 있어서도 사회봉사명령이 법원의 권한임을 인식하고 그 권한 행사에 주저하지 말아야 할 것이다.

한국에서의 특허법 관련 실무 동향 가운데 빠뜨릴 수 없는 것은 2007. 1. 3. 법률 제8197호로 이루어진 특허법의 개정1)이다. 특허법은 위 개정을 통하여 상세한 설명 기재요건의 완화, 특허청구범위 제출의 유예 및 작성방법의 다양화, 청구항 별 심사결과의 통지 등 출원인의 편의를 한층 도모하는 방향으로 괄목할 변화를 꾀하였다. 이로써 출원인은 종래 명세서 작성에 요구되던 엄격한 형식성을 탈피하여 비교적 자유롭게 자신의 발명을 기술(記述)하고 권리를 청구할 수 있게 되었으며 심사과정에서 자신이 작성한 청구항 전체에 관하여 특허적 격성을 검토 받아 적절한 후속조치를 할 수 있게 되었다. 무엇보다 위와 같은 법개정은‘명세서 기재 불비’에 관한 향후 심사실무 및 판례 형성에 근본적 변화를 가져올 것이어서 그 의미가 매우 크다. 한편, 근래 3, 4년간 선고된 특허 관련 대법원판례 가운데는 침해소송에서의 특허무효항변의 가부, 출원인이 명세서에 종래기술로 기재한 발명을 곧바로 공지된 발명으로 볼 것인지 여부, 선택발명의 명세서 기재요건, 방법의 형태로 특정된 물건발명에 있어서의 진보성 판단기준 등에 관해 선례적 가치를 가지는 것들이 포함되어 있다. 아래에서는 우선 2007. 1. 3.자 특허법의 주요 개정내용을 일별하고 앞서 언급한 판례들을 소개하면서 이를 둘러싼 문제점 등을 간단히 살펴보기로 한다.

해양사고가 발생하게 되면 총론적으로는 해원의 형사책임은 자기부죄의 원칙상 해원이 직접 부담하지 아니할 수 없다. 그러므로 해원의 형사책임에 대한 대책은 형사상의 절차(영장실질심사제도, 구속적부심제도 등)를 최대한 이용하여 자신의 형사책임을 줄이는 방법 밖에는 없을 것이다. 기존법률의 개정을 통해 형벌을 낮추는 것도 하나의 방법이 될 것이다. 각론적으로 벌금 관련한 예로서 현행 해양오염방지법상의 과실로 인한 기름유출사고의 벌금인 3천만원은 유출량에 관계없이 최고액수가 벌금으로 나오는 경향이 있으므로 이를 유출량에 따라 차등화 시키는 것도 고려해볼 가치가 있을 것으로 판단된다. P&I의 벌금납부는 일반의 인식과는 달리 P&I가 법적의무를 부담하거나 P&I납부를 인정하는 경우에만 전보가 가능하다. 이러한 문제를 해결하기 위해서는 새로운 집단적 보험이나 공제제도를 신설하는 것도 하나의 대안이 될 것이다. 또한 해원들은 법률적인 문제에 대하여 전문가가 아니므로 법률적인 문제에 연루되게 되면 변호사 등 법률전문가의 조력을 체계적으로 받을 수 있도록 선주협회나 해기사협회 등에서 대안을 마련할 필요가 있다. (예 농어민무료법률구조지원사업 등). 끝으로 별도의 법률을 제정하든지 그렇지 않으면 기존의 교통사고처리특례법을 개정하여 해양사고부분을 삽입하는 것도 대안일 수 있을 것이다.

교정현장에서 근무하는 사람들이 전문성을 갖도록 하기 위해서 어떠한 교육을 받아야 하는가에 대한 부분은 매우 특별하다. 이는 교정공무원의 업무가 범죄피의자 또는 수형자를 대상으로 한 재범방지를 위한 교육이기 때문이다. 사실상 교정의 개념을 정의함에 있어서는 여러가지 주장이 있으나 대체적으로 교정이란 범죄피의자나 수형자를 관리할 책임이 있는 조직, 시설, 서비스, 프로그램의 집합이라고 할 수 있다. 교정공무원은 재판의 결과에 따른 형별을 집행하고 다른 한편으로는 수용자를 과학적으로 분류하여 개별적으로 교정교육을 실시하여야 하는 이중적인 임무를 수행하는 교정의 주체이다. 따라서 전문적인 직무지식 뿐만 아니라 범죄자의 범죄성 교정을 위한 교화기법, 교정질서의 유지나 각종 사고의 방지를 위한 심신의 단련과 계구의 사용법 등에 이르는 광범위한 분야에 대한 지식을 갖추어야 하므로 끊임없는 인격의 수양 과 교육훈련을 통한 전문성 향상이 요구된다. 본 연구에서는 교정서비스의 제공자인 교정공무원의 전문성을 향상시키기 위한 방안을 모색하기 위하여 신규채용된 교정공무원을 조직에 적응시키고 그들로 하여금 직무를 수행하는데 필요한 지식과 기술을 습득케 할 목적으로 실시되는 신규자과정의 교육훈련의 현황을 파악하고 개선방안을 제시해 보았다. 특히 신규채용자의 교육훈련의 문제점 및 개선방안을 모색하는 과정에서 먼저 미국을 중심으로 하는 주요 외국의 교정공무원 교육훈련 프로그램을 살펴보고, 같은 형사사법체계의 한 축으로서 운영되고 있는 우리나라 경찰의 신임순경 교육훈련프로그램을 비교하였다.

A company needs low cost and high efficient S/W tools to improve the white color productivity in daily operation, These needs may be satisfied by end-user knowledge management system to be suggested in this paper. We suggest that the end-user knowledge management is not made by specialized developer but directly made by end-users of some related managers using company-wide DB and department DB. We expect that this end-user knowledge management system will increase the efficiency of end-user daily operation and minimize the total life cycle cost of end-user computing system in industry. The suggested end-user knowledge management system has been tested in some companies through the training course.

본 논문은 선박 기관사의 실무 능력 평가를 위한 CAI 시스템의 설계와 구현에 관한 것이다. 지금까지 실무 기관사들을 위한 평가 시험은 주로 필답 시험과 구두 시험에 의존해 왔지만, 컴퓨터를 이용할 CAI 시스템을 사용함으로써 평가에 걸리는 시간을 단축할 뿐만 아니라 효율적인 평가를 할 수 있다. 시스템의 구성은 영역 지식, 질문, 예제 등으로 구성되어 있으며 13 관련 분야에 바탕을 두고 있다. 이 시스템의 사용자는 교사, 실습생, 학생, 선박관련 전문가들이 될 수 있다. 또한 이 시스템을 Client/server 환경으로 확장하기 위하여 Oracle 7.3과 PowerBuilder 5.0을 이용한 실험적인 환경을 설계하고 대표적인 Client page를 보여주고 있다.
