        소말리아 해적에 의한 해운에 대한 위협의 증가는 해운선사의 민간해상보안회사(PMSC) 사용을 크게 증가시키는 계기가 되었다. 민간해상보안회사의 사용은 소말리아 해적의 위협에 대해 상선을 보호하기 위한 매우 효과적인 해적대책이라고 판단된다. 그러나 해상에서 민간해상보안회사와 민간무장보안요원(PCASP)의 사용을 둘러싼 여러 가지 법적 및 실질적인 문제가 발생하고 있다. 본 연구는 인도양과 아덴만 해역의 소말리아 해적행위로부터 상선을 보호하기 위한 민간해상보안회사와 민간무장보안요원의 승선에 관한 국제협약, 지침 및 권고상의 민간무장보안요원의 규제에 관한 규정 및 그 문제점을 분석하고 이에 대한 해결방안을 제시하는데 있다. 특히, 민간무장보안요원의 승선에 관한 관할권 문제, 정당방위에 있어서 민간무장요원에 의한 무력사용의 권한 및 민간해상보안회사의 사용에 대한 승인 권한을 중심으로 검토 및 분석한다. 본 연구의 결과 현재 소말리아 해적행위로부터 선박을 보호하기 위한 민간해상보안회사와 민간무장보안요원의 사용에 관한 법률체계가 복잡하고, 때로는 애매하거나 불일치 및 유동적인 상태인 것으로 나타나고 있다. 따라서 유엔해양법협약상의 민간무장보안요원의 승선에 관한 현행 규칙의 해석과 새로운 규칙의 제정에 관한 법률체계를 조정하기 위한 국제적인 노력이 필요하다고 판단된다. 또한 민간해상보안회사를 규제하기 위한 관련 국내법을 시급히 제정할 것을 제안하였다.

        We investigated the characteristics of electroless plated Cu films on screen printed Ag/Anodized Al substrate. Cu plating was attempted using neutral electroless plating processes to minimize damage of the anodized Al substrate; this method used sodium hypophosphite instead of formaldehyde as a reducing agent. The basic electroless solution consisted of CuSO4·5H2O as the main metal source, NaH2PO2·H2O as the reducing agent, C6H5Na3O7·2H2O and NH4Cl as the complex agents, and NiSO4·6H2O as the catalyser for the oxidation of the reducing agent, dissolved in deionized water. The pH of the Cu plating solutions was adjusted using NH4OH. According to the variation of pH in the range of 6.5~8, the electroless plated Cu films were coated on screen printed Ag pattern/anodized Al/Al at 70˚C. We investigated the surface morphology change of the Cu films using FE-SEM (Field Emission Scanning Electron Microscopy). The chemical composition of the Cu film was determined using XPS (X-ray Photoelectron Spectroscopy). The crystal structures of the Cu films were investigated using XRD (X-ray Diffraction). Using electroless plating at pH 7, the structures of the plated Cu-rich films were typical fcc-Cu; however, a slight Ni component was co-deposited. Finally, we found that the formation of Cu film plated selectively on PCB without any lithography is possible using a neutral electroless plating process.

        Technical developments of electric vehicles have been progressed very actively. Especially there are great technical achievements of battery for the electric vehicles to store energy from the outside source. Also there are numerous efforts for improvement charging infrastructure and charging system of the battery. And that is supporting this technology. For example On-Board Charger (OBC) is a battery charging system attached to the vehicle to operate the car. On-Board Charger is designed in manner of consideration such subjects: control via communication with other vehicle’s controller, improve the reliability as the security part, decrease of the life span of the battery due to temperature change during charging and discharging process, high cost of using parts for the high current rating and limitation of increasing the battery capacity. In this paper, there will be a deep discussion of designing and implementing the On-Board Charger to attach to the vehicles, which has superior cooling quality by effective radiant heat design and vibration and shock resistant design

Through the analysis of the unique advantages and the recent new cases of straw board buildings in Harbin, and the current obstacles to application, The effective ways and the feasible solutions to promote sustainable straw board buildings are summarized.

        Developing proper reduction strategies of indoor radon which have been an important issue in Korea requires proper information on source characteristics a phosphate gypsum board which is a common building material used for inter-wall thermal protection in Korea could be a major source of indoor radon level. This study evaluated the correlation between indoor radon concentration and the attribution of gypsum board content in building materials. In this study we valuated indoor/outdoor radon from 58 facilities selected based on the information availability of gypsum content in the building material across 8 different cities in Korea. Our results showed that indoor radon concentrations were 2 to 3 times higher than outdoor but those results were not significantly attributed from gypsum contents in the building material. Indeed, phosphate content in gypsum board did not significantly play a role in indoor radon level variations. It is concluded that physical environmental condition such as temperature, relative humidity, radon exhalation rate out of each building materials, as well as pathway from external sources (e.g., soil) needs to be identified to develop indoor radon reduction strategies.

        LIVE/DEAD® BacLight™ and alamarBlue® are fluorescent materials used for the enumeration of live and dead bacteria. LIVE/DEAD® BacLight™ is generally used for confocal microscopy applications to differentiate live from dead bacteria in a biofilm or planktonic state. AlamarBlue® has also been used widely to assay live and dead bacteria in a planktonic state. Whilst these materials are successfully utilized in experiments to discriminate live from dead bacteria for several species of bacteria, the application of these techniques to oral bacteria is limited to the use of LIVE/ DEAD® BacLight™ in biofilm studies. In our present study, we assessed whether these two methods could enumerate live and dead oral bacterial species in a planktonic state. We tested the reagents on Streptococcus mutans, Streptococcus sobrinus, Porphyromonas gingivalis, Aggregatibacter actinomycetemcomitans and Enterococcus faecalis and found that only LIVE/DEAD® BacLight™ could differentiate live from dead cells for all five of these oral strains. AlamarBlue® was not effective in this regard for P. gingivalis or A. actinomycetemcomitans. In addition, the differentiation of live and dead bacterial cells by alamarBlue® could not be performed for concentrations lower than 2 × 106 cells/ml. Our data thus indicate that LIVE/DEAD® BacLight™ is a more effective reagent for this analysis.

        This study challenges constitutional problems of the identification regulation on online web-board Games, which is about to be reviewed by Ministry of Government Legislation. The regulation comprises imposition of duty for online web-board game publisher to identify every game user whenever the game user plays or accesses the online web-board game. The regulation is deemed to be unconstitutional because 1) it is not an effective mean to prevent online web-board game from being misused as gambling 2) it violates free speech right, right on personal information as well as privacy. As the Constitutional Court of Korea has already decided that internet real-name system, which imposed identification duty online bulletin board, is unconstitutional, any regulator or legislator should not use identification regulation without eliminating its unconstitutionality.

        In recent years, the government is trying to regulate the web board games - poker, gostop etc. with the amendment of the executive order regarding the game law. The main regulation of this order is to regulate the maximum amount of betting the game as a ten thousand won per game and a hundred thousand won a day. if these are not obeyed, the gamer and game company will be punished. Therefore, these regulations need to be reviewed in terms of legal issues with a strict examination. However the regulation on the limits of betting in a game seems not to be justified with the constitutional standards - the principle of apparentness (definitude), the principle banning excessive enforcement when restricting the basic rights of people - in this case, the general human rights and liberties to act of gamers and the freedom of profession and speech of game operators(company). It is also questioned that it might infringe the essense of the legal institution of game and rights, and cause the paradox of excessive regulation.

        Shear test on hollow-core slabs that using board-type lightweight materials is performed. Lightweight materials are positioned in the slabs, it separate into two parts vertically. It is possible that each parts act independently and the concrete columns, in the middle of slab, can resist this action. Thus we have to check horizontal shear force on part-column connection besides vertical shear force. Also effective cross-sectional area shear force which is considered by existing study is checked.

        The educational process and result of onboard training should be evaluated according to the 1995 Amendments to the International Convention on Standards of Training, Certification and Watch-keeping for seafarers(STCW), 1978. In particular, the revised Convention requires that a trainee's seagoing service must be recorded in each cadet's Training Record Book approved by the maritime administration responsible for the issuance of certificates of competency. Trainees for certification under regulation III/1 of the STCW Convention are required to complete an approved on-board training programme. The purpose of this paper is to understand the compliance of the education for an approved on-board training programme. The questionnaire was distributed among 110 cadets being trained on board the training ship of the maritime college of the Mokpo National Maritime University. In this study, we conducted the questionnaire survey which is related to the on-board training programme such as marine engineering; controlling the operation of the ship and care for persons on board; electrical, electronic and control engineering; etc. The survey revealed that onboard training program was normally satisfactory, however, lack of practical training tools and time have accounted for most of the reasons for dissatisfaction. Therefore, it is our goal to enhance the satisfactory value of onboard training education by analyzing the reason of the dissatisfaction.

        In this study, the heat flow analysis compatible commercial code CFX 11 was used to develop the structure inside PCB circuit board devices, which could stable radiant heat as well as the cooling device within it. In case of modifying the arrangement of electronic parts on the PCB inside the multi channel temperature measurement board devices, radiant heat effects did not show a rising tendency, whereas the overall temperature went down in case of installing the vents in the outer case of PCB circuit board devices. In terms of installation location, it was the most appropriate to install it on the electronic parts with no heat. Besides, in case of mounting the fan as a cooling device by considering various user environments for multi channel temperature measurement board devices, the radiant heat effects were shown higher than in case of installing the vents, and the middle sections were the most appropriate to its installation location. In case of changing the wind quantity of the fan from its selected installation location, the best radiant heat effects were shown at high speed as expected.

        차(􃹍) 위원회 대 장 뤼크 뒤송 사건이란, 프랑스인 장 뤼크 뒤송이‘다르질링’이라는 문구와 찻주전자 그림이 조합된 상표를 등록해 도서, 잡지, 상담업 등에 사용하자, 인도 통상산업부 산하로 다르질링 지역에서 생산되는 차를 관리하는 인도 차위원회가 뒤송을 상대로 해당 상표의 취소와 손해배상 등을 구하며 파리지방법원에 소제기한 사건이다. 준거법이 무엇인지, 등록을 하지 않은 상태에서도 ‘다르질링’이 지리적 표시로서 보호되는지, 차위원회에게 원고적격이 있는지, 차와는 분야가 다른 도서, 상담업 등에 상표를 사용하는 것(사용관련성이 없는 이른바 교차 유형)도 지리적 표시 침해인지 등이 쟁점이 되었다. 이에 제1심 법원은 원고 패소 판결을 선고하였으나, 항소심 법원인 파리 항소법원은 항소를 인용하고 제1심 판결을 취소하는 원고 승소 판결(대상판결)을 선고하였다. 대상판결은 결과적으로는 지리적 표시의 침해를 인정했지만, 내용 면에서는 민법 등 일반 법리를 원용한 것이 특색이다. 침해 당시 이 사건 지리적 표시등록이 없었던 점, 침해 상표와 피침해 지리적 표시의 사용관련성이 부정되는 점을 고려한 것으로 본다. 한국법상으로는 지리적 표시 등록을 해야 비로소 지리적 표시권이 발생하므로, 국내 사안에도 비슷한 논리를 적용할 수 있을 것이다.

        목적 : 본 연구의 목적은 신입 작업치료사의 국가시험 실기과목 점수와 직무능력의 상관관계를 분석하여 국가시험 실기과목이 직무능력을 평가하는데 타당한지 알아보는 것이다. 연구방법 : 전국의 21개 임상기관에서 59명의 신입 작업치료사(경력 1년 미만)를 대상으로 책임 작업치료사가 신입 작업치료사의 직무 능력을 직무능력평가 척도를 이용하여 평가한 결과와 신입 작업치료사의 국가시험 실기시험 점수의 상관관계를 분석하였다. 결과 : 책임 작업치료사의 직무 능력 평가에 의한 총점과 신입 작업치료사의 실기시험 점수는 유의한 양의 상관관계(r=.414)를 나타내었다. 책임 작업치료사는 신입 작업치료사의 직무능력 중에서 자기관리에 대한 적극성과 인성 영역을 높게 평가하였고 평균 총점은 106.29이고 표준편차가 20.17이었다. 신입 작업치료사는 자가평가에서 인성과 대인관계 영역의 직무능력을 높게 평가 하였으며, 자가평가 총점은 97.49점이었다. 결론 : 현행 작업치료사 국가시험의 실기과목은 신입 작업치료사가 임상에서 수행하는 직무능력과 유의 상관관계를 보였다. 그러나 실기과목은 작업치료사의 직무능력을 평가하기에 타당하지만 높은 상관성이 아니므로 이를 개선할 수 있는 방안이 논의되어야 한다.

        This paper has fabricated insulation gang-form adhering general gang-form to the polyisocyanurate board and analyzed type of members, temperature record by locations and strength development after placing the concrete, in order to ensure efficient concrete quality under cold weather. According to our test, we can see that general gang-form member with curing under the same conditions as the actual field has a trend of constantly decreasing concrete temperature regardless to surface or central area due to rapid outdoor air temperature reduction, while in the case of insulation gang-from I and II, temperature increased up to around 25℃ after 12 hours under rapid outdoor air temperature change and temperature distribution did not appear large separation according to hydration reaction measurement locations. In addition, results of measurement for temperature records on weak insulation area by types of gang-forms showed that the temperature record distribution on the form tie surface and horizontal bar surface of angle bar has generally similar trend as the temperature records on the surface of the insulation gang-form, while corner area of the insulation gang-form did not have large insulation effect. It is determined that it requires additional curing measure for the weak corner area of the insulation gang-form in the future.
